Just to catch those who might have missed the other strand message

Hi Everyone this is to let you know that the SARC website has been disabled due to the numbersof hits we have exceeded our monthly bandwith allowance of 100mbs. we are now in the process of transfering to another host which I am paying for and hope to be up  again within the next few days.
       I am in a bit of a shock as we didnot expect to have so many hits

If you guys at  IWMH/SARCO are soooooooooooooooo in the loop how come you are relying on information from Anna.Who last week was the devil incarnate. It  would seem you have no links at the top of the chain and are actually a laughing stock  in chamber s and with the administration . Actually there was  a cartoon about your campaign in one of the local papers  It was entitled  "  White Scab want their houses in the dry land "     to you and I that means dessert               think on

I pmd Garcia today he and I seem to be the only  buyers so far who bought with QSD . I hope we can find more because his theory is good but would prove too costly unless we find more people who bought  through QSD.If things dont pan out the way you guys want his theory could also help your cause because you have formed a larger group. good luck in what ever you want as I said in one of my previous posts    -     truse   -

We also have the dream that our house (Azucena) will be built by San José builders at Santa Ana del Monte Golf near Jumilla and have signed up with our solicitors to fight for us at a cost of 2,300 euros.

We first came out in 2005 and signed up for an off-plan house and put down a deposit to secure the price, once back home we had to take out a loan for the rest of the main deposit.

According to our paperwork our property should have been ready in May 2007. We even came out in September 2006 and were taken by our agents to choose and order our tiles for floor and bathroom and kitchen and then the furniture/white goods/kitchen and household items, on which we had to put a deposit.

Because of the delay, having sold our house, we sent out 20 boxes to be stored and then stayed with various family members living out of a suitcase, which became very stressful for us pensioners. So we informed our agents and moved out to Spain October 2007 and have been able to long-term rent whilst waiting.

On talking to others our main complaint is lack of honesty from any of the three agents involved, ie builders, agents and solicitors.

We are prepared to hang on for as long as possible for our dream, but if it fails we will have to take out a loan to buy something in this area where we have made some friends.

Obviously we do not want any comeback, so please withhold our names.

thee seems to be other people that want their house as well in that desert

Says it all unfortunately.  These are the areas that have gone wrong and sadly the ones that matter most.

Hi Brian,
          I agree that there does seem to be a lack of honesty between those three elements but as the said they would still prefer to have their house if possible. It may be that those agents will have to change their attitudes and realise that PR is not just about how good you are but about getting the right informtion out to those concerned and working with them I do hope they get their dream and mine and yours to and all those what ever they wish wheter property or thier money

Hi All.
Various people are stating info from Anna is deposit moneys are safe in seperate account. My interpretation was information suggested this but confirmation was being requested and so far as i know has not yet beeen recieved.
I hope someone proves me wrong but it looks to me once again hearsay has magically been transformed into fact.

Ken, I doubt very much if you are wrong.  Nothing they have done has been within or complied with the Law  to us purchasers to-date and now it it out of there hands.  It is disgusting that even those few with BG's now have to spend more hard earned cash to get back what's rightly there own.

Thank you to Martin for being direct and giving us information rather than heresay.  My own Lawyer is in agreement with your philosophy of speaking only facts.

Santa Ana del Monte Residents Co operative Update
 
 
Dear All,
SARC is made up of purchasers who are working together and has no hidden agenda. SARC is working for the purchasers and no one else and in a very short period of time has established its own web site upon which to place information and documents, received in response to our questions and requests for information.
 
SARC has a copy of the licence for the build of the bases and have spoken to the MD of SJ regarding the completion of the project. The final licence, we have been told is available and requires 5 million Euros to be deposited with the Town Hall. We have also been told that purchasers will be offered new purchase contracts, with a new completion date when the administrators complete their process. Please remember that the foundations are in for a large number of properties, the golf course landscaped and planting begun, gatehouses up and roads being worked on plus the location is highly desirable.
 
Regarding getting our message out into the press, we are doing that and letters have been published in all three of the English papers in Murcia/Costa Blanca. We are also liaising with the press in digging for information and supporting documentation to ensure validity. 

Getting the message out that purchasers are in an awful predicament has begun and we will be expanding on the plight of all purchasers and the need for a speedy and beneficial conclusion for all.
 
We have clearly identified we can have little effect on a Court process, as this follows legal procedures which tend to be inflexible. However, SARC can and is influencing the administration process, with the aim of getting the project continued and thus prevent the need for a lengthy legal process for those who prefer to not to have to wait years for the return of their money. To that end we will be pushing for realistic and acceptable time frames, bank guarantees for deposits and the possibility of some form of compensation for purchasers for all of the delays and stress.
 
 SARC is open to all purchasers to join and can be done so by sending an email to santaandelmonte@hotmail.com with your name and plot number. We wish for all to have the opportunity to have their homes and we urge you to join with your neighbours to be and fight for your property and not  with one and other.

Can i suggest that now it has come to the 'game over' stage, that Tony, you place your considerable effort into exposing the builders and getting a result.

Please read the very good strand about seeking press coverage, and pointing out the corrupt Spanish house building industry, which i have been talking about for weeks.

With your energy Tony and Brian......you could make a difference and achieve something.  I have to say i think that the i want my house is looking pretty dead, sorry.

         Thanks for the sentiment but we still have a few weeks yet to try and make a difference if we can we will put or efforts to that task after the fat lady has sung we still have a small time before the administrators final analysys is produced.
          But if which ever way it goes at least we will have tried this avenue first. Then we can consider options we might support something but I believe that as a buillder they seem to have done things right at SADM legaly so what of those that enticed us the agents and their solicitors who are making money out of our misfortune, where were those compulsary bank gaurentees that both said nothing about and took our money. that might be a bigger campaigne lets just wait until they have submitted their report

I understand the sentiments for this campaign but i will say it again, you may well ahve spoken to Almudena @SJG or any other representative of SJG (i meet them frequent believe me!!) and they all hold out hope that they will pull through this. I can understand them saying that as nearly all of the employees have a vested investment in the company staying afloat and also the need to maintain their customer base.

Like on another thread where I ask for someone else to enquiry through alternative channels, can I ask you also to take some time and effort away from the campaign to gauge the feelings on the streets of Orihuela, Torrevieja and Costa Blanca. It may give you a total different understanding of the challenge ahead of you guys if you are to be successful. As for the newspapers, you know what they say, todays news, tomorrows chip paper................and without disrespect, i pick up approx 20-30 of these papers per week to line the dogs litter tray, and they are published for locals (who are well aware of the SJG issue and if you do what i ask you'll see the impact that has) or holidaymakers who again to be honest, don't give a s**t whether we get money back or keep our house. have you spoken to any solicitors that openly say that they believe this will go ahead and not to take out Power of Attorney or get on the Creditors List

Gauge what people think out here, those that will be providing investment and services to these and other urbs planned along the Costa Blanca and see if you have the same opinion. All you need to do is ask people or busineses about Trampolin Hills.

Just a suggestion of course

OK Brian/Tony/Darren....everyone interested

How about a deal with each other.

My views are not secret to you all, i think the Spanish property market is corrupt, i think there are backhanders in town halls, land parcels sold as developments with less than even chance of getting permission, customers left high and dry, deposits mis-appropriated......the list in my mind goes on and on.  

And still we have hopes to be dashed for those who continue to place trust in this sadly corrupt empirical third world system.  As i say these are my views. The industry needs a shake up.

As Brianmags suggests, someone put a timelimit on the administration delivering a report, someone please find out when that will be.  The legal system surely dosnt operate on a manyana as well does it?   Find out the date and then evaluate the decision or information, we all have lawyers lets use them to get this information, we will have paid for it anyway.

Lets make a pact,   When this report is delivered...lets all agree to decide the best way forward then.......and go for it, big time. If it has gone pear shaped then fire both barrels.

Press, TV, Fraud squad, taxman, bailiffs.......the lot.....lets go for them with a collective energy and scare the friggin pants off em.

Any takers?  To be honest i cant listen to half this stuff anymore its depressing me, i want to get on with some action but i want it to be realistic action, i really have no faith in the houses being built, its dead......if the administrators let them carry on building then happy days, i will show my ar*e on Jumilla town hall steps.

If not, then lets go for them......lets put a time limit on it tho.

Ha ha, yeah I seem to remember that as well, tell you what, bring those two emotives together and regarding wanting my house - they can kiss my a*s for sure !!!!

I'll back up something Julie Anne wrote a while back, forget what thread it was but hey, doesn't matter. I understand what SARC is doing for people and I applaud the effort, but please, please, please do not turn a blind eye to the other eventuality that this bottoms out and it becomes a bun-fight to get your money returned. We have already been told by our solicitor that we stand to lose a proportion of our monies in the process, and that's with us being one of the first to register as a creditor (and remember we lose a business as well here).

If you do not get a solicitor to act for you now, regardless of what they charge, you'll end up being bottom of the creditors list and risk losing everything...............is it worth it, go through the legal process and make the decision at a point where you actually have a decision to make, not now !! !

carry on with the campaign, but you must cover your backs. Non of us need to offer you all advice, but we do it (believe it or not) out of friendship and concern for our fellow buyers / friends and in the hope that we all end up with at least something to show for ourselves out of this debarcle. This campaign just reminds me of the final scenes in Zulu with Michael Caine standing there proud and British and saying, "chin's up fellows, we could still win this" - before the enevitible happens !!!!

Nuff said, I need to go out in the sun today, If I do end up on the Ayuntamiento steps alongside Brian, I want my a*s to look good for the papers !!

Hi Guys,
       Thanks for the responces and just to reasuer you all we have our solicitor and he doing what he should no problrm with him any way I am glad that you all agree that untill the administrators report is issue to the court there is not a lot we can do execpt by what we are doing already. Lets Say they says yes that the developement is a sound venture and that iit should be completed with new contracts ect what ever the courts say would you go for the propery with a realistice time fram say 8-12 months example or would you still want to fight for your money and have a loger time tied up in leagle process. Remember that if they say it will go ahead then the administrators and courts would be overseeing the developement for a time  maybe to completion (i am realy not sure on last bit) but for arguments sake would you then take up ypur new contracts and proceed with the purchases 
      Please dont shoot me down I am just asking the question as to what we all realy want  is it the realisation of the dream or just the money back.

I am definatley prepared for the worst but there is still a bit of a light in that tunnel so untill we hear from them there administrators keep your powder dry.
