I don't think this is good news, just further delays.

The flight disruptions lasted 1 week yet the judge provides a 3 week extension. The decision will be announced just before Spain closes down in August. Oh and the staff continue to receive their salaries whilst we continue to fight for our rights.

It seems the minority rule as no one can advise how many purchasers the flight delays impacted on. Just gives more time for HDT to fight for the 51% vote - was there roadshow impacted on with the flight delays ?

I just want closure

I take it that as HDT have asked for an extension to the dealine that are struggling to get the 51% of people to say yes to the proposal, i know that they phoned us last week to discuss the deal, in reality how many people have been effected by this when we now have email etc with which to communicate.

Next it will be because the world cup is on and everyone is watching it and have not been able to vote, we need a decision one way or the other now, not keep putting back the dealine, otherwise what is the point of a deadline.

Kind Regards

Mark

Hi all

read what you want into the anouncement

All this really means is that when we asked as SARC for an extension along with other solicitors the judge agreed to one how difficult is that to understand considering the air traffic problems experienced durring that time which may have only lasted a week but had a knock on effect to those affected

Hi all

There was NO need for an extension at all. Agree with rjmderry and Glendale, it is tactics to try and gain the bigger %.

All the purchasers, Lawyers, SARC etc, have known for ages when the deadline was and certain people are trying to delay the inevitable. It is really pathetic but then again nothing suprises me anymore.

Kind regards to all

Gill

Dear Jillyg
I believe that you only represent yourself when you are making these comments where as ,as SARC we represent over 100 members so please don't try and muddy the waters as I said some of you will read what you wnat into the anouncemet so why the comment,
I have heard that one solicitor not to named here is trying to charge their clients 100 euros to vote no when actually they if they don't vote it is counted as a no and so cost them nothing well done that solicitor money for old rope just another example of some solicitors making money out of our misfourtune

So For those that don't know the deadline is Now JUNE 1st

Brian, you state you represent over 100 members. Therefore, please advise how many of your members were affected by the flight disruptions ? Also, did the members you represent agree to the extension ?

Dear RJMDERRY

as you know from after being on here for two years  we do not disclose any details of members either on their decisions or otherwise the numbers are absolutley nothing to do with anyone.

 Kindest Regards to all

Brian,

The reason why you do not disclose this is because you did not ask your members on their views regarding the request to extend the deadline and this is FACT.

Therefore, I have to question the real motive as you did not seek SARC members views on this ? Still, not going to get into an argument with you but will make me question your actions and comments. You achieved your objectives (your objectives) whilst using the SARC members as a smoke screen.

Dear RMJ,

There was no need to vote on the request as it canme from a couple of members and as such they deserve to be able to vote pn the proposal this is not about having a vote in SARC about a request to the judge If the Judge felt it was not a reasonable request he would have refused it  as i said in my original posting when we asked we did not Know what the answer would be but we asked end of story

don't try and make it more than it was

as for my objectives here they are I want my house I have said this from Day one if they liquidate I stand to loose everything I dont have a BG so I will fight to save my money and anyone else who wants to save theres weather they want their house or there money back I stand by what we set out as our mission statement two years ago on SARC website

read it, it's on our front page of SARC website  and then read the proposal from HDT then try and criticise me or SARC

Dear Brian,

If it was only a couple of  SARC members requesting the extension then your open message is misleading and out of order.

When you announce the extension of the deadline you make it sound as if this is beneficial to all inparticular SARC.

For the record, I too do not have a bank guarantee and want the best outcome for all indidivdual purchasers but further delays in my opinion will not be beneficial to the majority. Let the results be known and we can deal with this as individuals.

Giving this company more time equals most costs and dare I say it more lies.

Still, your perspective is your reality. The truth will be known soon.

Stop this back biting you lot if SARC represent only100 the Administrators have given them time to convince the other 800 to vote yes I had a pm today from a purchaser who has had 6 yes 6 calls to date to ask them to vote yes 2 each from Almudena, Antonio and Tomas, remind me why o why are they so desperate. No dont bother if 51% vote no they will be out of work

Auntielinda,

Your last message confirms my concerns. This extra 3 weeks will be used or misused by certain individuals.

Not bickering with Tony but when their is contradiction this needs to be clarified i.e telling an individual they have 1 vote, SARC represents over a 100 members but it was only a couple who requested the extension without consideration to implications and even the majority view, then this needs to be flagged.

Still, the deadline has been agreed and we cannot change this.

This extract is from a e-mail sent to all purchasers more reason to vote NO

"However, once Herrada del Tollo S.L. comes out of the Administration process, there will be a number of additional options that we will be offering you"
To retain 100% of the money paid as a deposit by keeping your property plus a compensation that will be reviewed on an individual basis, to ensure that it is provided in the most beneficial way according to your own personal requirements.

Thanks for letting me keep 100% of my deposit. Compensation is 6% in my contract

To relocate to a different property in a different plot, model or price, always retaining 100% of the deposit paid.

Thanks again that is my money

To re-sell your property during the building process. You can re-assign your Purchase Contract to another person, thereby getting back up to 100 % of your money in a shorter period of time.

Sorry I will not take monies from some other unsuspecting person i have a moral ethic

In the case you were buying more than one property, the possibility to consolidate all your money paid in just one property.
The possibility to transfer 100% of your deposit to another property already finished in a different development (subject to the outcome of San Jose administration proceedings).

N/A

Where is my BG? Where is my deposit? Where is my compensation?

we have made our decision we have voted NO, why oh why are San Jose harrassing me with emails and phone calls to get me to change my mind. I only wish they had this much communication before all of this happened. As for the extension it is a joke. These crooks are milking the funds dry. I want them liquidated and sent to prison. And no i dont have a bank guarantee and will stand to loose e98k.

Exactly our sentiments, its strange that only now thay can manage to phone or email us, when they have had our contact details since 2006, if perhaps they had made more of an effort to communicate what they are trying to achieve from the moment they went into administration, maybe more people would have voted yes.

It' far too late now to be phoning up and trying to get people to change their minds, we voted no and have no bank guarantee.

Agree entirely.

We too have been had contact from San Jose asking us to say yes.

First contact in about 3 years, what a cheek.

We have voted NO without a bank Guarantee.

Looks like they are desperate

It´s gone very quiet on here, so I thought I would share an encounter we had today with a Spanish buyer (called Juana) at SADM.  She joined John and me as we were sitting outside a bar in Jumilla at lunchtime with a friend, listening to Al Golpe (Grupo Flamenco).  Juana is keen for SADM to go ahead, and she spoke to me as she recognised us from the meeting in Hotel Monreal.  We exchanged email addresses and she has kindly forwarded me some emails that she received.  There was nothing that we didn´t already know, however she has promised to let us know if she hears anything new and obviously I will do the same for her.
