 HI everyone,

Just thought That We would let everyone know,We have been advised by our solicitors to go out there asap,and see them face to face,so we our going out to Spain tomorrow,and have meeting with San Jose,Ambasun(horrible thought) and our solicitors.We will try and find our as much as we can,and let everybody know as soon as we know something.If anybody has any questions they would like us to ask,then please let us know,asap,as we are leaving early in the morning.

Lets keep all crossed,that a happy medium can be reached,and we all end up with our dream homes.

Hi, Can you find out the situation regarding building licences at Santa Ana ie are they ever going to be issued? Also when you become a creditor with the court and San Jose do start building can you actually still get your property?Seems like a catch 22 situation they could be difficult about you getting your house because you have become a creditor and we could all end up with nothing but a large lawyers bill! Joanniemac,

A creditor being someone who is owed money, would only really come into effect if it is necessary for San Jose to go from Administration into Liquidation, so at this stage it is unclear as the courts have yet to appoint administrators. 

However it can be normal during the administration period for a list of creditors to be passed to the court.  Your solicitor should then make sure you are on this list, although it can take time for administrators to be appointed. 

If San Jose can continue trading following the administration period then the choice will be either to stick with them or claim your money back (assuming they have gone over your contract completion date).

Redman, thanks for the info it makes it a bit clearer re being a creditor.Our completion date was March 07 plus the 3 months delay built into the contract. Cheers Joanniemac
