I read the new report, thanks.

I havnt taken any new directions from the report and it hasnt been informative for me.  

One important part of our debate on here is often making the choice of house versus money back.

Now that SARC has stated it is being accessed by investors and financiers alike, can you explain and elaborate the claims SARC makes on the following points please.

'Getting our money back will be 5 years and getting houses built could be 1.5 years'

The emphasis is on a very definate statement that it will take 5 years to get our money back.  What are the factors in making this statement?  How can you support those claims?, its mentioned a solicitor and a barrister has said so............what exactly did they say and how did they arrive at that conclusion.  Was it for example if a bankruptcy takes place etc.  Give the reasons why you arrived at that so it can be scrutinised.


The house building could be 1.5 years claim.  Exactly how are you backing this information up, what is it based on, most have waited 4 years already so lets get to the nitty gritty of that right now please.

Hi Braindo,
The time frame is as told to us by our solicitor/barrister who specilises in Concursor. It is clearly stated that this is information given to us in a brief of the situation by our legal representative along with his advice to proceed with the purchase and that is what 90% of his clients are doing.

I did not know of the new motorway until we were told during the briefing.

Let me make it very clear that the report is what we have been told and any comment is clealy marked as such. It is up to each purchaser to read and digest the content and decide for themselves how this effects them and if they wish to seek clarification form thier own legal representative or agent.

page 75  " Ask the experts"

"Q Where do people stand who have put down a large deposit on a property and then the developer has gone out of business? What action should they take?"

Reply......." Unfortunately, some developers ignore the law and fail to arrange gaurantees,which then causes problems.
In this case the buyer has to get in line with all the other creditors, and it could take years to get any money back, if at all....."

Yes you spotted the typo, it should be 2011 not 2001, however, we have run out of the superdupper heal clicking shoes that we normally give out as a prize.  So it will just have to be a nice pat on the back, a well done and depending on how things turn out a cold beer in the sun some time in the future.

I saw a housey magazine in England that said a poll of 19 design experts, in house designing predicted that most house living rooms would be painted duck egg blue by 2011.

They were funded by the manufacturers of duck egg blue paint.

So it must be true.....................or we are all going to be duck eggs

Hi B,

Ive been thought of as  an inovator of trends in the bridal gown industry (tongue in cheek)  but Im re-painting my lounge on Sunday! (I like the kitchen in this colour tho..)..

 I lost my will to smile last month big time but have decided that  this 'episode' in our lives  aint gonna kill me...Its  nearly September folk and I can sense some fire in our  bellies  again .. time for some answers and action for those who wish and those who dont, either way we keep on breathing, dreaming and  fighting.. 

Im going to work.. I can feel a Lawrence Llewelyn Bowen moment approaching! 

Lets share any good solid  info we can gain after this recess and pray some good comes out of all this mess.

SARC is still working towards a positive outcome and for those who want their houses to be able to have them. We are pleased to have recieved a copy of the letter posted below, that indicates that SADM will be going ahead. It also shows that the SARC request for compensation for purchasers has been taken on board by  HdT .

During August I have been in discussions with both the directors of San Jose and the administrators appointed to the company.
 
Some of the developments that have occurred do not specifically affect investors at Santa Ana, however, I will outline all the progress San Jose have made as I believe it is encouraging to see that positive progress is being made throughout the group.
 
In total there are three developments affected by the administration along with large tranches of land.
 
El Pinet
 
The court has ruled in favour of San Jose and construction is commencing in October. Many of the properties are virtually complete and sold, this means that in a couple of months completions will start which will affect the company’s cash flow very positively.
 
Playa Golf
 
San Jose is continuing to market and sell properties on this popular development.
 
Santa Ana
 
Negotiations with a consortium of four major banks are continuing, the purpose of these negations is to secure a 30 million euro line of credit in order to continue the development of this resort.
 
30 million euros is the projected amount required to bring to completion all sold properties, complete the golf course and other retail and leisure areas.
 
A more recent development is that statements of interest have been received from three large construction companies and discussions are ongoing with San Jose looking at selling a percentage of the development. This will of course provide capital to continue with the project quickly and in due course recover some of the time lost.
 
I have been advised by the directors of San Jose that the administrators will be contacting all purchasers of properties at Santa Ana during October formally advising purchasers of their options.
 
 
 
 
 
I have been assured by the directors of San Jose that, before the administrators contact purchasers, a proposal will be in place; this proposal will include new completion dates and compensation for clients.
 
We are continuing to work with San Jose in order to help them resolve their problems and achieve a good solution for all; but mainly for our clients.
 
Please be assured that we will continue to keep you up to date with all developments at Santa Ana.

        you seem to think that it is alright to be abusive about people here briando55, FIN, JA and your cohorts you DONT BOTHER ME BUT I WILL say again  this is a public forum and you should be more responcible. you are the ones that are a rogueish eleiment. because any time anyone puts on a positive posting you try and rubbish it even when the sources are independant and nothing to do with SARC. What you seem to forget SARC was formed for the purpose of continuing the build if possible and just becuase it may succedd you feel the need to be abusive others shame on you all.  not a nice person amongst you all.

It would seem to me Brianmags SARC is the rogue element in all of this, your sources are never independent as most of your     information comes from SJ. The information is twisted and slanted to what you wish to hear and most of the time is so unlikely to be true and factual that it is laughable; the only truly independent voice I want to hear is the Judge. So lets wait for his decision. I don’t care what you bloody want so cut with the Bull. Thanks Garcia

Dear Garcia,
                    Here we go again the news G put up was from another source rather than SARC. SARC has only worked to get the Developement to continue as first choise and yes there are offers on the Table for that now to happen now. So lets all wait and see what transpires but please dont just rubbish anyones post because you dont agree with what is said in it.
 There are to many purchasers without the safety of BGs and therefor have more to loose that those with if they don't get the monies needed then we all loose big time as everything would then be sold to meet creditors and at a loss So SARC will continue to be proactive in getting the developement to be completed as that way those that want their money can get it and those that want their properties can also get theirs.
If other people have a problem with SJ why take it out on other purchasers that are in the same boat I really cant see what can be gained from this attitude I am a purchaser like most others on this site so why be angry at me i took no money from you or anyone else I have paid my deposit by extending my exhisiting mortgage here in the UK  and have spent my own money on SARC campainge so please evryone give it a rest and dont abuse others who are in the same position but with different views.

Hi Garcia,
thank you for your remarks. Any information given out by SARC is not twisted or slanted but factual reports of what has been said. Any comment or opinion is clearly identified. As for the truth, it has been supplied and some of you do not like it ,even though other sources are now supplying similar information. 

As for a rouge element it is clearly those who behave in a selfish, aggresive and  irresponsable manner, slandering who ever they disagree or have issue with.  All it is doing is helping SARC get more members. It might be a good idea if we start posting our plot numbers with our postings just to ensure that we are all SADM purchasers and help us identify the mischief makers.

I also strongly suggest that you refrain from using expletives on an open forum.

But back to the important point.....It  seems that the probability of getting your house is now very high.

Tony..you say sarc is not slanted.......then come up with this request below

What agents?  who are they and who signed the letter?

What are you going on about?  Are you saying that San Jose can produce contracts and  sell properties on the sites you are telling us about?

This is an absolute revelation, they are trading in the property market and are writing contracts for properties, dont you see what this means Tony......everything is fine now.....i really did wake up in the shower and its 5 years ago and nothing has happened.

All we need Tony is the name and contact address of the agent, the date of the letter and we can all use this as evidence that everything is ok.  Then we can all either have our house or our money back.

Send this to the papers, take it to your soilictors..Tony has solved the case, clueso has won....woopy doo....

Are they trying to flog properties illegaly though?...is that possible?...the old sell to the wet weather patsies again?  in that case you have a duty to report this activity to us and to the authorities.......which is it to be Tony?

GIVE THE NAME AND CONTACT ADDRESS OF THE AGENT AND LETS GET ON WITH IT.......OR ARE YOU TELLING PORKIES?

Hi Briando,
I was forwarded the letter and feel that it would be wrong for me to disclose the name etc of the agent,although I believe it would be acceptable for one of the clients to do so,( perhaps Jon G  who originally disclosed it)It would be wrong for me to subject them to the abuse that is dished out to people who give any positive info.

I suggest that you are very carefull about making any suggestion that questions my integrity, as I am not adverse to taking legal action if I  believe that I am being slandered.

Dont understand why the name of the agent matters The Info came from a selling Agent and SJ that in itself is enough to tell us that it is probobably not what is actually going to happen but rather what they hope will happen . It is just wishful thinking by all parties concerned .Be patient and wait for the judge he and only he will decide on facts and evidence not foolish speculation and optimism by agents or  SJ employees and Directors.
