Hi Tony I believe your recent report like all the others deals with nothing at all just more spin put out on behalf of SJ/HdT .Purchasers would be far better placed if they listened to truly independent advise like that being offered by Maria .oooooooh but you dismiss that ,Why ???????

As for the news reports would you rather we did not post them at all .It seems that way .Sorry Tony but once again I feel I have to question your motives and others should as well !!!!!     MM

Hi All,

 I am replying to MM's remark about the Jan report being just spin, well lets just mention just a few of the points in the report.

The date by which all votes on the settlement agreement must be lodged, Fact not spin.

The date by which the administrators said the settlement agreement should be out by. Fact not spin.

The Jumilla Town Hall and Mayor taking action in support of SADM. Fact not spin

E mails going out to purchasers . Fact not spin, plus an apology for an error in their sending.

SARC have urged HdT to make the best offer posible to purchasers in the settlement agreement. Fact not spin.

I suggest that every one reads the report for themselves and make their own minds up.

Perhaps for once, MM you could actually try to make a comment that is based on a fact rather than a wish to deride anything that you view as positive and demonstrates that there is a good probabilty of SADM going ahead.

 I  WANT A POSITIVE OUTCOME FOR ALL

Do you find it as intersting as me that MM is left unable to make a sensible reply when confronted with facts that disprove her remark?

Over the past few weeks there have been several conversations including today, with HdT .

An update report has been written, is being checked and should be going out to the SARC membership either tomorrow or Saturday & then it will be posted on the SARC website for all to  be able to access.

I want a postive outcome for all

Dear All,

I know that the  over the past couple of years we have all been to hell and back. It has and still is not a pleasant experience for any of us, particularly those of us who are without the protection of a BG. Our money is in SADM, that is what we have paid for, that is what we need to fight for and that is what we must not loose. By all of us & yes I mean all of us, those who want their house & those who wan their money back, standing togther and supporting SADM we can get a postive outcome. It may not be an ideal outcome but far better than loosing it all.

My heart goes out to those purchasers who were convinced to spend money trying to improve their creditor status and sadly not being able to.  Who adviced them to do this & who made money out of their attempt to protect their deposits? I do not think I have to say who did as we all know very well who did & which posters supported such action. 

I urge all of you not to think that their is a way to spend more money in an attempt to either get your money back, more money or any other goal. I believe that it would only serve to give the legal profession a income and the postion of the purchaser/s would be just the same. If HdT goes and SADM is lost then that is it, there will be no futher recourse, just the bitter taste of the loss of hard earned money!

So  I  WANT MY HOUSE and I  want to be able to buy it and have the money I have spent used to pay back those who want their money back but first we all need to ensure that HdT and SADM survives.

Sorry to disagree but i for one am not willing to wait four years to see some of my money back, i want this finished now not to be strung along for another few years and to find out a couple of years down the line they say oops, we have gone bcak into administration not our fault.

I also don't under stand your reference to people trying to improve their credit status, and not being able to due to people who advised them, you also seem to greatly distrust the legal profession but not san jose, are you seriously saying that the legal profession just exist to bleed us dry on pointless court cases and don't act in our best interest.

I think you are very wrong and misguided in urging people to follow your advise and just meekly comply to the proposal, each person should and must do what is right for themselves and not what is good for san jose.

I know which way i have voted and it aint in the positive, even though i do not have a BG.

Do you really beleive that when you pay for your house on the 9 hole pitch and putt golf course that they will then keep that to pay off all of those that want their money back, not in a million years will they do that.

This has gone on long enough, it is getting ridiculous

Hi Ken & Mark,

Firstly if you g oback through the threads you will find postings on how some purchasers were  trying to change their creditor status. This was not for free and an action that they had to pay a legal professional to undertake. Was this done on a no win no fee basis? No it cost those who under took this action money and they got little in return. Was it right for their legal representative to do this?

As for being sick of the current siutation, well we all are and  I must point out that the settlement agreement if accpeted would be a legally binding document on HdT. 

As for advice SARC give opnions and comments and it is up to each individual to decide what they wish to do regarding thier money and what the best course of action is. I have stated what I think & I repost it below .

Dear all I have not written much of late as being busy with life in general Kayem as for BG's with new contracts I will enquire but I believe that no bank or court would allow the developement to put out the propsed restrucure with out BG's but i will check this out for us. Any speaking of BG,s

 

Those with a BG what have they to loose say they put down a deposit of 42000 Euros

In 2007 the amount paid out in sterling was 25000 now that the euro is strong if their BG was cashed in they would receive nearly 41000 pounds.

 

Where as I have paid out the same as them and if the company was to be liquidated I and the rest of us would in all likely hood get nothing. So please be care full of those like JA who have BG’s.

 

Remember these are the same people who said that their solicitor was going to get them and anyone who joined them special status many people paid for this action and although we said at the time that their action flawed and that no one would be moved from general to privileged status  in the line of creditors they continued to sell the false hope and cost their people extra money to pay for the action.

 

Time! well it does take time to get documents translated in to from Spanish to English  also it takes time to set up a website to function correctly believe me I know that it also takes time for courts to grant the application we all know that.

 

So although a date was given I for one understand that delays in these things do happen I have worked long enough in the health service to realise that when a government body says something it nearly always takes a lot longer before it is sorted.

I have waited nearly two and a half years so a few extra weeks does not worry me I can wait another few. Especially if it means we all get what we want property or money

Oh Dear,  where to begin.....

Firstly Brian, your posts are very difficult to read, so I can only take from it what I can.  I don't normally cut and paste, but this time I'll make an exception.

So how come 80+% ended up without one the first time around??

Are you suggesting that the exchange rate in 2007 was at €1.68 to the pound.  What bollocks, or was that the rate on Planet Zog.  Secondly a conversion of €42000 at todays rate would give you nearer £37500 not £41000.

Regarding legal representation, most people aquired a solicitor to have a voice in the court proceedings, not as you put it, to increase their creditor status, although I'm sure most good solicitors would have put this to the courts as well as carry out other duties.  What did/does your solicitor suggest??

As for time and waiting, I put my money down in April 2006, so I'm at four years and counting.  I'm also keeping track of where I should be with my 6% legal (and compound) interest added to the money they owe me.

Oh, and for the record, I have the full Spanish version of the proposal, so Tony's mention of no staged payments is another 'untruth'.

One question; why are most of your posts an attempt to disuade people from using a legal vehicle.  Should you not just be giving useful information.  I can't remember anything you've said actually come to fruition and your inability to question what you are told by Almudena is also worrying.  I often wonder how much you are being paid to peddle such trash.

Well put Redman, you got there just before I wrote "What a typical load of Bollocks" (sorry if I offend the sane people on this forum, however this is the only language these idiots really understand)

At the end of the day San Jose continue to spout drivel and lies to SARC who for their own unknown reasons accept the lies as gospel. This is the same company who have now forced out the people who live in the Apartments at La Zenia, you know the ones with a legal contract to live there until their properties at Jumilla are completed,by cuttin off not only the water but the electricity.

Trust them not in a million years, Trust anyone who says they are ok to deal with, never.

I admire your patience and motivation, i read sarcs posts and feel they are so utterly ridiculous i cannot raise the will to post a reply. I wish it were just a difference of opinion but it is something far greater than that. I honestly believe that Tony and Brian are some kind of players and they cannot seriously believe what they are posting. Obviously this is just my humble opinion but i sincerly worry that some people who are clinging to some kind of false hope may persuade themselves to also believe this nonsense, hope i am wrong.
