The questions are excellently put and exactly what SARC is going to be asking and we are putting in place a structure that should enable us to do so. When we get any inforamtion we will make it available and we will endeavour to make it verifyable and ensure its validity.

Hi Darren

The hotel is probably just a planning permission thing is it, i dont understand the planning regs or licences in Spain, you probably do.  The economics were a concern to me, i dont see the financial viability of buying a hotel on a plot of land currently part of an administration procedure, thats all i was saying.  

I know there is a lot of banter and polar opinion on this site but i dont see many people trying to persuade others into following this path or that path (regular contributors that is), unless i missed some things.  If im guilty of it im sure you will let me know.

When you mention soilicitors, your right i have given POA to a solicitor i chose from on here, this is not because i want to or could force an outcome, its because i cant afford not to be represented by someone who knows what they are doing.

Something to ask San Jose and Herra del Tollo (sic) if you can.

If i do some very simple maths and err on caution and say there are 2000 customers with deposits, and the rate for a solicitor as a mean average could be 1000e.  Thats 2m euros spent on legal representation.

If the 2000 customers have deposits of say......something easy to add up.......30k e each thats 60m euros.

If the interest on non building was 3% that would be 1.8m euros.....say the average wait time for building or out of contract may be 2 years to balance off the ones at four years and the ones at one year takes this to 3.6m euros.

So aside from the deposits there is an amount of 5.6m euros, being the cost of the administration to the customer.  Is the administration going to recognise these fees and pay them back to the customers as part of the legal and out of pocket payments do you know?  

This of course would be regardless of a decision of 'to build or not to build' and has no bearing on that outcome. 

Im trying not to sound negative, to me this is positive, but it would be good information to get and i can use that more than the hotel information.

Dear all I write this with the permission of Justin and EOS.

Well that article made me a laugh.  Whoever wrote it has never been to Fortuna.  Famous for its Spa water.  Look up Banos de Fortuna.  Great place.  Never seen a lettuce there either.  Up until about a year ago most of the roads in and out were large dirt tracks but since the Eu money has helped to build roads it is now becoming more populated and Almond trees and the odd vineyard are popping up in the cement like hills.  As for water in Murcia.  When they feel they are running short, which I might add they have never done in the eight years we have been here they barter and play politics with those bodies in Galacia and Asturias and get it sent down and while on the subject of water.  It has been raining with heavy storms for the past 6 weeks.  The news is full of rivers bursting their banks over most of Northern and central Spain and this morning in Albacete, not far from here, the poor people where wading knee deep in it walking down the high street.  In Spain water has ,since the year dot ,been a subject to battle over.  A North South divide sort of thing.  I have a neighbout who at 48 had never owned a washing machine because of the amount of water it uses.  Took me  year to convince her that it uses less water than her hand washing.  Only convinced her in the end by showing her our water bills.  She is now the proud owner of a washing machine and now shows me her water bills which she says are half what they used to be.  Which I might add are a darn site less than they were in the UK

El Pinet Hotel.  Only my opinion but I would have thought that in the long term any land that has licences and is totally legal, for whatever purpose in this part of Spain, in the long term is going to be worth a lot of money to investing companies looking to the future.  There are not many companies that have achieved that much in recent times.

had a look at your website template. Sounds impressive but a bit unrealistic. One of your aims and objectives is to

  • That those purchasers who are unable to wait or due to adverse changes in their financial circumstances can have a refund, without having to undertake costly and lengthy legal action. 

    If you can do that then I take my hat off to you! I have been completely wrong and I apologise profusely. You obviously know excactly what you are doing and the court should perhaps ask you to run the proceedings. I assume in this statement you are only talking about those purcasers with a bank guarantee? If not then are you also providing many loaves of bread and fish at your committee meeting?

    Obviuosly you are are unable to understand what you read or you see what you want. Read it carefully and you can see it says  " costly and lengthy" also read the bit above before you reveal you sound off.  This is the second time you have quoted in error. For all you to see the mistake she has made go to  www.santandelmonte.org and read the whole document. which list aims and objectives plus members views and was agreed in a consultation process with members of SARC who supplied email address' to recieve draft documents.
    Your sarcasm is unnecessary and lets not forget the lowest form of wit and I believe you are not a purchasers at SADM. If you are what is your plot number.

    again what influence do you think you will have to say whether people can have their money returned or whether the process will be costly or lengthy? Apologies if I sounded sarcastic I jut cannot understand how you will back up these objectives. they sound little more than a wish list.

    Just thought i would let you know that those nice people at San jose seem to have forgotton our name when declaring the creditors list.

    I wonder how many others are left out?

    The first base for us now is not we want our house, not even we want our money, lord knows they have had it long enough, probably more like we dont want to be ripped off.......here we go again

    I agree with you Briandoo,

    I am trying get proof of the origional 3000euro deposit and get this added to our total on the creditors list, 
    Feels like a rip off from all directions. I have no intention of not ensuring that I am represented in telling the Court in Alicant that I want my money back. I would advise everyone who wants there money back to start getting themselves some legal representation as the I want my house brigade are shouting loudly. 
    I feel it is intimidating people who want to ask questions that might indicate they want there money back from posting a comment. This is not acceptable as is this practise of dpractically demanding to know peoples plot number, what rubbish.
    You should check that whoever your agent was hasn't had your deposit credited against them. I was over in Spain last week and was told that this had happened in some cases.

    Hi All,
    Just to make it clear that SARC appreciates that there are those who would prefere their money back, infact it is mentioned on the SARC site. However, that is not particularly remarkable as that is what would be expected. What is remarkable is the fact that people are standing up and saying I want my House! This does not deride or prevent those who prefer to go to the Court for their money doing so and it is their right!  What we are saying is that we want SADM to go ahead and have our properties, those who do not wish to do so have that choice and it is theirs alone. We should respect the fact that we are all purchasers and trying to make the best of an unpleasant situation. So why do we ask for plot numbers? It is not to intimidate anyone but to show that when you post your comment that you truly are a purchasers at SADM because anyone registered with EOS can post on the site.

    I wish you well Irene and I hope that this works out OK for all of us.

    Have read the "reports" etc., looked at the website,  and continue to read the contributions of the forum.
    It is a pity when it is claimed that writers are used to writing reports for their Profession and claim on here to represent many, they can't get the grammar and spelling correct.
    A typo is one thing, but when reports are written and contributions made when the same errors are repeated and often several in one sentence, this is quite unprofessional, as no doubt you will be aware.

    This is a bid of a sad thread that people are still trying to justify their positions. I like many others hardly ever post because of this. 
    I think we will not know what the position will be until the administrators have done their work ,then we will know if there is anything to recover, Whether this is money or property but this constant diving on to this site when a posting is made that is of a different opinion to some is really off putting. 
    If any person is not an actual purchaser what difference does it make as they are entitled to have a say. 
    At the end of the day the people who are purchasers are the people who will have the opportunity through their legal representatives to put their case to the court. This will apply to both the people who want a property and to those of us who want their money back.

    i cant wait for this developement to go ahead and everyone thats on here bickering and moaning about individuals trying to help each other out, and using the forum to develop neighbourly love, all of a sudden find themselves living next door to the person they have been putting down on this site.

    seems to me that it may not be a good place to purchase judging by how people seem to get on so well on this site, we will all be sitting in the clubhouse not talking to each other.

    wow sounds like the perfect place in the sun to retire to.
