Hi Eoin and Val

My Family (Brother, sister and parents) have bought the apartment as an investment. we havie been coming to the area for 6 years now as my parents have a place in Calahonda. We are in block 4 with the round balcony and will be renting the place out but only to family and friends. I have been checking this site daily for about a year now but only just posted a message, so to everyone who has been keeping us all up to date I thank you.  The last time I Visited DJ was in June and it looked great apart from the dirty pools. I did read on someone elses post that another complex from this developer only open the pools for 6 months a year, I hope that will not apply to us. I will be at DJ from the 19th to the 29th and look forward to meeting as many of the neighbours as possible. Val are you planning to stay in your apartment while you are there?

Dear Neighbours,

Let me introduce myself.

My name is Rene from Holland and together with my father we bought an appartment in building1 segunda C

I am happy to find out that there is already an internet community.

Last week we visited the site and were fortunate to meet some ne neighbours, who all had waited for ages for delivery of their property.

I am ofcourse very curious who my real neighbours are so if you also live in buiding 1 please let me know

Our appartment will be delivered 19th of september and we will come over at 2nd of october.

The staus last week: no electicity but the told us that it is a matter of days know.

Lets hope this time they keep their promise.

Hi Rene

we are official residents as of today 13th September 16.30!  Our apartment is Block 1, segunda A. We will be flying out on 22nd September for two weeks. Furniture arriving on the 24th.

So we will be cleaning all weekend!   Sounds as if we need to bring lots of candles and elbow grease.

Looking forward to meeting everyone soon.

Keith & I plan to sleep on lilos on the floor , with candles & wine, until our furniture arrives on the 22nd.  We will also try to do a bit of cleaning before the furniture comes. Hope to meet you whilst we are there.

The pools in Monte Canada are closed for 6 months of the year because they are of the size that require a lifegaurd when they are open. Ours are smaller and don't require a lifeguard so hopefully they will be open when we want them - it will be for the community to decide

I was shocked at the stabbing episode also the druggies hanging around that area,

I would hope to go over sometimes with the children on my own, Is this a safe area to be on your own?

Is there a lot of crime there.

PS welcome the new people to the board, Hoping one day we can all put faces to names.

We have been going out to Spain every year for a lot of years and my sister has had an apartment in Benalmadena for 7 years. Neither of us have ever seen any crime or even drunken bad behaviour. You get stabbing and drug problems in England it is becoming the norm which is a sad thing for our society. We were there for 15days we walked about late at night without problems. ( maybe we were lucky)  I would'nt be happy to walk late at night in most of the English towns & cities.

Dear all,

Today I had a conversation with my lawyer and he told me that the Caixa Galicia the bank from the developper wants me to get a life insurance of them.

Costs 250 euro / year.

I heard from Max thet this is not necessary to take it but the bank insist on it.

Does anyone have similar experiences with this bank?

The interest offer from Caixa galicia valid  till the end of the month is 5.3% for the first year after Euribor+0.75

But which Euribor they will take? for one month or 15 years?

Does anybody know the answer already? I could save a lot of money!

Hi Lorraine,

We have been here 6 times and never have we been in trouble what so ever. and We have a freind that lives here and she tell s us that the crime rate is higher in Denmark which I belive is same as saying that it's not bad. however I will always suggest that you take care (no matte where you go). As Janmet says you have bad guys allover (they might even be danish or british :o)

I think that you can go to Costa Del Sol and do all that you wan't, as long as you use common sence.

Hi to all new forum members. Good to see that our community is growing!

I heard about the stabbing on the local television news. I didn't realize it concerned the Calypso bar. Yes, there are criminals and drug addicts in Fuengirola, but nothing compared to the bigger cities in the UK or the Netherlands. I feel quite safe in the busier areas. What really helps is that the Spanish people still interfere if they see that you're in trouble. Unlike the attitude in the Netherlands!

Regarding our own area in Carvajal it's of course a bit isolated. The good thing is the existence of the large brothel in front of us. It may surprise some of you, but it's in their interest to keep the place quiet and free of crime and as far as I can see they do a good job. I hope (but don't know) that they have a security camera monitoring the stairs going up to the station. Lots of their girls use the train to go to their work so it wouldn't surprise me.

However I really hope that we, the community, will decide to have a permanent night watch on the premises. The current guys (especially the Rumanian) do a very good job and I would like to keep them in place. It will save us on insurance costs, make sure we have no burglary (as is common in holiday homes) and makes one feel very secure. Their contract ends at the end of this month :(

Hi all,

I was in the Calypso bar when the incident happened. 2 young lads got slashed. One across the face and the other on his arm. not a nice site. Happy to say this sort of thing does not happen very often. A good friend of mine has been coming here for 20 years, and this is the first time that she has heard of something like this happening. Its a shame because the Calypso is a nice little bar.

Hi Rene35,

Welcome to the forum. You say you are in block 1. Is this in phase 1 or phase 2. If its phase 1 block 1, there are a number of us on this site in the same block. We are on the ground floor semisotano , my neighbour is Gericomm99, and Mozza are upstairs. I see you are flying out on the 2nd of October. So are we for a week. Maybe we could meet up. This also goes for Deniseapartment who I believe are in the same block.  As for the mortgage terms Rene35, I was always lead to believe the mortgage rate is 0.75% above the Euribor rate for the term of the mortgage for 15 years. I presume it changes whenever the euribor rate changes. We also had to take the Life cover & buildings cover from the bank, but after the first year we can move. We completed today I believe. What seems to be the problem with the electricty, has no one been connected yet. Dont say we will have to splash out again for accomodation.

Hi All,

Thanks for the reassurance of the safty in Fuengirola. I do agree with Max that we should keep the security gaurd at night as a lot of us cannot be there all the time.

We are waiting on a completion date still.

Is there elettric and water there yet?

We've been told that the administrational proces to enroll Don Juan in the computersystem of Sevillana (the electricity-company) takes about two weeks, after that it should only take a few days for connection after you've applied for it. We are expecting it this week or the next. Hopefully this won't be the Spanish two weeks ;)
Everyone who has completed now has gotten water from the builder, so not much problems there either. The watercompany has to do some work before it can supply us with water, but Arrohabitatge has already payed a deposit of 80.000 euro's for that. Until that time we will get builders' water.
We spoke with the guard today, and he told us that he has been hired by the administrator of Don Juan to stay on at least the coming months. We are very happy with that news, he is a nice guy and it will feel good to have somebody watching the place at night and in the weekends.
A lot of people showed up at the meeting today, very nice to already know so many of our neighbours. It makes the place look even friendlier to live.

We have finally been given a date for signing and a 'statement of account' in it there is a charge of €750 to cancel the developers mortgage. My lawyer advises me that this charge is illegal but dispite protesting to the developers about it they are adamant that if we do not pay they will not sign. I am sure some of you are in the same boat. Anyway my lawyer has suggested signing and paying the charge for now but then to sue the developers for this amount and also compensation for the delays in completing which he states would hold more weight if this action is taken collectively by a group of buyers. I think this i a very good point and worth considering.

I agree that joint action is going to be cheaper and more effective. Our solictor is to friendly with the developer and not good enough - do you (or anyone else) think that your solicitor speaks good English, will work in the best interests of the people who are paying the bill, not charge a fortune and is competent to take on our case.

My solicitor didn't think we had any chance of getting the mortgage cancelation fee back. This maybe because she is friendly with the developer or lazy but she said it was becasue we had bought a "resale" and that made it very complicated. She did get the developer to agree a reduced cancelation fee of 400€.

Hi Davmunster, My lawyer speaks very good english & is totally independent. I have queried him further on this issue and I have pasted his reply below: QUESTION: a question about the mortgage cancellation charge. You say that if we do not sign we may loose our right to buy the apartment but surely if the sellers are forcing upon us illegal terms then we have a right not to sign without the risk of loosing the house? ANSWER: It should be like that, but it isn´t .Technically the charge was "agreed" between you two and whilst a change of legality allows you now to challenge the validity of that clause (but a third party will have to decide upon that conflict, that is what is of "better right", the agreement or the subsequent legislation considering clauses like that null and void) that is not automatic. It would be automatic should the contract had been signed, with that clause, after 2006. In our case, the clause is "anullable" -so it is up to us to seek annullability. In the Courts, that is, as Arrohabitatge is not being very reasonable on this one. Mind you: I am of the idea that this "lack of flexibility" in this affair has not its "headquarters" in Arrohabitatge but in Caixa Galicia, the banker that originally granted the Mortgage. I do have the sensation that it would be THEM who are going to collect "Mortgage Cancellation Fees" as I very much doubt that the developer can actually put their hands into a subject like that. And if there is any instance actually a degree more arrogant than a developer in Spain...that´s a Bank. They couldn´t care less. All this is unconfirmed thoughts of mine, of course. QUESTION: However if we do this wouldn't the court take the view that if you paid it at the time of signing then you have voluntarily accepted the terms imposed by the developers? ANSWER: No. In any case we will make a statement that we do not agree with the validity of that Clause and that we reserve all rights under Law to challenge it afterwards. What he is saying seems to make sense. I think it might be best to wait till completion and see how many of us are prepared to take joint action and can then put the case forward to him with regards to feasibility / costs etc. Regards

Hi all,

Here is some information that I received back from my solicitor today regarding a list of questions that I sent her. . Thank God we have a good one.

There is no problem with the electricity connection. Normally the electricity Company needs a few weeks to instal the individual electricity meters and to arrange the contracts. We have been told that these will be signed on Thursday and that the connection will take place before the end of September. This is what they have told us.

Normally the installation of the meters is outside the apartment. If they need to come inside, you will have to leave one set of keys with someone you know in the area.

For everything related to the developers mortgage payments, etc., you should contact Mr. Angel Baena, from CAIXA GALICIA.

The declaration of new building deed has to be granted obligatorily before the purchase title deed. The IBI will be issued in the next months by the Townhall.
 
The local Town hall address is Plaza de España nº 1, Fuengirola, and one of the contact numbers is 952 58 93 69.
We could get a copy of the by-laws for you. They could only be changed by unanimity of all owners and in any time.

The forum software is indeed a real nuisance as it always screws up the lay-out of posts. The discussion about the legal issues moved to the completion topic thanks to RG’s cooperation.

On a  different subject: Arrohabitage decided yesterday to repaint all the grills and patio gates. Very good idea as we already complained about it in several snagging reports for clients, but….

 a)       Why didn’t they do this a few weeks ago before completion while they were painting the railing of the stairs?

b)       How do they expect to get all those keys back? As keyholders for some of you we got a request to hand them over to do the job, but lots of people are not on site. They would have made life so much easier if they had done this before completion!

c)       I hope they don’t repeat the error they made the last time they painted these grills and gates. Our gates for instance have originally been painted while locked so the inside is bare metal! They  will encounter the same problem this time.

It’s a great country to live, but a bit more planning by the Spanish would make everyone’s life so much easier!
