A development of terraced houses on the beach front, with a swimming pool and spacious gardens. This sounds like a place in many people’s dreams, but for about 50 people who live in La Borboleta development in Manilva the maintenance of this residential complex is becoming a real nightmare.
So many people have failed to pay their community fees that, after already having had to cut back on the number of hours spent on maintenance work and gardening, the water supply could be cut off within a few days, says property administrator Rafael Mena.
Five British owners are responsible for the largest part of this debt, because between them they owe more than 25,000 euros. A debt recovery company in the United Kingdom is now looking for them so they can be brought before the courts.
Although traditionally British people who live on the Costa del Sol have been good payers, since the economic crisis began the amount owed by them has been increasing, says the head of the Association of Property Administrators in Malaga and Melilla Fernando Pastor who signed an agreement with a law firm in London a few days ago to locate those who have failed to pay their community fees in apartment blocks and residential developments, many of them luxurious.
The firm, Wellbeck Law, has received more than 300 cases from Malaga province since June last year, because before this agreement was signed some property administrators already used them to try to reclaim outstanding debts, says Jeremy Boyle, the founding partner of the firm.
According to this lawyer, the average debt of British owners who owe money to communities is about 6,000 euros, although in one case it is 100,000 euros because the fees for four properties in a luxury development in Marbella have not been paid for more than four years.
British experts are being appointed to try to recover the debts because of the difficulties encountered by property administrators in Spain when trying to locate the debtors and because the legal processes can go on for months.
This, says Fernando Pastor, is because under Spanish legislation it must be established that all notifications have reached the debtor. However, the Law of Horizontal Property only obliges property owners to provide a contact address in Spain so it is not uncommon for there to be no information about any address in the United Kingdom.
Many foreigners spend most of the year in their own country or they return there permanently when they can no longer pay their mortgage. “Some of them hand over the keys of the apartment to the bank and then think they are not responsible for paying community fees,” says Jeremy Boyle.
Interminable process
“Many of these people bought the properties as an investment and now they find that they can’t sell them”, says property administrator Rafael Mena, who works with another British debt recovery company because otherwise “the legal process can be interminable”.
“If we don’t go to this type of company it can take us two or three years to be paid, but in the UK it is less than one year,” explains the head of the Association, who points out that half of the debt to communities on the Costa del Sol is owed by foreigners.
Once the community provides the legal firm in London with the information about the debtor, the search begins. With just the name and place of birth, they can be located within a few days, says Jeremy Boyle. However, if the lawyers are unable to achieve this by their own efforts they use a private detective. In that case, it can take a few weeks to locate the person in question.
Once the debtor has been found, the legal process begins in Britain and is resolved in less than one year. The professionals at Wellbeck Law receive about 20 per cent of the money which is paid by the debtor. If in the end the case is not resolved, they receive nothing.

This would be a bit like Turkeys voting for Xmas. Who in their right mind would invest in property in a country where the owner was unable to rent out the property. If they think they have a lot of unsold properties now, wait till this passes and see the property market crash beyond repair along with their tourism industry. It's amazing what desperate ideas governments that are on their knees come up with. They are trying to create a monopoly so hotel owners can charge whatever they like. I have a solution that will help solve Spain's economic problem. Bring in a dog tax. € 200 per year per dog would be a good start. Also € 200 fines for owners each and every time they let their dogs cr*p on footpaths and other public areas and don't pick it up.

 Hi dont forget the dogs on the beach that is my pet hate but at least Don juan is clean now.

The hotel prices are now half price in spain just back from the THB  hotel great break.

About the prices of  properties  Don juan 3 has 2 bedrooms apt  at half price now  and great deals for car parking spaces they are so big you would not need to buy a store room.

More trains from Fuengirola.

THE Malaga to Fuengirola train timetable has been revised to accommodate links with the AVE. From last Sunday the schedule has been altered to accommodate branch line passengers and also extend services beyond midnight

The first Malaga to Fuengirola service departs at 6.10am, followed by 6.45am; 7.20am; and 7.40am. Subsequent services depart on the hour; 20 past; and 20 to the hour.

Other changes will assist Fuengirola, Benalmadena and Torremolinos passengers with connections to the AVE that leaves from Maria Zambrano station in Malaga at 7.10 am and 8.10 am bound for Madrid. 

The last commuter services will leave Fuengirola at 10.20pm, 10.50pm, 11.20pm, 11.50pm and 12.20am.

Electric Water Heater squealing

Over the last few weeks my electric water heater is emitting a loud squeal on a regular basis - I think it is something to do with the high water pressure and a release valve that may be fitted to the water heater.   I do not think the unit is overheating and the thermostat appears to be clicking in and out in the normal manner.

I am situated on semisotano level so pressure may be higher that at the top floor of the building.

Does anyone have experience of this problem and what the solution may be?

Hi Gericom

Most of the boilers the builder fitted, in our phase at least, are many years older than the apartments. Many have already been replaced because they started leaking. A much more efficient replacement that hooks onto the same brackets can be bought from Aki I think for around 200€.

These leaks are usually around the seal of the glass "thermos" internal cylinder. It is also common when the weather warms up for water temperatures to rise. This causes water to escape from the safety valve. If this is happening turning the thermostat down a notch usually fixes it.

There are pressure regulators fitted to all blocks and while I agree pressure is likely to be higher at the bottom than the top there is no reason why this has changed recently and I would be surprised if it is the cause of you problem

 Last year our boiler collapsed and we had to buy a new one.

The problem is, said the plumber, the calcium is far to high, so you have to clean your boiler every 2 years!

He will return after 2 years to clean the inside, he said. He installed a Teka.

We decided, to put a bag of calcium cleaning now and then in our washing machine to clean it.

Because I think this will also give the same problems.

We brought the bags from Holland, I guess from Aldi, no idea if they sell it in Spain.

The washing machine will turn the same program but without anything in it except the bag.

 Hi this week in Liverpool the radio station have been warning people driving to Spain in the own cars to be aware of an increase number of attacks to people and there cars.Also people using hire cars in Spain.  Irene

 received the letter from the town hall about the increase  in the bill.This increase is for non resident and people who don't pay by d/debit.It is for the extra cost for the rubbish collection.

 As far as I understood Irene, the bill is for both, residents and no residents.

But the residents pay less..

Correct me if I'm wrong, but Ken also told me he had paid this bill and he is a resident.

 Hi Corrie we all pay for the collection of waste.It is just that as you said none residents pay the higher rate of this bill.

I Can not imagine evey house holder in England being charged different prices for there colection of waste.

I do not think this is right we use less waste and pay more as a non residents.

 I havent posted for a while or indeed been on this site! so here goes..... Irene I believe you are incorrect. The town hall have replaced the old 'Basura' tax with a environmental tax. Additionally all the taxes i.e. IBI IVTM etc are now payable in two installments this is the same weather you are a resident or not.

However if you are on the 'empadramiento' before 31/12/2012 (i think thats how you spell it) and you do not owe anything to the town hall from previous years then you only pay the first payment which for IBI is due by end of May in order to get 5% discount and the new environment tax is due 10th June. In this instance you do not pay the second installment which effectively is equivalent to the 30% discount we used to get off the old system (again which only applied if you were on the empadramiento.

Its immaterial weather you pay by direct debit, online or cash at the counter the same rules apply. Overall i think the taxes are up a little compared to what i remember paying last year.

We've had a cold wet Spring and now in June, although it is pleasantly warm, it is still no where near as warm as it should be at this time of year. ....is this the explanation? www.digitaljournal.com/article/351008

We have  friends staying at our apartment in Torreblanca and need a taxi to get them to the airport by around 5.30 a.m ish on the 14th.

Does anyone know of a reasonably priced reliable taxi?
