Dose anyone know what an NIE number is as the bank emailed me and said I need it for the meeting on Friday.

Hi Eoin

You must get this straight away, both of you, otherwise you wont be able to complete. I cant believe your solicitor has not told you about this. Get your solicitors fax number straight away, and fax a copy of both of your passports, and ask your solicitor to apply for your NIE before Friday.  Can you meet up on Saturday 6th October instead of Friday 5th October. If you cannot change it, its no problem. Just thought Saturday night would be better so if we have a hangover, we dont have to get up on Sunday for shopping, as all the shops are closed. There is a method in my madness.

Hi Eoin,
I'm pretty sure you will have a NIE number as, like Westport says, you can't buy a house without it. Your lawyer will have it.
Regarding communal dishes versus individual dishes. I can't find the post by Gericomm who said there was a special storage room next to the penthouses which he thought would be for the communal dishes. Anyway, he was right. There is a place on the roof for a communal dish, the cabling is in place throughout the building and there are quite advanced amplifiers and distributors installed in the utility room next to the penthouses.
The question remains if we can receive more than one satellite. Important as the British Sky is in a different position as some other satellites for other nationalities. I will investigate, but I would advise to you to refrain from installing individual dishes by now. They could be outlawed by the community and they are an extra expense which doesn't seem necessary.

For the information regarding the NIE number, I Think you are right Max I am sure that the solicitor must have these numbers. (I Hope).

Max at the meeting was there any mention what we can do with the garden area in front of the garden level apartments. As I am meeting a Gardner on Friday afternoon to decide what to do with this area.

Hi Eoin,
No, the gardens were not discussed at the meetings, but as a sem-sotano owner you will agree in your title deeds not to tile them, put a roof on them, have higher fences, etc. See my earlier post in the completion topic about it.

I have been talking to Max about getting an estimate for extending the tiling of our semisotano private garden and he reminded me that according to a provision in his own contract it was expressly forbidden.  However I had gone to the trouble of asking my solicitor to check if this provision was also in our own contract and the solicitor informed me that he had checked the deed and found that it was not and this work was not forbidden.  It is also true that the Horizontal Property Act allows owners to make alterations under certain conditions.  Having got this advice from my solicitor I felt that this work was something that could be carried out if we so decided.  However Max has since informed me that his solicitor told a similar story but because he could read Spanish he found it to be untrue.  Therefore it appears the only way to be sure what is or is not forbidden is to check the actual text of the purchase contract. 

My reason for considering this option is to have a low maintenance area free from the need to cut grass, remove weeds etc which will grow up in periods of long absence and detract from the appearance of the property.  Already it is quite clear how unsightly these areas are looking right through the development and I expect many owners will not be living on site to take care of these private areas in the future. 

Apart entirely from the garden issue I also have concerns about the safety of the green fence for those blocks with an elevated embankment like Block 1.  If, say, the unthinkable happened and a young child was mortally injured having fallen down from a height and having somehow got through a relatively flimsy barrier, surely the community would have some questions to answer on safety issues.  I notice that extra barriers have been fitted on some of the upper balconies and I presume it was for safety considerations.

I would welcome any thoughts on these issues.

I agree with you totally. I brought up all of these issues a long time ago. We are looking to do the same with the terrace area in matching tiles, so if you like we could do the job together, seeing as we are next door to you. Let me know if you get a quote for the 2 of us. I will double check with my solicitor this week what we can or cannot do. I asked Mr Don Juans number 2, when I was last on site about the low fence and the big drop on Block 1. He told me under Spanish Law they were the heights of fence that had to be fitted. When I told him there were higher fences at ground level around the complex, he told me, "we have to put in what we are told". Wether or not we can heighten them I dont know, but will try to find out from my solicitor. Your right, I wonder if we could sue the developer if a child fell over this death trap, seeing as I informed them before completion.

I was also informed by my solicitor that there is nothing in the purchase contract forbidding tiling the garden area. If some of you are having this done please let me know because we'd like to get ours done at the same time. It will be for the community to decide what we can do about extending fences and putting gates in and I am content to leave this issue provided it is on the agenda and discussed at the next community meeting.

Thanks - unfortunately our flight is not due in until 2055hrs - by the time we wait for our bags and pick up a car I do not see us getting down to Fuengirola until arourd 10.30PM and with easyjet it could be later so I guess it's not going to happen this time.

We'll be out again in early December then over New Year by which time I guess we'll have electricity and be meeting in Don Juan

I sent you an email again just now. Just incase you dont get it, we will see you in the Fools and Horses bar/restaurant along Los Boliches seafront, underneath the Palm Beach apartments as a meeting point at 8pm on Saturday 6th October. Ask in any local restaurant for directions. We both have dark hair and our little boy has fair/blonde hair. What do you look like.  If you dont want to eat there we can move on, then if you like go to my friends bar I was telling you about. Have you contacted SRS about meeting. We are going over for New Year as well, 30 Dec to the 3rd Jan. We can meet then. Dont think you will have to wait too much longer for the electricity. I just got a call to meet the electricity company tomorrow morning (3rd OCT)for connection. They are connecting 7 apartments tomorrow.

Thanks for your email yes we will meet on sat night at 8 the only problem is that Eoin cant come over so I am staying with my friend in Los Boliches so no prob if you and your family want to meet up. My friend is Irish also and lives there for 10 years.

I will be at the apartment from 4pm to 6pm on Friday. Block 5 Phase 1, hopefully with the keys as I complete on Friday morning.

Eoin and myself and the children will also be over for the new year, arriving on the 31/12/07
