hi finn

as you know we completed 15 months ago  taray have had our money so we do not apear to have much power  but if we can do anything we are more than willing  we also bought on the strength of what was promised we had no cause to doubt as freinds of ours have bought on other sites built by taray and got what was promised we are very dissapointed as we have grandchildren who come out for holidays hope somebody can suggest something posotive as to what we can do to speed it up

no doubt Taray in the wrong here, but so are our solicitors and agents.Please no one complete your contract until your contract is amended. If Taray and agents insist all will be ok, then  lets see it in PRINT before signing over the rest of our cash. These properties are worthless without the pool and facilities. Wake up everyone.

Ok a lot of talking going on here , i want action, what i suggest is  make a list of names of  all people  commiting to taking  legal action against taray. Only then when every one is commited will we know for sure what strenght we will have to fight Taray. I fear a lot of people will sit back and let others fight this and also others pay the legal bill. If you all want you can send me a private message with your commitment, or if some one else wants to do it thats fine. as i said before i have deposits on 2 propertys in this develepment and will not pay any more money with out a pool and leisure complex as promised to us by Taray.

Hi all , thanks to those who have got on board with me so fast today,  I need all of you to get in though with me, and then we can discuss this further , i have a solicitor but i don't know if he's any use . Can any one suggest a good solicitor that may be they have used in the past in spain on a similar matter with good results.

Hi Everybody

Onsight report

I went to Site again yesterday, Different guy in the office. I aked him about phase 1 and the fact that the sports complex is now a block of flats. He replied that they hope to build a complex on the site of the porcelain factory at a later date and that the council will build a pool later this year.  (Bull****).  I was posing as a potential buyer.

Sit tight I am seeing my solicitor on Wednesday and will ask her all the pertinent questions. If anybody got specific questions let me know.

its great that you are out there and can see what is going on.  the guy from toray who told me about the council building the pool again last november i think let it slip out as up until then it was toray was building the pool and like the reasons you heard yesterday they varied their stories to suit their needs.

questions to ask the solicitor would be the obvious ones can they get away with this which i very much doubt even spain is subject to eu law you cannot be told you are buying a pool be shown pictures of the development again with a pool and then suddenly you have no pool.

i agree with the earlier posts i really dont think anybody should hand over any more money until this is clarified my original understanding was that all the monies paid over so far where held under bank gaurentee until all works were completed can sombody clarify this for me as then surely this would protect you against this sort of fraud that toray are trying to pull.

again if somebody from toray is on this site rest assured we are not going to accept this

hi guys it just gets better and better

i have just copied this from a posting in relation to phase two and this is what they were told about our pool in phase one

*****Bev is correct. We were looking at phase 1 in Jan 2007, but decided to hold off until phase 2 was released. It was clear to us from Taray that the pool on phase 1 was always going to be a communial pool owned by the town and that phase 1 owners could pay as you go, or more likely there would be a method of paying monthly/annually. This of course would mean lower community charges to owners on phase 1, as the upkeep of the pool etc would be the responsibility of the town.

The difference on phase 2 is that it will have its own private pool and the upkeep would be out of the community fees we owners will pay.


its a pity they did not say this to us before we parted with our money but as phase two was not even on the horizon at that stage we were really being taken for a ride

Hi Finn

I forgot to say that the guy in the Taray office also said they had plans to build a 9 hole golf course.

We are all focussing on the pool but do not forget when I purchased about 2 years ago they also sold me a sports centre.

This would include a golf driving range and tennis courts.

The proposed site for this is now the block of flats with their own pool on the end.

I would not think the bank hold our money as Taray would need these deposits to carry on building, but there is a guarantee in place. 

At the end of the day Taray sold us things that have not materialised so therefore I believe thay are in breach of contract.

I have to say apart from the missing items the site is looking superb and finished to a high standard.

I will find this out on Wednesday.

Some information on phase 2.

Phase 2 is split into 3 developments so therefore will require 3 separate planning permissions. So all those who have bought on phase 2 need to check which development they are in. Taray expect the 1st permission soon but do not assume that when they start building it covers your plot. 

Okay I will see solicitor on Wednesday and try to sort it all out.

jesus you made me laugh, yeah we were also sold the idea of the sports complex the golf course is news to us, we were told about the fab restaurant that was going to be in the sports complex.....

yeah i love the site it looked really well in november and you knew it was going to be to a really high standard that is why i cannot understand about the pool its such a stupid thing to try and pull. the sports complex was a big thing to us as well with the kids you were planning how they would get loads of use out of the facilities promised we were told tennis courts and basketball courts and the sports complex

in relation to the contract on our english version page 17 of 19 it refers to the section a. common elements it mentions the pool etc.

as far as i would be aware the bank are supposed to hold your deposits and this is what taray would borrow against this account.

hope you can get some answers i am emaililng our contact in taray today to see what they are saying if anything.

hope to hear some good news from you later in the week remember there is a lot of people backing you on this.

Hi Everyone

Good to see that the common feeling that the pool is an issue is alive and well............we contacted our solicitor and made our views very clear i.e no pool no completion monies..........adding that there were plenty of other like minds.........Her response from Taray was that if the Town council were not forthcoming with moving on with the pool then they (Taray) would commence themselves !!!!!!!!which begs the question why don't they do this anyway ???????So many different stories and versions of stories are emerging now that they don't know what to say.....As stated in an earlier thread we totally believe that if we all to-gether refuse to complete until phase 1 is completed then the pressure will have to make them build the pool  and surely this will benefit everyone who have completed, are about to complete and who are looking to complete in the future. Keep the pressure on and if that means one solicitor to represent all then we are in favour of that.

Hi, JLMURPH well said !! what more can we add other than you seem very very switched on to what Taray are doing ,or trying to do here! If legal fees become a collective issue and we go on to use one solicitor you have my pledge of full support, and that we will pay our portion of costs because I am sure we have a good case here, even by spanish litigation standards. However that said hiting them where it really hurts is the best  old way of (don't pay until you have it your way)......Spanish builders are having it tight so best taray just deliver what they promise !or go into cash flow issues until the build that pool.......& lets hope to gather more like minded support here well said JLMURPH!! cheers widds

I don´t have all my paper work with me but I do have an original plan showing the sports centre which is now a block of flats.

So going back to a previous post publicity literature should form part of the contract.

I don´t see how Taray can build the pool as they do not own the land, again I think it is rubbish just to placate us.

I wonder if the council suddenly became the ones building the pool after the Torre Pacheco council scandel?

I will try and find out where we stand tomorrow. If anybody has anymore info let me know by tomorrow morning.

If Taray ever do build a pool, sports complex, driving range, green areas, club house or any thing apart from houses. Who will run them on a day to day bases. Franchise, individual, Taray, council, local community or no one?

All these activities cost money and some one to organise them, who will control it? Businesses will have to be set up and managed and make a profit. I doubt a small development like San Cayetano could sustain all those facilities. I think the shops, pubs and restaurants in the village would complain if a club house selling every thing was built at the end of Taray development.

I am now of the thinking Taray lied big time to every one. They promised facilities similar to Polaris and other large golfing urbanisations but cheaper due to no golf course. 

Taray have said that phase 2 completions are tied in to the pool and green areas, but they have lied so often I do not know what is true.

lets face it we are not going to get any of those things, at this point i will except a pool, but i don't thing we are going to get one with out a fight. so far i have 8 commitments from property owners and from proposed property oweners who have paid a deposit on there appartment, penthouse , quad, ect, where are all the other commitments from rest of you surly there are more than 8 familys who want to fight. or is it as i suspected most of you will sit back and let others fight and pay for you.  we need all the support we can get. all this talk will get us no where.  we need action.

8 commitments is a start i estimate  thats over 1 million euros plus held back from taray.
How much would it cost to build a nice big pool and green area 40 to 60k?

A few phone calls to the media tv wouldnt go a miss they love scandal stories.

I think this needs to taken a step further taray will sh*t them selfs if tv got involed.

Hi all

I am on maternity leave but count me in, i hope to go back to work soon.  When i transferred my deposit from phase 1 to phase 2 the new contract stated that the build will be completed on the 30 june 2009.  There is something  written in spainish about 120 days, that could be the lenght of time given to taray to finish off bits and pieces.  
I am in Birmingham, anybody residing this neck of the woods, please get in contact.

Is it a case of giving this collective a name and having a letter drafted by a lawyer or spokesperson out lining our concerns on what was a previuosly happy and impressive site and having Taray forced to reply in writing. This would either clarify and put our minds at rest or affirm our cause for concern. It would also make sure Taray were fully aware of the potential problems they are about to encounter from us.
