hi

yes i have spoken to a rep from taray in the last two weeks 4 times each time he assures me that the pool will be built and facilities (notice he does not say what these are) he talks about taray giving the town council a year to give them permission to go ahead and build and if they do not get this decision within the year they will go ahead with the pool??? now where i don't know as we all know taray do not own the land that the pool is to be built on.

there is already a pool in san cayteno ok its only open for two months of the year but can you really see the town council oking another pool that they will be responsible for running, i dont think so,

surely this is a straight forward breach of contract (still waiting to hear from our solicitor) what is the storey on putting pressure on the bank in regard to the bank guarantee

i think we really need to step this up and in a hurry so we can see where we all stand on this issue.  i was told their website was currently being redeveloped

Hi 
I am still waiting to hear back from my solicitor about the pool on phase 2 and how it is contracted. My solicitor has said he will get an answer when he comes back off holiday in 2 weeks.
If phase 2 ever starts I am concerned Taray will built a pool  but it will not be gated and will be for all residents.
I hope you all on phase 1 get Taray to quickly build and maintain this pool.

Something else is starting to worry me.

How many people have actually got a bank guarantee?

When we buy these places we assume wrongly that our solicitors are looking after our interests.

They tell us Taray will give us a bank guarantee.

After each stage payment we should get a guarantee. This guarantee is personal to you. it should have your name on it, your passport number on it, the address of the property your buying and the amount you have paid.

I ask my solicitor if I could see these documents and low and behold they have not got them.

2-3 weeks back they asked Taray for them and guess what. No sign of them. If you have not got them and Taray go bust no chance to get your money back.

So come on all lets take a count post here if you have or have not got the guarantee.

By the way it is  against the law for a builder not to issue a bank guarantee.

I got my Bank Guarantee for Phase 2 in October last year - It is valid until March 2009. It did take quite a few weks to obtain though so be patient.

I requested a bank guarantee in July 2006 and it only took about a week for the solicitor to send me a copy by e-mail.  It was personalised to us and the property.  It also stated that interest would be paid at 0%.  An abusive clause???  It was valid until April 2008 and I have requested another one.  No sign of it yet.

Hi all. New member who dropped a clanger by starting a new thread under my name when all I wanted to do was to contribute to the debate after visiting there last week.

The new thread is under ny name, and the only thing I can add other than what is in my first message is that this morning, my mortgage broker was on the phone, and rather surprisingly, said he knew of the troubles with the sports facility complex, including importantly the pool.

Funny it was never mentioned last week, and as with many others, the whole package sold to my wife included the pools, which, quite clearly are in the brochure.

Also on another Hacienda Taray site, specific to Hacienda San Cateyano, it states quite clearly that a communal pool is part of the complex.

Any further developments will be reported asap.

It seems that even though owners on site as well as owners in the process of buying and visiting the site are continually asking there is still no official clarification on this subject from agents, Taray or solicitors. It looks like this is only going to come to a head when the Spanish system is tested by one of us refusing to pay. That date would appear to be fast approaching for some of you (I personally have til Oct 08 to settle up which I wont be doing) and we will all see then how this goes off legally! Nervous times for those under pressure to pay up soon or risk losing their deposits?

Just copied and pasted this from tarays sales pitch for the new site in balsicas they must be getting our sports complex.

I disagree, anyone bying balsicas will be misled just like us, doubt they are going to build a pool and sports complex.  This is a selling technique to attract buyers, as a matter of fact its not a technique but a scam.  Warn others before its too late.

We were out in Spain a couple of weeks ago. We spoke to the builder about the pool who really just told us the same story as we have been told by Taray since before we bought. The building of the pool is in the hands of the local council, and until they decide what they are doing, nothing will get done. The builder said that the council could even choose another builder to build it if it so chose. He believed that the pool and sports complex would still be as on the original plan in the sales office, i.e. 2 pools, driving range, petanque, tennis, etc. In his opinion, this would be the most likely outcome.

We also asked our lawyer about the pool. She said that sales contracts would not be expected to include any information about the pool as this is a communal area, and has nothing to do with what you are actually purchasing which is your home. She said that only once the whole development was completed and the owners association was set up, could anything be done, and this would then have to be taken up with the town hall. Let's hope we don't have to wait that long!

I DO think it is a nuisance that we don't have a pool yet, but I must say that Taray have ALWAYS told me a consistent story about the pool, and I don't believe they have lied to me. I hope I'm right!

Just got this from my agent


The sales director Joaquin from Taray has just rung me to update me on a few things and I asked him what is the true position with the pool at San Cayetano.

His comments were that Taray are committed to putting in the pool facilities at San Cayetano the delay has been with the council making up their mind as to what exact facilities they want included.Until the council decide they cannot really complete fase 1.

The original plan was to complete the complex by the end of 2008 but the council has caused the delay.

Taray are going to make a start in September on the area and they have proposed a solution to the council and they are ready to commence the works so that they can complete the project before Spring / Summer next year.

He also told me that work would be commencing shortly on the fase 2 of the project across the road as they have now received their building licence.

He said they have been streamlining their operation because of the down-turn but they are not in any problems and are still giving new clients bank guarantees.
I hope the above information is of some assistance to you.

              Is anything in writing? This is because all of this seems to be word of mouth and second hand info, who spoke to who etc.  This is no critisisums but why don't Taray write to us all ? 

They sent a letter to us all okay when it was to ask for completion funding! so why not update us all by a methord that may hold some integrity. I for one don't hold much faith and will be one of the first to invest in legal action when they try blaming the council.

Would United golf get away with not building the golf course and then just blaming the council!!  Why do Polaris world bother with the greens, just sell the houses and blame someone else.....Taray must be quids in and they are still stringing us all along somehow

We live in San Cayetano now and have for  over 6 months and had been told now and in Jan 2006 that the pool would be the last thing that TARAY would do before the site was completed, so why not just wait and see and stop second guessing what will happen TARAY have a second site to complete and I cannot see they will pi;; every one off with that kind of investment outstanding 
The Hacienda has now been dropped from the address.

Hi Peter ,do you have anything in writing about the pool? Our solicitor has wrote to them on 2 nd week of June 2008 for clarification but had no response at all what would that tell you? 

We are not the sort of people to just wait and hope for the best when there is such a lot of money at risk. By the way if you look back at these posts you will find a whole lot of conflicting verbal versions all we have been told. by Taray Also one post from another Taray site where their promised sports complex turned out to be youth club for the local spanish I do however admire your sense of optimism.

I am sure many others take this issue as a very serious matter on which they require firm written clarification before they hand over hard earned cash !

Hi pete

silly boy, thanks for the time I spent on site with all the people that are your freinds, and are enjoying every minuet there, some people on the link are looking for ways out of the contract  and by the sounds of it you are better off if the pool doesn't get built.

I wish i had the property you have with or without the pool, by the sounds of it, it will be packed with all these other people anyway, the beach was one of the main attraction I thought and your location being close enough but without paying the coast priemium on the hose.

Good look for the future and I hope I can get back over to see you all next year.
