i know what taray are saying but it has now got to a stage that i don't really believe them.  if i think about we were told the pool would be there in  december then it would be when our block was finished  then the apartments and now its the town council problem.........

the excuse given to the first occupiers was that they were waiting on the other blocks to be completed etc and how they could not put it in with building going on etc which made sense but then they go and build one at the apartments????

and now we are being told its the town council building it and running it so they will decide if and when they are building it and also what way it will be and when it opens etc i dont really think that is good enough and its not wat i wanted

i would be very interested in what your solictors are sayinig.

Our solicitor still attempting to find out  situation re pool and facilities but i think its time for everybody to realise that things are not adding up and we genuinely feel we are being lied to.  People had better be aware that unless we take a stand now it will be too late.  Our properties will be worth significantly less without the pool etc.   Nobody should close there deals without this issue being sorted once and for all.  Without pressure as a group we will have no say in this matter any more. without a doubt Taray are not giving us the truth.  What does everyone else think.  Was this false advertising in the brochures ?  Are we entitled to our 40% back or are we all bunched.

Have just looked at the articles section of the eos website. In the buying process section there is a post from a solicitor called Publicity-Part of contract. Although i am not legal minded it looks like it is court judgements or laws regarding the sale of developments by developers. The way i am reading it, its tarays responsibility to build the pool, as it was advertised to be included in the sale of the properties. Maybe someone else could take alook at it and see if they come to the same conclusion as me.

We have got our solicitor involved  with the pool issue but like many of us we are having trouble getting any real answers.Will keep trying as we should be completing on our quad this week .

Have just read the article and I agree witth you Tom that if the pool was advertised in publicity literature then it forms part of the contract.

As the contract iis with Taray then it is there responsibility.

I have asked my solicitor to clarify the situation.

Will let you know when I get a reply.

This link should take you to the article to which tomveron and  laserman refer.  It does read as though the advertising material we received forms part of our contract.  What worried me about our contract is that there are important bits missing from the English translation.

Our agent is still saying that the leisure facilities have not been cancelled.  The builder has put all the necessary paperwork in to the Town Hall and it is the Town Hall that is causing the delay.  There is no way of hurrying the Town Hall.

I am waiting to hear from our solicitor.

Having read the article it seems certain to me that Taray have an obligation to build the pool.We are  completing on 12th June nevertheless. I think we should all pool (sic) our  resourses and take Taray to court. I realise this will not be a quick process but it seems we will be able to apply costs (eg. money lost due to the lower value of our property without a pool, and also the costs of solicitors etc...
To get the ball rolling first we need a list of names and property numbers of those who are complaining. We need to research if any other developments have had the same problem and how they resolved it and then we need to find a lawyer with a proven track record in conveyencing / company law to take up our case, I am sure we can get agreement to meet these costs as we would be awared them back in damages. LETS START DOING as a group rather than inividuals, who I am sure Taray can put off eg. "The cheque is in the post"  What does everyone else think?

I'm on Tarays other development Torre Alcantara Balsicas we where also promised things on our site, which was in the selling details (Green areas, trees etc). What we got a load of waste ground & Youth Club for the local villagers. Best of Luck you will need it.

hi all,

well as you see from the post before mine they have done this before i would really advise anybody who has not completed their sale like us not to complete as then you have no leverage at all.

i am no longer accepting their word as from the post before mine they have made promises before and not kept them, we should all band together i have no problem doing this at all we purchased a penthouse and bunglow in block 7 they have our deposits but as there is no cert of completion in place they cannot demand us to complete we have been on to our solicitor and he says it will  be likley that they will put in a pool  but i want to physically see it before i will complete.

i think we are all being taken for a ride here and there is now way i am handing over more money on the acceptance of their word.... if we all push together and refuse to complete sales until this issue is sorted this i feel is the only way we will get something sorted as the word from all those who have completed is that they cannot get any answers at all.

Good luck on getting Taray to do some thing they do not have to do. 
They will have shown every potential buyer a lovely picture of pool, green areas, club house etc but unless it is in writing with a date of completion it will not happen. Look at the problems and delays of getting something done that is in the purchase contract.
Taray will blame the Town Hall and the Town Hall will blame Taray. Think how long it takes the council in Britain to pay for communal services. YEARS - by the time they confirm it should happen, to finding funding and budgeting for it. It will take even more time in Spain - especially all the secrecy that surrounds planning and funding.
Several months ago I warned that Taray were up to no good and those on phase 1 to beware of what Taray were doing or not doing. I am very cynical of Taray as I (and you) have been continually lied to by them and when you ask them direct and specific questions they refuse to answer.
I have just been watching 'trapped in the sun' on the telly and all the bad things Spanish developrs are doing mirrors Taray.
Many people on this site think Taray are the best thing since slice bread but they are just the same as most Spanish developers/builders - unreliable and untrustworthy. note how the sales people are all smiles and apologies - sorry maybe next year.
I hope a group effort would force things on for the pool as it would be massive addition to the complex.
Until the pool and area is developed, does any one know what will happen to land. Will it be grassed or left as scrub land?
In my home town right now, a large piece of ground that was to be kept as a green area for wild life is now having 180 houses built on it. It only took a few years and an agreement to only built 180 houses with a small green area as oppossed to 210 houses and no green area. 
If the council cant afford the pool or dont want to do it, whats to stop Taray doing the same thing and building more 
properties? 
Many of you will disagree with me and say it cant happen here but take time and evaluate what Taray are doing.

I am due to complete in the apartment block in Oct but have no intention of doing so in light of this confusion. Recouping monies paid is going to be difficult though, is anyone in a similar position?
I will pass on any useful info I receive on the matter.

WE are also in Balsicas.At least we have A POOL and a flyover as a diving board .Make sure the pool is in the contract as we were promised palm trees and a green area still waiting

I am not calling Helder a liar but a month ago Taray had no plans to start the pool area and now it will be started soon!!!
One of my previous posts states Taray's definition of soon is a year away. I might be a bit generous with that definition.
More waffle from Taray. 
It might be worth taking this problem to the whole EOS site and see if other developers have done the same con trick and how the owners managed to get the poo built.

I am on a development near roda golf and beach - we bought our apartment on the understanding  ( and the visible proof of a site plan) that our view would be of a landscaped pool for our neighbouring apartment  block and the local 16th century church and hacienda in the background ( idyllic?)  

what we've got is a view of another apartment block and our pool is now slightly enlarged to accommodate three apartment blocks. no privacy, no security and no view.  we have tried fighting, complaining etc, and have been met with the spanish brick wall.  The builders have argued that the plans were changed before we signed our contracts, and that the plans were just architects impressions!!  - it is still ongoing.

Beware of spare ground.

hi all

spoke to our solicitor yesterday he had been speaking to toray ( i dont know who there) and they said they will be building a pool soon he told them he wants this in writing when they are building it and details of the pool and when it will be open etc.... he is giving them one week to have this to him.

agree with the last post maybe if we go on the eos site we will get some advice on what to do

To tell you the truth, so far I've found Helder really helpful and completely honest. Whenever I've asked him about anything and when it'll be done, it's been done. I have lots of faith in the guy. Hope he comes through with what he's said about the pool, too.

hi just a suggestion could we all send a email to the customer services in toray and see do we get any reply at least then they will know that there is more than a few of us complaining and we can all see what answers we get if any that would be my suggested start perhaps somebody here knows the best email or contact to try in toray we can draft an email between us and all send the same then they will know we are all working together but then again i would be suprised if they were not already on this site and well aware of the situation but we would show them how serious we are.

i presume most of us have still to pay the balance so this would be a lot of money to toray espically in the current situtation in spain and this i feel would give us our only chance to put pressure on them i would say once they have your money they wont bother with you maybe i am wrong on this

Don't know if this helps, but last week we drove through San Javier and noticed a large Taray Customer Service building.  The address on the back of Helders business card seems to be this building:
