Hi Finn

We have not spoken before but I have followed this thread from your first post.

I am thoroughly pissed off too, I am fed up with the lies and dishonesty on Taray's part.

I just want what I have part paid for...

For the people who are fighting for what is rightfully theirs to be called whingers and trouble makers really hurts....and don't even get me started on the ones who obviously live in a parallel universe, who believe everything Taray feeds them.

I am at the end of my tether!

Hi all,

 

Its sandra Greene here and I have not posted anything on this for a while ( bar the joke that backfired with tina).  Thanks finn for your words.  Yes  we are the couple who lost fifty grand.  A bitter pill to swallow and one we will have to pay for for many a year to come.  When we cancelled our hand was forced because joquin told us that after a certain point, not just when the lfo comes in, you can be forced to sign or lose your money.  We had to make that dreadful decision there and then .we could not afford to wait or take the risk.  I asked many a time on this forum for info and support but got very little bar from al finn ,laserman and one or two others.  All the info that tina put up recently was new to us and i wish we had known it earlier.  Al and fionnula sorry to hear that you gave up one of your apartments and i sincerely hope that Taray do finish the site but i also believe that it will be a long wait.  Taray told us that without doubt the pool would be in last summer and that i and my three kids would be thaer but lo and behold I doubt it will be in this summer.  It is three years practically since we looked at Taray and now the kids are all three years older and ther is no way they would want to be there without the facilities.  There would be little for them to do.  Also i bought in SC as a holiday home to really find that it is a residential area and not really a main holiday area.  Then we were told that social housing was to be included and that certainly was not on my agenda.  I was sold this as a holiday home.

 

What I cannot understand is how Taray are selling phase two without phase one being sold and many still to sell on phase one.  I think that Jonah may have a hard time selling his quad and i do feel sorry for them.  I also believe that Taray do NOT care what happens to the people that they have sold to and dave he laughed at us when we said we wouldn,t finish and said well don,t and we will see you in court.  He was very brisk and sour.  We arranged a friendly meeting with him but after two minutes I knewthat I was getting nowhere and that he did not care.  It is time that you all got a bit stronger and joined forces as that is the only way you may get things done.  I really hope that you all succeed in your quest .  Redwine and niceboy were definitely Taray at work.  Good luck dave and Al  I do think the pool may go in sometime this year but hey who knows with Taray.  We could not wait forever and do not regret our decison just the loss of money.  I would only look and comleted builds in the future and believe nothing a builder would tell me.

sorry if im stating the obvious but im in the same position as dub and irish, did your legal; people offer no hope of a refund on any grounds? False advertising and lack of transparency come to mind.

Just got back from Taray office in San Javier to see Jonquim about the pool,he advised us that it will be started as soon as the paperwork comes back from the council and it could be possibly started within the next month,we wil see!!!

Hi Seamus,

We were left with a simple choice by our solicitor: lose 50,000 or risk losing all our 83,000 if we waited until LFO came in and then didn't complete.!  We flew  over especially for a meeting with one of the directors of Taray before we made a decision last October.  I swear he only gave us 3 minutes, sneered at us and told us to go to court if we weren't happy. That is what you are dealing with out there! We were stunned and decided over a few drinks to pull out that afternoon. We felt so abandoned and were shattered flying home to Ireland.

That was 4 months ago and although i will be paying for this for years to come i must say i think we made the right decision. We were sold a lie whatever happens. This is not the beautiful holiday home by the pool we thought we were buying for our kids! This is a spanish housing estate with a lot of decent people having been conned into false dreams by rogue builders. And the terrible thing is they look like they are going to get away with it! I feel sorry for all the decent people caught up in this but we were left to fend for ourselves. Before its too late everyone should unite out there. Dont let another brick go up. Then they will talk to you!

We also put down a deposit of almost 2,000 euro for furniture which we cant get back from the shop. I'm still trying to get that back but the agent we bought through is not helping out there.So all in all its been a nightmare especially having to tell my kids our holihay home is gone. That was worse than losing  the money! Maybe some of the facilities will go in, but nobody should have been put in our position. If Taray were genuine this would never have happened. Its not too late if you are determined enough but it is too late for us! Good luck.

Yesterday we had a meeting with the councils planning department.

I now feel positive the pools and leisure area will be done. Altho its all been heavily delayed what we heard yesterday was positive news and I no longer feel I need to take any further action.

We have a further meeting with the council in a few months to see that all is rolling in the right direction as planned.

On visiting the Taray office at San Javier about another matter I asked again about the pool.

Like other owners I was told that final permission to start was still awaited from the Town Hall but expected maybe this week. They hoped to have the pool finished by the end of July and yes Tary would be running the complex as a seperate entity. How they would charge was still to be finalised.

I now have a copy of the plan which I have been told has been approved and this is what they will provide.  Though it looks comphrensive  it is a scaled down copy of the orginal so no measurements are available from it. the plan includes a covered pool with sliding panels, a kids pool, golf driving range, boule court(s), tennis court(s)  changing rooms and a cafe/bar building, etc. The solar panels forr heating the pool are also shown. There is no 3d dimensions to show height of buildings etc.

It would be great if Taray communicated to us ALL with a newsletter etc as to their position so that all the little meetings and gossip  were unnessary and show that they, Taray,  have nothing to hide.

Are there any surveyors,architects,builders on this forum who could answer a couple of questions.

How long does it physically take to build a pool on phase1 and phase 2? According to posts both pools should be ready around July-ish. Is this a practical date or just appeasement?

What about the club house, leisure facilities. how long  does it take to actually built this type of facility?

Taray have been going great guns so far on phase2 - will building these facilities slow down phase2?

Does Taray have enough resources to take on the extra tasks in the middle of a credit cruch? There are plenty of builders on the dole in Spain but it will cost money to employ them.

By the end of the summer (if you believe Taray) phase1, phase2 (almost) and the leisure facilities will be completed. What happens then?

Taray have said " hoped", "maybe", "expected", "council delay" far too often to me. I think this is another delaying trick on Taray's part. As Tina has said, I also think Taray will build all the facilities but not until parts of phase 2 have completed and Taray's cash flow has improved. Taray will have a schedule of works time tabled to suit them and not the reisdents or buyers. The only thing that will change that is financial pressure. Taray has borrowed some of Tony Blair's spin.

By next summer we will all be wondering what the fuss was about as we enjoy the fabulous facilties at SC. The pound will have recovered as well.

i would really like to believe it, but i have heard so many times in the next few months and now its few years...

i dont really mind that it is not a holiday development per se but i just want the facilities that i was sold and that i wanted... yes sandra we could no longer take the risk and go with the two so we pulled out of the bunglow and lost 35K we would have pulled out of the two but could not take the risk of losing everything like you we will be paying for this for a long time to come and it is really a very bitter pill to swallow.

can we all not agree that we have been all promised a few more months a few years ago?? i feel i have been more than patient and its very easy to blame the council etc surely all the planning had to be in place before they got permission in the first place so i find it a tad hard to swallow that they had to go back and get planning for the pool etc which was a central part of the whole bloody development.

those buying in phase two i would be really really sure about what i was doing before i handed over deposits that you cannot afford to lose.

I have been watching this forum for about a year - ive read most of the posts and decided to respond to the good news because i am looking forward to moving to san cayetano in a couple of months with my girlfriend. I have visited SC for about 4 times a year for the last 3yrs and have watched all of the progress and can see the physical differences on the site.

when i heard of good news regarding the facilities i was very happy and wanted to cheer people up and put a positive input to the thread.

so i wont be changing my nickname, or getting concerned by the negativity on this thread. i have just as much at stake as the rest of you but realise that in the current economic climate that a lot of builders and agents in spain have gone bust and defaulted on their obligations to lots of people ,,, frankly im glad taray dont appear to have exposed themselves too much into a loan for the development (i am not just blindly making this up i have asked my solicitor to check this out and understand their status).

 

so its not surprising when in spain where regions like murcia (formerly agricultural) is so reliant on continued sales mainly to british people causes things to slow down and take a long time.

 

Summary - i am just glad that most of the development is done - i wish the other parts were finished too - probably they have to sell the 2nd phase to make enough money to be profitable enough to finish those nice features on the 1st phase - moaning and stressing about it probably wont make very much difference at all apart from registering your dissatisfaction with taray (which i respect that you have the right to do) - i hope for the people who will become my neighbours that you can be positive and i think in my opinion of the business that taray are run in a much better way than most of the others.

 

i really am a niceboy and want to get on with the people on this forum - i think this is a great place to exchange information and a good community idea, please dont get upset with people without getting to know them.

hi tina,  we will still be neighbours as the penthouse we bought was on top of the bunglow.  i cant wait for the whole thing to be finished, as with everybody else i love the layout and the development i love the town and where its located being from a rural part of ireland. i just wish i had been told at the very start that the pool would be 3 years thats all.

I think you confuse negativity with the truth/reality. As you have been reading this forum for about a year and visiting SC for 3 years, you will have realised not to believe what Taray say until it actually happens. Taray told me for 8 months that they were expecting the building licence for phase2 next week. I was originally told 2 years ago all building licences were in place. The same scenerio for the pool and lesuire facilities now. You will have noticed that Taray comit to very little in writing and when they do it always has "maybe" or "hopefully" in it.

In the unlikely event that Taray go bust it will only affect those on phase1 who will be left with a part finished complex - nightmare situation to be in. Those on phase2 will be able to execute bank guarantees for a refund of deposits. I agree with you, and stated previously, that Taray will not do any lesuire facility work until money starts to come in from phase2. (cashflow is king) They may built the pools on phase1 and 2 at the same time as this tends to be specialist work.

Due to the world wide recession (Spains economy shrunk by 2.5% last quarter) which is expected to last until 2010 at the earliest, who is going to buy the other half of phase2 if it starts or will it be left  as scrub land? There will soon be more pressing questions to ask Taray that are not of Taray's making.

Even tho that piece of land has been given back to the council its well known within this industry that the promoter will be the ones that build on it. In the event that the promoter goes bust which we think is unlikely with taray as they are a strong company then the council will be obliged to finish this area off as a leisure area providing all the paperwork is legal and correct which in this case it is. This is what we were told at the council meeting. I dont know the final details of how the council would complete the leisure area, its a grey area but i think the council would then be paid for this but to be honest now that taray have put in the application i see light at the end of the tunnel and have rebuilt confidence with the pool and leisure area.

just a word of caution to those putting deposits on phase 2, some friends of ours bought in tenerife and the builder has just gone belly up.  They have 50k down and they have been told that they have very little chance of getting this back never mind bank gaurentees etc???

i am only repeating what i have been told but basically it works same as in ireland that when a firm goes the first people to get paid are the govenment then banks then outstanding suppliers employees etc

as i said i would be very aware about putting down large sums of money when there are plenty of key ready properties that are currently for sale with all facilities in place.

I would see if Mario de Castro on EOS can help. Bank Guarantees are not included in any assests when firms go bust. It will take a bit of fighting but for £50k I would give Rocky a square go. There is lots of advice else where on EOS - pass it on.

I dont think many people will be putting large sums of money on phase2 as there are no buyers about just now, but there are lots of us that have deposited very large sums of money with Taray for phase2. All we can do is sit back and wait and see what happens. We can monitor the situation with the pool/lesuire facilities and how it will affect phase2. When it comes time to complete at the end of the year, people will then be able to make an informed decision on how to progress. I sincerly hope all the facilities promised for both phases are up and running.

There are 2 'official' looking men on the site of the planned pool, measuring up with what appears to be surveyors equipment. Don't recognise them as Taray people?? They are wearing high viz and hard hats over their suits.
