Hi El Robbo.  Palmera said Urbasa had deposit and they dont know why they were saying that Palmera had it!  I said that because nobody heard anything from Palmera and that we were all told so many lies we didnt know if it was Urbasa lying or Palmera lying. To which he said that no communication was perceived as a sign of guilt on their part which he understood.  Your right about the property market there but we looked extensively around and they are not as cheap as when we bought off plan but there are lots on the market.  It is so difficult to know what to do.  However Gotardo is definitely worth having a chat with.  Good Luck!

After five years trying to talk to Mr. Gotardo, or to have our communications and requests answered by him, it is actually very kind from him to give you a little bit of his time. 

I can not deny that realising he (and his assistant) are "genuine and honest" is a big surprise, given the fact he is charged with fraud and misappropiation in, at last, four criminal procedures, having receiving millions of euros, none knows where they are. Maybe Judges do not share your nice opinion over him, Danny72.

In any case, I do recommend all buyers keep on trusting the legal advide of their INDEPENDENT lawyers as any kind of agreement and "swapping", even wich such an "honest" man, will have serious legal and taxes consequences which need to be considered carefully.

DOES ANYONE REALLY KNOW IF URBASA HAVE GONE BANKRUPT OR INTO LIQUIDATION AND IF SO , DO YOU HAVE ANY PROOF  ?

IF THEY HAVE GONE BANKRUPT OR INTO LIQUIDATION THEN IT WOULD BE POINTLESS TAKING THEM TO COURT

WE ALL WOULD HAVE LOST OUR MONEYS !!

Dear Urbasa buyers:

Up to 9th September Company Registry Info, Proyecciones Inmobiliarias Urbasa  S.L. has not been declared in insolvency. 

The point of taking them to Court (in an individual and concrete legal procedure -or in a common creditor meeting, if the situation arise-) is trying to have the money paid back, after two years of stopped building works, huge delay and breach of the contract. 

You would not be in the risk of losing your money due to Urbasa´s insolvency, you would be maybe losing your money since the moment you paid it  -with no bank guarantees- or the moment they gave up building works in 2006.

There are only two options: crossing your arms and do nothing or take them to court trying to have your money back.

Thanks very much for your input and information it is really appreciated, the main issue and I think I can speak for the majority on the site is that we have all lost or presumably so a great deal of money , most Lawyers in Spain  who have been contacted regarding taking Urbasa to court require 2000 Euros  irrespective of whether the  case was won or lost  also  + 10 % of any   final settlement amount plus of course the IVA tax.

Many have sunk their  entire life savings into the venture and cant risk losing anymore of their hard earned money even if they had any. A few lawyers have commentated that its highly probable if they do declare bankruptcy  that not much money after liquidating their assets  will be left  for the creditors so it looks as though purchasers are in a lose lose situation.

In the UK many solicitors work on a no win no payment basis (meaning the Lawers fee is taken from any recovered or final settlement amount whatever that may be)  I am not sure if any work on similar basis in Spain but if so I am sure many would take the legal route

Hi misty i have been looking around about no win no fee but i cant find any that do it there in spain 
but aparently if you win in court the people that lose have to pay the court fee's and solicitors cost much like here

Hi all, we're back after a few day's break, we have to say this website reads like a horror story when reading the messages written here lately.  The information given by Patricia Morales is helpful, and we've just searched online and found some information regarding the background of Mr Gotardo (whose full name is Jesus Gotardo Rodrigues) and apparently he is out on bail regarding fraudulent dealings on the Costas.  It is understood the properties in Formentera are at a development called Brisas del Mar, but remember they are key ready and no one is appearing to touch them with a bargepole, so be careful.  They are also steering people to a place named Mirador de las Palmeras which we believe is somewhere near Almoradi and much higher priced than Amarion III, we know the Costa del Sol Action Group who've been fighting for their money back too (or their intended property) have come up against problems with legal actions concerning Palmera and a company called Grupo Mirador, so not sure if this site is anything to do with them.  There's so many pieces to this puzzle.

hi wotnocasa,
    thanks for info,thought something fishy,when they suddenly got in touch. 2yrs ago they did not want to know, now all of sudden they offering properties and want more money,is he thinking screw us for more to pay for other court case?
   we are still going with solicitor and should be going to court soon. it is only thing to do if we want chance of getting anything back. we will not just write it off,and will not give them any more.

Hi el robbo and whoever's reading this, not much more to say is there..it sure smells bad whichever way you look at it.  Still waiting to hear of anyone who has a firm answer from any lawyer, I guess they are waiting to see if Urbasa files for bankruptcy, we haven't been given any legal update lately. As a point of interest we were told (in writing) by Urbasa that Palmera had our money and Palmera told us Urbasa had it, that was when Ainhoa Reyes was dealing with things at Urbasa.  The mind boggles..

I live in  mirador  las palmaras where they are trying to send people,  they are different builders but sold by palmeria, there are about 90 empty and they are 20,000 euros more, and gypsys have recently moved in so be carefull everyone

hi all, palmera sent us an e-mail last week with a list of apts in Formentora, all of which are more expensive than the one we put a deposit down on. They reckon that we are getting a bargain! Fat chance, would not trust them as far as I could throw em.

We also Have an apartment in Mirador De Las Palmeras. It is a community of 97 apartments , of which there are about 15 unsold. ( mainly owned by Palmeras) . The apartments are in a lovely spot - 10 min walk from the square and we have had numerous great holidays there over the last two years. They were actually built by the building arm of Palmeras properties and are finished to a high standard.
                 As for the gypsies. There is a family renting, who aparently have gypsy in their blood line. We personally have not had any problems with them, but I do believe they are disliked by some members of the community. The apartment they are renting is owned by an English man.

Hi selaine, thanks for letting us know about your apartment, we thought that perhaps gypsies had just moved in as they do in empty places, but if they are renting and paying their way that throws a different light on it.  Trouble for a lot of us who reserved through Palmera Properties (ours was reserved at Amarion III in Oct 2002) is that we paid a price appropriate to that time and now they want quite a lot more so we can't afford to do it even though they say 'its a bargain'.  How much does it cost to rent a place in that apartment block?  your input is appreciated, thanks.

Hi all   

i have a apartment in formenera del segura 

with the state the world is today , if you actually go to the village and look at the apartments that are allready built  and you like it 

buy one there   we love it    but its not for everyone    it  is a very quiet village  in the middle of everything

quadamar beach is 10 mins away in car 

so is almoradi   toriveca ( cant spell it)   20 mins away

but we do love it and prices are coming down like all over the world 

if they want 80.000 tell em 65.000 and see what happens

there is a lot of builders struggling now 

take advantage like they did with us

ya never know ya min't make ya money back what ya lost

any how thats my thoughts  up to you lot to make up your own minds 

we are actually going to move out there later in life when we are ready and cant wait

but work comes first


by the way i dont think the gypsys are much to worry about in the other village
they have laws in spain 

to stop people making to much noise  etc

I have been away from this web site over the last 3 months due to relocating to Singapore for my husband's job so I am now catching up with the latest events. It seems that nothing has changed since I was last on here.
 
It makes me sick to think of how much money we have lost on this. To make it worse, I actually remortgaged my house to pay the deposit so I am now paying this back to the building socieity with nothing to show for it.  I may as well have shoved the money down the toilet and flushed it away. 
 
We decided to not take the group legal action in the end as I felt they were asking for far too much money and we needed every penny for our relocation.  Having looked at the recent posts, there doesn't seem to have been much movement on this either.  If there was a cast iron guarantee that we would get our deposit back I would borrow the money from family but it seems if Urbasa go bankrupt, we will not get anything anyway so that would be another €2000 thrown away.
 
I can't believe the cheek of Palmera asking for a further €10,000 for an alternative apartment.  Do they not have a cell in their brains that tells them how insensitive and insulting this is.  They should be offering us an alternative at no extra cost.  It's like 'oh, never mind the £20k you've lost already, you won't mind giving us an additional €10,000 will you'.  Arrgghhh.  And whatever happened to their 'agents fee' we paid them, which was to see us through completion.  Have they offered to give anyone this back due to incompletion of contract?
 
Also, is Spain completely full of crooks?  Is there any lawyer or someone who is honest, god fearing (not that I'm religious), trustworthy, non-criminal, not on bail, not trying to rip off hard working brits who are just looking for somehwere nice to go on holiday.  Is there anyone who we can trust who will get us our money back without ripping us off further in the process?
 
I would really like to find a way to get our money back but if someone said, kiss your £20k goodbye and get on with your life, you will never see that money again then maybe we can all get on with our lives.  I just hope that everyone involved at Palmera and Urbasa who have ripped us off die horrible deaths and rot in hell forever!!!!!
 
Rant over.  Now I feel better.
