Hello all,

Just to clear up a point as to the finish date of the apartments. When I sent the copy of my contract to a Spanish lawyer he told me that to build the apartments, Grupo Urbasa had to apply to the authorities for a licence to get permission to build. The licence stipulates that the property must be built within 3 years of the date of the granting of the licence and a further 3 months would be allowed for any unforseen delay in the completion of the build.The licence to build the property was granted on 5th October 2003 which means the date for completion was 5 Oct 2006 and with the further 3 months allowance January the 5th 2007.

Hello all

I asked a friend of mine who lives in La Marina to phone Palmera as a prospective buyer of an apartment in Amarion 3. My friend states that Palmera does not envisage any work starting on the project for two to three months.

Hi I was out viewing property at Luz de Almoradi at the weekend witha view to buying.  Had a look at Amarion3 (only passing in a car on Saturday) but no visible sign that any work has started. There was one small one-man type digger (the very small kind like you would use to dig your driveway at home) sitting outside the property, but that was all, doesn't look anywhere near complete, sorry to be the bearer of bad news.

have just returned from spain after a few days break

I saw laura in almoradi.  the situation regarding the build is unchanged ie she says that they have yet to decide which builder to use for the completion stages. she says they are negotiating with at least two builders. once they have reached an agreement then work will commence to complete the build. it looks to me that at least 2/3 months work is needed but this would depend on the numbers of workers being employed

I know this has been mentioned before but as regards kitchens/wardrobes urbasa again emphasise that they will not supply these unless it is specifically stated in their contracts. it would appear that they will supply these just to the few apartments they added on after the original plans were altered. if palmera said you would get these AND you have this confirmed in writing then you would have some case against them otherwise we all would be spitting in the wind.

from what I saw personally - internally the actual lifts still have to be installed, stairwells completed and at least 2 floors have to be finished off doors ,baths etc. most of the ground floors have the front doors on so assume that they are more or less finished. all the internal brickwork is still exposed (and some external round the south side) and has to be covered in the coloured cement like material they use

the road from the north (main road )  to the south side of the building is closed. this is because the council are building a new roundabout on the main north road hence the small digger. the pavements are also being re-aligned to the west side.

I did take some fotos and I will post them if any they add anything to those already posted.

I also met with James in alicante.  he did not add anything new to what has already been mentioned on this forum. he only again says that a letter is due to come from malaga in a short while giving the latest situation.

I did see earlier in the forum some people referring to a contract with Palmera. as far as I was aware the only valid contract should be with the developer urbasa as Palmera are only acting as selling agents with none or very limited legal liability on their part.

Hi everyone I emailed James yesterday and this is the reply I have just received does not say too much but let you all have a look , I asked when we would be receiving the letter about progress.

Thanks for the email – the letter was in it’s first draft stage the week before last. I saw it, although it was in Spanish awaiting translation. It had to be updated/changed slightly and I think that there have been developments in the last couple of weeks, so it shouldn’t be too long now. We have heard that Urbasa have now sold some land and will be able to restart work on the development. We have also heard that they hope to finish by January. However, we have not had this confirmed in writing by the builder.

I think you are better waiting till after january because you have signed your contract, If they have not finished by the date they said they would they are in breach of the contract and not you,  Then you have more chance of getting your money back

Amarion 111  will have gone up in price since you bought it 3 years ago, I personally think it would be daft to pull out now so close to completion date

I  know its a pain in the you know what waiting but i think its better to do so

I dont know what the financial situation would be but i exspect you would need to pay for a lawyer and if you pull out now before the date in your contract you may not get any money back for you would be in breach of your contract

Hi Jamrock yes I agree with philansy. We have waited 3 years whats another couple of months? At least hang on until their contractual date is up in January. Then decide what you want to do its GOT to be ready sometime soon.. SURELY!

January will be here before we all know it and then we can all join together and fight for what is ours.

I found this little snippet in the general discussions and thought it may be of interest to jamrock.

Coles family are correct that there is a time period to complete by, but my 12 year in practice solicitor has never dealt with anyone who has ever obtained the legal full refund plus 6% interest that the law dictates.  There are too many excuses that can be used such as inclement weather (!) and lack of suitable labour (the state projects such as road building apparently have first call on legal immigrant labour).

Hope this changes your mind. Even if you don't want it any more, you should see it through to the end, then sell it. That way you may actually make some money, instead of losing it.

Oh dear that is not looking good. We use Palmeras solicitor too, we had  better have a look at changing if we still can! You just never know do you, we thought they were good at first but as the years have gone on it gets more worrying.

We have also used the solicitors provided by Palerma Properties, and are now looking to change. Is there anyone that has a independant solicitor in the Almoradi area I would be greatful for any contact details.

We went to a solicitor which is literally in the next street to grupo urbasas shop in Almoradi, and asked them to represent us and after a lot of muttering in Sspanish and pointing in the direction of grupo urbasas shop they took copies of our paperwork, but we never heard from them again. We was wondering if they were all too close to be at odds with each other, or am I being too suspicious. This was Omega Services, they seemed quite professional and also very convenient. I think I probably just need to chase them up

hi,everyone,

e mail recieved today from malaga states they are as much in the dark as us as to what is happening at amarion 3. they are still waiting for the letter from senior management , then they will translate and send out.hopefully it will be sent out in next few weeks.they dont think building work has started again.

the few weeks for this letter is turning into months, we spoke to james in august it was a few weeks then, in this e mail they have not answered or mentioned any of the questions i put in my e mail, which i sent 7 days ago. think we may have to keep on at them .

Hi All

Please find below a copy of the reply we have received from Malaga by e-mail, not good news but at least news.

can understand your frustration, we have been aiming to produce a further written update, as the last was sometime ago.  We however have been seeking clarification from the builders and involved parties.  

 I have today discussed the matter further with our Managing Director, and he has made it clear that he has been speaking with Urbasa (the builder), they have recently sold one of there plots of land to raise the required funds to complete the project.  He has advised me that the builder expects to be back underway by the end of January, and that it would only take a couple of months to complete the project.  I am awaiting further assurances that this is the case.

 If you remain in contact I am quite happy to relay any information I may have.

 

This was received from Palmera today 8th November 2006, I have seen the negative comments on here about them, dont think they are totally justified,  but dont think we need worry too much as they always reply straight away when we contact them. The real problem lies with Urbasa who are basically not getting their act together.

Good Morning all, I have pictures of the site from Jan/ Feb 04 which shows the land being cleared and the pile drill in operation. These are dated pictures which were sent by Palmera to us to verify that work had started. This would tie in with the 36 month plus possible 3 month grace period.

TO
FINALIZE THE BUILDING. IF HE DOES NOT THEN YOU CAN ASK FOR YOUR MONEY
