Hi
we are setting out some rules for our Community pool and are finding a lot of objection from some of the owners who want to treat it as their private pool during their two or three weeks stay a year.  Does anyone know if there is any "law" covering the issue of babies wearing nappies or other protective clothes when in the water  (for reasons obvious to us but not all) and also is there a legal age below which children can be in the pool area unsupervised as we do not employ a lifeguard?

Hi there

These are our community swimming pool rules, they form part of the community rules that have been voted on by the owners. You can vote on any issues but must also abide by the law (i.e. food and drink). So in truth you can vote that nappies etc not be allowed in the pool, this then becomes binding under Spanish Law and is enforceable by the Developments Adminastrators, enforcement can ultimately end the owner in court.

a) Use of the pool and pool area is restricted exclusively to owners, residents and people staying on the complex of “Hacienda del Marques II” in accordance with internal rules of the community.

 

b) It is not permitted to swim in the pool with normal clothes on, it is necessary to use and wear appropriate swimwear.

                   

                      c) Before bathing it is compulsory to shower, at all times.

 

                      d) Do not throw paper, litter or other waste on to the ground in the pool area, use 

                           the litter bins provided.                      

 

e) Do not leave Lilo’s, inflatables or other pool related objects in the pool when you have finished with them. Do not leave Lilo’s, inflatables or other pool related objects in the pool area overnight.                

 

f) Under Spanish Law – Health & Safety, smoking, eating food and drinking is NOT permitted in the pool area.

 

g) Consideration must be given at all times to other users of the pool area.

 

h) Under no circumstance must Glass, China or sharp objects be taken into the

 pool area.                                                                     

                      i) Animals are not allowed in the pool or pool area, except for guide dogs for blind

                      people.

                     

        j) It is not allowed to play any dangerous games that could cause harm to or

       disturb other people

                     

        k) Hard ball games are not permitted in the pool area.

 

l) It is not permitted for any person who is not an owner, resident or staying at the property to use the pool or the pool area. Guests may be allowed to use the pool and pool area as long as they are invited guests of the owner, resident or person staying at the property. The owner, resident or person staying at the property must always be present and therefore be responsible for the actions of those guests.

                       

m) It is forbidden to provide a key to any person who is not an owner, resident or person staying at the property for the purpose of accessing the property with a view to using the pool and pool area. 

 

n) Children must always be accompanied by an adult in the pool area, at all times.

       

o) The swimming pool will open on the 1st of April and it will close on the 31st of October. Any use of the  pool outside of this time is at the personal risk of the person using the pool. (The pool is analysed for bacteria and other pool related water problems every 15 days during the summer period in which it is officially open. No such tests are carried out during the winter period in which it is formally closed).

 

p) Bathing is prohibited for people with infectious diseases.

 

q) Please respect the quiet hours at all times.

on your list of rules for the pool you have missed acouple of major points that you need to make very clear.

No Diving into the pool is allowed. Any person doing so does at their own risk.

All children must be accompanied and supervised at the pool by an adult.

you specify times of the year the pool is open but not times of the day so that your pool cleaner doesnt have to clean whilst people are swimming.

No nightime swimming needs to be specified and also no swimming whilst under the influence of alchol or drugs.

the first 2 could leave the community open to "ambulance chaser" legals if there is an accident.

we have also put all the pool and community rules into our lifts and stairwells so that residents and guests have no opportunity to say...nobody told me!!

cover yourselves or make a larger allocation of budget to insurance against accidents or death on the complex!!!!

sorry to be negative but we live in a society where there is no such thing as an accident anymore...

Just come across this discussion, and it's a topic that I mention in my next article on being president of our community (A Year In The Life Of The President - Part 3; coming soon to EOS!) Denise, you're right, most of it is common sense, but, promedia is also right, there is no such thing as an accident any more, so best get those rules posted ASAP. Here are our rules - ours is a very small community, and every community will have different priorities of course.

RULES FOR THE USE OF THE POOL & GARDEN

 

In the interests of safety and the convenience of all, the Community requires that the following rules are observed:

 

1)      The pool & garden are for the use of residents & invited guests only.

 

2)      Guests may only use the facilities when accompanied by the resident inviting them.

 

3)      To avoid overcrowding, no more than 4 people per apartment should use the pool at any one time, unless by the prior approval of the President.

 

4)      Children under the age of 16 must be accompanied by an adult resident at all times.

 

5)      Excessive noise or other behaviour which may disturb other neighbours or cause damage to communal facilities, is prohibited.

 

6)      Litter and personal items should be removed when leaving the pool/garden.

  

N.B. These rules may be amended by the Community as & when deemed necessary.
