Just Received the following e-mail

Dear Mark,

Thank you for your last e-mail.

My apologies for not having answer sooner. I have been terribly busy since April as I have been attending in the San Javier office as well.

In any case I am GLAD to inform you that we have good news on relation to your case.

Huma was condemned to pay you the money BUT as they never paid our barrister had to request the execution of the sentence. Due to the execution fo the senten and with the threat to seize with embargos Huma’s assets, they deposited into the court account 30.712 € to cover principal (22.999,72 € & interest and legal expenses).

Our barrister has managed to get from the court the devolution of the principal (22.999,72 €) BUT the interests and legal expenses have to be valued yet from the Judge and will issue a mandate of payment so we can collect such figures.

Although the money for the legal expenses will come afterwards we have to pay the barrister & the procurator his fees now. The FULL expenses have been

Barrister Fees: 5.267,55 euro

Procurator fees: 1.312,06 euro

TOTAL: 6.579,61 euro;. As you paid 2.500 € on 7/01/08 we have top ay the barrister: 4.079,61 euro

So we can return to you NOW 22.999,72 € - 4.079,61 = 18.920,11 euro;

The barrister is transferring such amount to our clients account and we will transfer it to you. Please let us know the bank account details in which you want us to transfer the money (Please include name & address of bank, IBAN & SWIFT). Once the barrister receives the money for interest amp; legal expenses form the court they will return it to us as well and we will transfer them to you

Papers were served to the court Jan 2008, we saw Victor at christmas last year he told us Huma had failed to honour the court judgement so they would look in Jan this year to place an embargo on Hums'a assets.

Overall it has taken approx 19 months from start to finish

We have got back our 2nd stage payment (1st was covered by BG cashed in Nov 2008), our 3005 euro deposit, legal expenses and intrest.

We are getting our 2nd stage payment plus deposit less legal fees paid into our spanish bank this week. we have to wait for the judge to work out and award the legal expenses and intrest before we get it back.

What good news. I bet you have had a drink or two to celebrate I know I would ,But unfortunately our drinks are on hold as there don't seem to be any good news  for  people without a  B/G .but we won't give up hope just yet .

Well done again you all deserve  to be out of this mess.

But can anyone explain this .....

It appears Mark's solicitor/barrister only threatened an embargo - and Huma found some magic money from somewhere.

Why are others having to go down the placing of an embargo - why have Huma not paid up to prevent this?

I am a bit confused - or am I reading the posts wrong?

I don't no him personally, but if I remember  rightly he posted  on here alot when this mess first started if this helps.We could look back on some of the earlier posts.Its  sad and a shame that we don't no who to trust any more . I hope genuin people don't take it personally, we just have to be careful as we have been caught out so many times and i'm sure people will understand this.

I have no idea why this has happened, perhaps it could be that being owed only  23K Euros we are small fish compared to others who are owed substanially  more.

We are in spain at the moment and are calling at  our solicitors tomorrow to pick up copies of our wills.

I will try to see Victor if he is thrie Vera office and ask him some questions

John's so right , it is important we know as much as possible why you managed to get your money back. I cannot remember anyone w/o bg getting their money before so hopefully the reasons Victor can give will offer a chink of light

I am one of the lucky one's who had a bg and got money back but am still owed deposit and compensation etc so if possible would like to recover. Your answers will decide whether it is worth investing nay more money with solicitors to fight this cause

Our solicitor is about to place an embargo on Huma assets. (but wants another €1000's to do it !! )

So maybe, reading below, things are changing in the Huma camp and they don't want this legislation put on them by the courts so possibly deciding to pay up. and if they read this they surely know they will NEVER get away with holding onto what is rightfully your's and mine !! So why not pay up and refund and move on.............

I'm sure the Spanish property sector really needs developers like HM who have done nothing to restore confidence or trust in buying in Spain !!

Before you pay your money over make sure the property they are placing an embargo on has no mortgage or previous embargo on or your embargo will be worthless.

We have also requested that they progress with the claim on HM assets (via courts) paying any bill from their own account and on sucessfull completion of getting refunded then deducted agreed amount. ........This also gives them an incentive to get it resolved.....

Why always money upfront with the Spanish ?

To be fair to the Spanish solicitor assuming you have changed from you original solicitor it isnt there fault that we are all in such a mess.  Also if they don't have money up front they may find it difficult at a later stage to get the monet from a foreign national who is not living in Spain.

My solicitor asked for money up front when I changed to him but has not asked for any further money since we started the court case.  He actually got an embargo placed on 3 properties but unfortunately someone else had an embargo on 1 and the other 2 were mortgaged to the bank so all in all the embargos were worthless. 

Is this developer (HM) still in business ? Are they working on any development ? What's happened to them. They seem to be very low key, not answering emails or anything ................gone underground with all the money............

However, I bet if I emailed to say I wanted to purchase and put down a deposit I would get reaction..........

Answers on a post card please.

I have just spoken to someone who lives on MCC (has been out there for about 4 years) and he says HUMA are still trading but appear to be very short of money.  The father who owns the company has plenty of land in his personal name and owns and trains horses for competitions (he use to be Mayor of Mazarron).   His daughter and her husband work on MCC - she works in admin and he cuts the grass!  He also said he owns 2 properties on MCC the one he lives in and a bungalow that he is currently trying to sell at 85,000 euros (this is one that is on proper electric and water) - that makes a nonsense of HUMA 's ofer of transferring from ACC to MCC.
