court hearing

Hi all.

.Does anyone know anything or was included in the  court case that was allegedly to be on the 25th March at Murcia.Only we were told that this was date from Miquel formerly from Andersons .But we have emailed him and phoned but can't seem to get an answer  from him .We have been waiting for this day for along time and want to know the outcome.We have no B/G and thought he was doing a group case  Any information would be greatly received.

I do hope you get some news soon.  We all know what it's like to have your heart set on receiving news on a particular date, how many have we had over the last years! 

Please do post as soon as you know anything as so many are waiting for news from the courts.  We are not with the same Solicitor but we are for ever hoping to have a date for the case to be heard.

We won in April last year and guess what, no money, so don't hold your breath.

The courts seized bank accounts at Christmas time and now plots have been seized, although we have been told it will be another 6 months yet before we get any more news. WHY? We feel very bitter, and I am sure it shows in this comment.

It amazes me that despite all these legal actions and seizures, nothing is being done to pay any of us back. Lets hope that Holiday Homes from Hell finally do something this time, because most of us have contacted them goodness knows how many times already with no luck up to now.

The producer I was in contact with has not responded to my last e mail, so it looks as though that is now going no where too. I had really high hopes set on that coming off!

Keep us posted and if we hear anything from our solicitor, I will let you all know.

Can i ask what it has cost you so far in legal fees and court costs,obviously you are now in the pecking order if and when humas assets are divided up.

Just a thought has anyone seen or actually been to any court hearings? Or do you get any legal documents to say what happened on the actual day .Hope this makes sense.Just like to know what were paying for.

our court hearing was 2nd april, davies co who are acting on our behalf e mailed me on the 3rd, huma ignored the court and did not turn up for the hearing, for the second time,  davies is now waiting for the court sentance so he can go after a huma property on mcc that has no loan against it.

the court system in spain is as crap as the developers,  god knows how much longer this will drag on, suebila snr looked about 95 when he conned me out of 40k four years ago, i should send the albainian debt collectors..no win no feet.............

We are on another complex. Had our pre court hearing in March, no agreement so court date set for December!

We are desperately waiting for a hearing,  that seems to be taking forever but it really makes me think what is the point.  It is just absolutely unbelievable that this situation is allowed to continue within Europe.  When you think you are on the right side of the law then justice will be done - but  - that doesn't seem to be the case.

We have no BG and have been trying to sue HUMA through the courts.  I have today received this from my solicitor:

- The Court accepts the execution of the Sentence
- The Court has requested to embargo three properties in Mazarron in the
name of Huma Mediterraneo
- The Court ha requested to embargo money which can be in the following
Spanish banks: Caja de Ahorros de Murcia; Caja de Ahorros del Mediterráneo;
Banco Popular Español S.A. and Banco de Valencia.
- The Court has requested to Huma Mediterraneo to give us other possible
properties, accounts or assets without charges which can be embargoes.

This sounds really good to me - anyone any thoughts?

Can anyone tell me approximately how long it should take to get a court date .  We had a court date in Nov  07 but cancelled it brcause Huma said that they were going to settle out of court which they didnt do. So we had to apply for another date .  The court my solicitor said we are applying to is Totana and we have been waiting since Nov 07 and have still not got any news. I cant even get him to answer my telephone calls or e-mails . Any information would be gratefully received we are getting very frustrated now.

Hi Nigela thats better than we got .We won the case about 5 wks ago. Our solicitor said the courts have given Huma so many weeks to pay up, but he douts they will . We then have to take them to court again to do the embargo thing. He said he will send us an invoice soon and we havent heard any more.so think we will be emailing to see whats happening.

Hi Nigela and all, we won our case over a year ago and Huma was ordered to pay us back, then when that didn't happen (surprise, surprise) the courts seized bank accounts before Christmas and more recently plots. Guess what? Still nothing. We join you all in saying we are sick to death of Huma and ACC. We have posted this before so apologies if you have read this already.

We have in the past contacted TV companies with no luck, and tonight we have e mailed five of the national newspapers to see if that gets us anywhere. WHY WHY WHY will no one help us? Someone has suggested we contact the Spanish government, but we have tried to find an address to send our complaint to but can't find anything. Has anyone heard any more about the petition we all signed? Is anyone taking any notice of us at all?

Any ideas on how we can all join together to fight would be very welcome. We will never give up.

WE were one of the lucky ones who received monies back and  charges  plus depositfrom Huma over 2 years ago!

If you write to the president office of the Andalucian Parliment  they may be able to advise eetc I just Googled it .

Just looked in to see what is happening. Haven't posted for a while because I can't find anything encouraging to say anymore. Apologies that you have heard all of this before but  ----- what a mess !!

 What I do still find interesting though is the vast difference in peoples experiences in this sorry mess we are all in. Some of us have been lucky enough to get a good result and a refund in a few weeks. Some of you have won your cases and yet still can't get any money back. 

Alfie, we have been waiting for a court date for two years now, we have a bank guarantee but the bank refuses to honour it. I can't believe it is 5 years since we went to ACC to buy our little place in the sun. Even when our date comes, we are not guaranteed to win , even if we win, we could still get no money.

Remember the petition many of us signed to governor of the bank of spain ?  here is what I can tell you about it.

The petition was delivered in Madrid on the 17th Feb, signed by 229 people. It was supported by Andrew Duff MEP. The governor, said that  ' he has no authority to enforce the law that regulates payments made during construction '.  What is the point of the spanish having any laws at all if no -one  can enforce them ? 

Many of us have written to our MEP's, but there are few replies, no-one is prepared to get involved. What on earth to we pay these people for ?

The legal system is a mess , with absolutely no consistency at all, in effect, they just please themsleves ! What is amazing though, people still go on inspection trips an buy properties off plan without knowing what can happen.

The agents should be taking some responsibility for their clients. They are all very quiet, having disappeared with huge commissions, never to be heard of again.

Well, anyone going out there on property inspection trips is either a complete and utter fool or has so much money they can just throw it away into the big black hole of planning irregularities, corruption, dishonest developers, agents that give false information and councils  that have no idea of which way to turn etc etc,....

Yes go on the trip have a great time  - just don't sign anything
