We have signed a rental contract for a property but don't move into it until April, we have the opportunity to move into another property straight away and wondered if we could cancel the first property or will we be liable for 12 months rent?  We have paid a deposit and the contract is for permanant residence for 12 months with the option to extend for 3 years but it doesn't say anything about ending the contract early.  Can anyone advise please?

A strange question or maybe just a stunt post.

What would be the point of having a contract if you could ignore it and everything in it was null and void? Wouldn’t it be nice Fred if you moved in, then came home to find your furniture and belongings in the street?

I dont see what is strange about the question.   We would be giving 6 weeks notice to end the contract if it was possible,  and we even have other people interested in taking it on.

The only way to find out for sure is to ask the agent/ owner you rented from. Explain the situation and that you have a new tenant for them and they may just charge the admin fees, you may lose your deposit. If you don't ask, you don't get. However, it is pain, so expect the unexpected.

A contract is a contract is a contract. Breaking any contract will involve a financial penalty. Usually penalty clauses should be written into the contract wording. If not the other party is in a weaker position.

I would really need to see the contract wording. If you have paid a deposit/ reservation, it is possibly just that what you would be losing but, as you have paid it before actually getting into the property, I really need to see what you agreed.

I take a rental for six months contract but for my purposes need to stay two months more, but the owner told you don't need to sign any contract for further. It's right or wrong for me.
