Can you withdraw from your community

Hi,

we have been in our community for 10 years.Every year we have issues over gardening, painting etc.Generally through the poor management of contractors by our President and management company.

Our question is can we withdraw from the community in whole or in part. E.g arrange our own gardening and painting etc.

It depends on the rules of the community but unless they are very unusual no you cannot opt out

if you want to research this further,  it is covered by the Horizontal property law

I don’t see any reason why you cannot paint your own property providing it is in the exact colour and at least meets the same standard as the Presidents contractors. The same would probably apply to you mowing your own lawn providing you carried it out at the same time of day the contractors do. You would of course have to incur the cost of the paint and lawnmower electricity yourself.

Hi thank you for that.I can paint and keep the garden tidy at my own cost but I will still have to pay my community fees🌞

Yes of course, that’s the arrangement you agreed to when joining a community. You have an equal say as to what goes on and who does what.

If you are dissatisfied and in the minority maybe it’s time to sell up and move on.

Or if you are dissatisfied, change your President and, or contractors.

No way you can opt out of any Community costs and fees.
