 I think this may be the end for a number of owners

how many times as it been said ML are the best thing ,well  now's the time to let them know what we think (and who pays them)

especially the presidents  who put them in  ,they carry on like this and they will be paying for a lot more  c/charges

may be NOW owner's can wake up the smell the pig shit.  

I heard they want to turn condado into a open jail but the government refused due to lack of facilities  lol

its the same all over Spain they are in the shit so they are shafting foreigners to pay for their corruption don't let it be you.

Having sat on a number of resident association`s in the past. I  know that they have quite a good clout here in the UK

However I wonder if, should an association be formed for Condado, if it is a realistic suggestion

If resident assoc`s are not recognised in Spain then all proposals would be ignored

 Residents Associations are very common in Spain, I have looked in to this a few years ago, it requires a lot of work and someone who can devote full time devotion to it.

Can be set up by 30 people and a set of constitition rules and aims.

I can point anyone with the time in the right directions.

Hi,

What a shambles, get rid of ML.  Would it not be possible to run Condado ourselves.  I am sure there are enough unemployed people we could pay to run Condado for us that live on Condado.  I would love to help set up our own community administrators.

Just an idea, and we would at least know who was running the place and they wouldn't be in the pockets of any bank or PW.

I suspect we are not hearing anything because ML have said the Presidents cannot contact the owners. Its my intention to contact ML rather than making rambling posts on here and elsewhere ( straying from my usual path I know) and making it clear that as an owner who pay's their wages I intend to speak to/contact anyone I choose, I hope other people will also feel that contacting ML to voice opinions is the right thing to do. I'm sure that the Spanish owners will also feel let down by these strange decisions.I'm aggrieved that the community websites may have had their day- they are very useful and I cannot see what the legal problem with them can be. Rather than filling the forums with grievances lets contact ML and let them know our feelings directly.

Can they make the two websites/forums close down? How would that work for EOS?

Is there some voting issue that would make it difficult to remove ML?

The Mazarron Country Club (just down the road from you) also run their own community.  They no longer employ 'self serving' administrators, etc, And are, with the hard work of a committee of approx. 30 owners, turning their urbanisation (approx 850 villas) around.  Their hard working president is a member of this site (username fighter2), and I am sure that he will be able to point you in the right direction if you contact him by PM.

It's obviously become a concern to the various Presidents that they shouldn't contact owners as we usually get lots of information feathering across the forums. Very little has been put forward and all of that is quite worrying.

I think ML have about 30 days before they issue the minutes and also they've suspended the contact via their website, to Presidents, whilst they get all the new information on line.

I'm now going to email them to ask about what happened at the AGM and whether the process was managed in the right way. I want to know if our proxy votes were recognised and if one President was voted in just because he said he had the majority of votes.

I hope other owners will feel they can join me in this sort of enquiry.

I agree with The Quiet Man , ML want the community to deal Directly  Through Them, so  if everyone e-mails their issues Directly To Them,   Ml  will hear loud and clear the feelings of our community,   at the same time they might realise the usefullness of our community website,   and eye on spain to vent our feelings instead of dealing Directly Through  Them  Im off  now to e-mail  Directly To Them!!!!!!!!!!!!!

The following is our undertsanding following the AGM which we stick with until 2pm. This may not coincide with everyone else who was there and I think Quietmans point about contacting ML direct is the way to go rather than making random 'we should kick ML out and do it ourselves' statements when managing a budget as huge as this requires professional expertise and orgainisation.

- totally agree with PGMs post

- owners (both spanish & british) were asking for clarification which was taken as a person attack by one very vocal and not particularly constructive Level 2 president. I belive he has been a president for 3 years so he must have some redeeming qualities but they were not evident

- no websites are being closed down but the plea was that the official website should be used as the reference point for information to ensure consistency of message.

- article 19 of the protocol was ambiguous in terms of level 3 presidents being able to contact their garden owners direct. The long and rambling discussions appeared to indicate that this was not a restriction on the level 3 presidents but again an attempt to coordinate a single point of outward information. Not sure if there was a translation issue with the paper work or moving goal posts. It is however clear that what ever the case the information was not given to the level 3 presidents in sufficient time for them to review prior to the AGM and form a view - that for me is a key issue

- voting was very hap hazard and needed to be more structured. Even with the translator it was not clear what was happening. We went to vote for Gill (NG4) and didn't get the chance to raise a hand!

- any increase in budget requires a 100% agreement from all owners. This was the killer for the telecoms vote. More importantly a point made by Terry is that it is all very well to keep triming the budget but with a 100% consus required to increase it the community could be driving itself into the ground as the banks will not agree to any increases. Some residents (british & spanish)  also appear to feel that same way. The arguement regarding economies of scale e.g. to secure internet etc for all against individuals taking out contracts does not seem to be understood.

- as there is no telecoms network owner identified for the community at the moment it is not possible for companies to formally submit quotes for the provision of internet yet anyway so the quoted increase appears to be a moot point at this time

- unless a more pragmatic view / process can be introdcued in terms of budget increases we are stuck with what we have. There is alsobonly so much lean that can be negotiated out of any service contract which opens the question of how will an increase to budget for basic maintenance be managed. Back to Terrys point again that there is a very short sighted & negative view at the moment

- a bus service is scheduled to start twice a week from Condado. Tuesdsay to Alhama to coincide with the market (I'm assuming there is a bus back too!) and another route to be confirmed

- negotiations are in hand for a chemist in Al Kasar which will be useful for the rather aggravated Level 2 president to collect his blood pressure meds

Again this is just our understanding based on what we saw / heard on the day and meant to be useful in summary. The official site is obviously going to be the best option as it will have all minutes etc.

Re the minutes.  Section 19 of the HPA (see my previous post) states:

3. The president and the secretary shall sign the minutes at the end of the meeting or within the following ten days. Once the minutes are signed, the resolutions shall be in force, unless otherwise provided by law.
 

 

The HPA is a very powerful law, and is there for your protection.

Can someone clarify what the official site ML want us to look at is? I look at a couple for news and updates on CdA but am not sure if they are the "official" one.

I also agree that we should contact ML with our views rather than going to the extreme of trying to administer the place ourselves.  Running a resort cannot be an easy thing and would require a great deal of time by resident owners who probably have other things to do.  Plus until this fiasco I thought ML were doing fine.

I fully agree with the point raised re the budgets.  I have no problem with budgets being trimmed and best deals sought...but we shouldn't reduce community fees each time this happens.  Otherwise we'll get the situation where prices rise but we can't increase the fees as Mr Smith in Apt 12045 won't vote for it.

It was posted that CdA may fund a sports centre for public use on the council owned land for 250k.  Forgetting that this seems an absurd use of our funds (unless it generates money), how could this be funded without an increase in our fees while the telecoms option required an increase in the fees.  I'd guess the difference between options B and D wasn't €250k.

Best scenario would be if the presidents could sit down and discuss the problems (without coming to blows) so we could move forward as a resort.  Not necessarily agreeing on everything but at least knowing things are being done in a fair way for all.

To clarify I am referring to article 19 of the 'Protocol of basic action of the administrators' that was provided at the AGM which refers to there being only one official e-mail address for presidents & vice presidents not section 19 of the HPA.

Apologies if I have caused any confusion.....

Hi

From my calculation the budget for 2011 appears to be £250k above what was spent in 2010.

Is this coincidence?

Also the budget I assume cannot be increased by this amount unless everyone agrees?

I also agree if the costs reduce leave the budget the same (and I mean reducing costs at the same level of service, not reducing the scope as well as we found out with the pergola painting). Lets get more for our money.

1)  Clarification. The special privileges within the website (only into the website) have been temporarily suspended until we renew the information from the last AGM.
These privileges allow the President to establish within the website, documents, links, polls, etc.

2)   

I regret the misunderstanding.

I am responsible for maintaining the website and following the AGM meeting was necessary to update the data of the presidents in the web. So we have 'suspended' in the web the access to special tools for them.
