We would like to recommend this team of lawyers to anyone out there who is considering taking builders or banks to court for breech of contract. We had high hopes of having a holiday home in BIgastro, not far from Torrevieja. In 2006 we  paid a cash deposit and later a second cash sum into LA Caixa bank. As the 2008 crash took place we discovered our site and communal pool had been abandoned by the builders . Today 10 years later that site has gone to complete wreck. We were distraught at the impact upon us financially. Having read about Maria and her team on Eye on Spain website I decided to use them to help us go after our large financial loss. The builders declared bankruptcy so Maria and the team took the bank to court. This all started in 2010. Costaluz handled everything with upmost profession and although everything is very slow in Spain with vast holdups in court , eventually we got the news just at Christmas 2016 that we had won the case and we're getting our two cheque amounts back plus ten years interest to be paid by the bank. Despite a long procedure and a lesson in patience we are delighted with the outcome and would recommend anyone in a similar position to check this company out. They did not disappoint and I was most impressed with the detailed breakdown of costing right at the end. Please do consider this team. We were unsure at the start but on reflection it is one of the best decisions we made. Adrienne Rea

Yes Adrienne, Maria and Costaluz have done an immense amount on this forum to educate and answer so many questions relating to litigation in Spain. Their courage to tackle the Banks behaviour in the early days when so many thought that ther monies and lifetime of savings were unrecoverable, and wherever applicable, have endeavoured to make the Banks more accountable in this whole sorry saga of events in Spain, should never go unrecognised.

So little would have been accomplished without their commitment and legal challenges that were born from the early litigation procedures, when Supreme Court rulings were unavailable to act as clarification against the Banks continuing and incessant attempts to deter claimants and deny their legal responsibilities (immoral behaviour in my eyes!), and their resilience to make the Banks more accountable and gain the necessary rulings to assist and benefit others in the longer term , has been quite extraordinary.

Their support and specialised knowledge with regard to Ley 57/68 (and now other aspects relating to Bank accountability) that has developed over many years, initiated by Keith Rule, whose remakable determination and patience and knowledge, (through first hand experience), has been invaluable to many caught up in the frustratingly lengthy litigation processes, but wherever possible with good and honest intent to answer the many questions relating to the complex procedures, is a testament to their hard work and commitment, under exceptionally trying circumstances (many of which have been sadly beyond their control). Nevertheless their dedication has been beyond question.

Maria has been a "little brick", with her educative and transparent legal tips, acting as precedence to demonstrate, wherever possible, that help and support for forum members is available, and that for those who seek specialised knowledge and meet the relevant criteria (essential to determine, in this litigation process), that justice to retrieve monies is possible, hopefully acts as reassurance for others to use their legal team and strive for justice, where applicable.

We should never take for granted their commitment and resolve in this battle against the Banks, to bring greater accountability, nor under-estimate their courage to tackle sensitive issues relating to past negligence and lack of due diligence...

It goes without saying that there is still much to achieve in this regard, but I for one wish to thank them sincerely in this educative process, to tolerate my continuing questions ;) and occasional forewarnings, but equally I hope and trust that others will comprehend their significant ongoing role in this whole process to try and improve transparency and gain justice in what has sometimes proved an uphill battle. They deserve endorsement and acknowledgement of their specialised knowledge.

What's that saying " Without research there is no progress, and with no progress there is no learning ".

Thank you Maria, Keith and all the Costaluz team for being there and thank you for all your ongoing endeavours.

Thanks so much Adrienne and Irvine and of course thank you Ads.

Hope to have health for keeping my efforts to bring Law to people in a simple, friendly and uncomplicated way as in the past. It has been a real privilege and no doubt a second Law Degree.

The spirit of people like you, who have persistently fought for their rights, asking for explanations, demanding a better Justice, inspires me, no doubt. We, Law professionals, lawyers specially, are here to bring Law to people, being able to show the the commun-sense based and beautiful simplicity which is behind the sometimes-laberynthic world of rules and norms. 

Law is a conquer of all, of centuries of civilisation, we all ( professionals and citizens) need to make it shine the more we can,  despite the obstacles and tiredness.

That's wonderful news. But what's the holdup, it's now April? Let us know when the cheques clear.

Dear Maria and Adrienne,

Thanks for the input, because you mentioned your financial hardship over the time, and Costaluz good work it's positive and a good outcome.  

But the timescale from Christmas to now for a cheque to come through does seem a long time, don't you think?  

So it's important information to us not only to know that a case is won, but that the case has a positive result for your financial hardship.   Perhaps you could let us know if the money has been returned yet, and if not perhaps how long this will take (and even why the delay?).  

That would be great.

Thanks for all who show interest in our story and for those who still think we haven't received our cheques, we did!!! Thanks to Maria's team we got a bank transfer in January 2017 for the full amount . There was no hanging around once the money was back into court hands . Many many thanks Maria . We can finally get on with our lives . Adrienne

Hi Adrienne55,

Congratulations and what a brilliant result having won your case in December 2016, you then received your full amount  plus 10 years interest, in January 2017, I am amazed that it can happen so quickly.

Like you, we are also with Costaluz, and our case was in March 2017, which we won and we have been told it will take 6 to 9 months for us to receive any payment.??????

Mind you I've been trying to recoup this money since I first paid it to the developer in 2004, approx 13 years ????

Every delay has a reason an we are happy to explain, as always. In occasionssions, we can influence the speed of processes but in many other ones we just cannot.

@Adrienne. Great news - sorry if I appeared cynical. It's my default mode when people have only made one or two posts as they are usually selling something. It was your saying on March 28 "we're getting our two cheques amounts back", which I took to mean hadn't yet happened.

"We're getting a holiday flight to Benidorm"

"Hope you enjoy it"

"We did, we got back in January".
