Hi where is evryone hiding?

.We had an email from Miquel. He is still waiting for the courts to get their ass in gear to tell Huma to pay up .But the courts are so busy we have to wait our turn. We have asked him to look into why the bank didnt issue a BG when they received the money from us, surley they need to give some sort of reciept to say they have got it, because of money laundering .If i had 35k put in my bank wouldn't  they ask where it came.Thought it might be time to take another route anythings worth a try. Any one else going down this route it would be good to no how it went or how it's going.

That's a good point.

Although we don't know if the con-artists put the money in the bank.

We also had an email from Miguel that was very similar to yours.

I really can't see an end but I can't afford to give up, its far too much money that someone has been allowed to get away with.

.We paid the money straight into Huma's bank account  and we have a receipt from Huma but nothing from the bank .I dont' no how it works.

Hi All

We asked our solicitor about the possibility of suing the banks for failing to supply our BG's, as we believe that all involved have failed in their duty of care. We also are led to believe that they have also broken Spanish bank law 57/68 for failing to provide BG's. She did not mention it in her reply to our first e mail, so we sent another asking the same question on 4th Feb and still have not received a reply. Its a bugger that we have paid a lot of money to the solicitors and yet they choose to ignore us. To give her the benefit of doubt in case she is on holiday, we will give her till next week to respond, then we will send another e mail. Trouble is we daren't antagonise her too much as we will just go to the bottom of the pile if we do that.

Has anyone else heard that if a court order is not resolved in 5 years, you have to start from scratch and take them to court again? We were told this recently but can't seem to find out if it is correct. If it is we are in even more trouble as Huma will just hold out until the 5 years is up. We are already 2 years on from winning the case and we know some of you are even further on than that.

Hi.

 We have done the same thing, asked Miquel how the banks can get away with having our money with no BG,. but  have had no reply .We will ask again and let you no .I no what you mean about putting pressure on it's scary and almost don't want to p...ss him off , we are paying for the  service so should be able to get some answers,after all it's his job and if we don't ask or keep on we would just sit here quietly and wait until it's to late.

Indeed, you have paid your solicitor for the service, and they have quickly taken your money and offered the service. The problem is that our cases are long, drawn out with no quick fixes because of the Spanish sytems.This means 'hard work' and constant battling for the lawyers.

This makes our cases for refunds complex and drawn out for solicitors. In turn, this uses up the money you paid them.Then they slow down because they feel work v pay not enough !

Our experience is that the lawyer will come back for more money from you having not got anywhere further forward for the first payment.

This is partly the reason they don't want to take on banks and the such like.

No BG's is and has been a massive issue now in Spain. Whether it's the developers responsibilitiy or the banks I've no idea.It's all a shambles.

Hi We have also got nowhere, and used 2 soanish solicitors, once they have had our money they dont want to fight anymore.

I feel its best to go through the no win no fee road, the carrot and stick approach may work, if i can get enough people interested we should go in a group, im happy to give 25% of any return i can get its better than nothing what do you think

I'm with you gizmo if such a thing in Spain exists. It seems solicitors are little better than everyone else in Spain, take your money for little return!!!

Hi Dallan  We heard from Miquel a couple of weeks ago.We are still waiting from the courts to get involved yet again.He says the courts are very  very busy and he hopes he will hear very soon !!!!! Thats  basicaly it.

This morning on GMTV there was a programe on spanish property being demolished due to being illegaly built.We have emailed the MEP that is dealing with this and asked him for help.Hopefuly we will get a reply I will keep you posted.

Hi Trudge, who was the MEP?? I've mailed loads of them and usually get the same reply "yes we know its a problem and cant do anything about it!" Stil, I think its worth badgering them!! The more people who make it an issue, the better especially if they know we wont go away!!

I totally agree, we need to keep on to them all, as we are sick to death of being ignored. Maybe we need to organise something as a group and meet up somewhere to take some form of action.

I e mailed an investigator from the Daily Mirror a few weeks ago and was very surprised and pleased to get a reply asking for more details and addresses etc. However, I am not surprised that I have heard nothing since and despite e mailing him twice now asking if he is able to help us, ie an answer either way just so we know, I have heard nothing. What is it that stops them from supporting us? There must be a reason for it, as I am sure that out of all the people I have contacted, one of them must have been willing to help us, so why do we never hear anything further from anyone?????

No wonder we are getting paranoid about possible conspiracies!!!!!

Hi Lin,

Just agree with all you say.  I still am so amazed that the courts will just not do anything. Why?  The solicitors take our money and start the ball rolling but it just comes to a standstill in the courts. Why?   If things are illegal, which they are on several issues how can these companies just get away with things.  It just seems that no-one in any position will take things to the final step!

Hi all, My husband wrote to an mp who was on  GMTV. He is fighting for people in spain who are having their homes bulldozed  and spoke about what has been going on with illgal builds. We emailed him for help and his reply was that he's not a lawyer and cant get our money back .My husbands reply was no but the least you can do is to fight for us and put a bit of preasure on the Spanish rather then letting them get away with what they want and our hard earned money.We are waiting for a reply.His email address is

Sorry for delay in replying.

Dont bother coming onto this site much now.

Well HUMA dont bother going onto their sites.....

We are waiting for the Courts. We have an asset, its been re-registered at the Town Hall, now its back in Court to proceed to auction.

Dont know why but the Court is busy with a lot of listed cases !!!

Had a quick look at the other forums.

Cant believe people are still being sucked in and buying a property paying massively over the odds.

They are buying trouble.....

Just had an e-mail from Miguel, here is an extract.

'     Thank you for your recent e-mail. I was about to write to you because we have finally received the papers from the Court confirming that the sentence is definitive and that Huma has not presented any appeals. The Court has confirmed that Huma has to give you (and the rest of clients) all the money back, plus legal interest and legal fees. We will be pleased to send you a copy of the sentence if you wish to have it for your records. 
 
     As I informed you in the past, we are sure that Huma will not pay this amount voluntarily, which means that we would have to initiate another legal case to request from the Court the enforcement of the sentence and the seizure of Huma´s assets. We want to be very clear with the fact that we cannot guarantee the success of this action (because it will depend on Huma´s solvency basically) and the timescales involved (because it will depend on several factors out of our control). We do not want to be pesimistic and in fact we are ready to keep on going until the end, but you need to be aware that it might not be possible to recover the funds.'

 

We are wondering what to do next, any advice??

Hi we have had the same email and really don't know what to think  were very confused. One minute i'm holding my breath through excitment,then when it sinks in not so good. What more can we say ,do we just sit back and hope they pay up ,or do we have to pay more money to take it further and still get no where.I suppose these are the next questions to ask. .How long can they stall this and get away with it .Still none the wiser,but can't afford to give up and won't.

Reading Miguels email sounds like he is not extremely hopeful, having said that, I dont think you guys can let it go!! I reckon you have to proceed with the legal case anmd I really hope you are successful!!! It may be that you are throwing good money after bad but what else can you do?? Kiss goodbye to everything!!!

Why not ask the solicitor about issuing a statutory demand for payment promptly followed by a winding up petition? that would bring things out of the woodwork!!
