Suing banks for not giving a BG

Has anyone looked at Maria's thread about taking legal action against the bank for not providing a BG.  What is everyones thoughts on this?

I hope its correct. It may be a way out for a lot of people who developer has gone bust.

So long as I get my money back I dont care who gets sued, Developers, Agents, Banks or the crooked lawyers

Incidently, Maria is working for me against Huma, so who knows???

Dare say we will find out in a few months time.

Thing is, it's how long it takes for the courts to actually have your case put in front of them........then after an appeal, they'll see it again minimum 6 months later.......and so on.

Sorry to sound negative, but if you play by the rules in Spain, you stand a good chance of losing.  Better to go higher up the food chain and take it the the EU.

Any sugestions of how you do that, what solicitor to use and what piece of EU law you would be using to win the case?

No recommendations for a Spanish lawyer, I'm afraid - in my experience, they're all pretty useless (although I've only used ones in Murcia and Andalucia, perhaps ones in Barcelona and Madrid are of a higher standard)  although I do think they are limited by what they can do to some extent, due to the Spanish legal/court system - however many of them seem to use that as an excuse to sit on their a** month after month, without even bothering to update you by email, even if there's nothing to tell.

If it were me, I would lobby my MEP and try to contact as many people who are in the same or similar boat as myself - there are quite a few lobbyist groups, try an internet search to see what comes up - Spanish property scandal petition is run by a very energetic woman by the name of Suzanne, I believe.

You probably won't get your money back sooner, but at least you will be doing something constructive, and forcing the EU to actually start hitting Spain where it hurts - their pockets.

I wish everyone the best of luck with this - I would also suggest that some (no one on this particular thread) come to their senses and realise that Huma is not interested in doing what is morally right, i.e. giving back the money that they have effectively stolen.

I have allready contacted my MEP - to be honest unless someone has some success along this route I think it is a waste of time - my MEP complained tried to do something but came back with the answer that you have to go through the spanish court system.
