Subletting in Spain

Hi, does anyone have experience with subletting rooms in Barcelona? I am thinking of renting out a whole property then renting out the rooms to people moving to the city for work and to study (not tourists). Also i do not want to live in the property.

Is it a property you own when you say rentinmg out a whole property, or are you meaning you want to RENT a property and then let out rooms in it?

You have to look at your lease, not just ask if someone in cyber land thinks its OK

Spain is much like the UK when it comes to what you want to do and of course you can do this..... Right up to the point of when you get caught.

You want to rent a property, rent out individual rooms, and not live there? 

That sounds like a legal nightmare. Tenants have rights, and non residentandlirds have few rights. It is illegal to rent out a property shirt term without a registration number which must be on the advertisement. 

Your landlord, whose property you intend to rent out is quite likely to find out what you have done very quickly, the neighbours will tell them. So unless it is specifically in your contract that you will not be living there but intending to rent out each room you will find yourself in legal difficulties and the support will all be on your landlords side.

This income would be taxable, so you will need a tax registration certificate. It is the tax people you would most need to worry about, they can seize property and possessions and freeze bank accounts.

Seriously, your proposal sound a bit dodgy to me.

Baz, it’s almost like someone who is already a member is using a one shot post to put something on that an existing poster may make a little mistake on with advice.

Then that supposed 'expert' can have a go and get some oneupmanship going.   That’s what it seems like sometimes and this particular question is as stupid as I have seen on here!

It's not so stupid a question if it's done legally. ie: with written permissions both from the property owner and the local authority. It's done quite often in the UK with student lets where the lessor takes all the hassle away from the property owner in return for the lease costs. Often landlords are absent living elsewhere and for them it's an attractive option. I know of a number of people who have this arrangement.

An additional incentive is properties let as student accommodation are usually exempt for UK council tax. However conversion costs and fire certifications are also required.

Barcelona is a university city. Perhaps the OP has this option in mind.

It requires a local lawyer to write up the paper work, contracts and obtain permits. Therefore some considerable advanced capital costs involved.

What your describing there Micky is a rental agent with a specialist let business.  I notice John has a quick

link to a law site, curious.  

My initil response to the postee was as below and still fits.
