NEW! Banks condemned to repay on illegal mortgages

Maria is anything being done to make provision for a mandatory system of Notarial checks (independent of conveyancing lawyers due diligence) to prevent Banks from being allowed to issue mortgages at point of transference on properties without correct licences and planning in place? If not prevented at point of transference doesn't this run the risk of legal action being required "after the event" and exacerbating a justice system that is already overstretched , already witnessing Banks challenging case law at every opportunity?
