What an entertaining read. And everyone is right!

Yes, it's a brilliant idea, it is a wasted asset. It is a way to claw funds back from a builder.

Yes of course it's illegal and morally wrong. And of course the 'law' would act swiftly on this whilst for some reason it is incapable of bringing all the other 'usual suspects' in Spain to book.

Yes it's time the average joe fought back.

Now here’s a plan that might suit everyone………. How about ‘Assisted Squatting’? Old Woodbug here stayed up till almost 10 O’clock last night considering this option over his Horlicks and digestive biscuit.
 
This is how it works, A firm appears called Help the Homeless or something equally clever and the subject apartments are furnished by the existing tenants and possibly the incoming squatant (A squatant is a cross between a squatter and a tenant Norman), and NO tenancy agreements exist.
 
The  squatant makes an unsolicited charitable donation every month to a bank account in the Isle of Man for on-going protection from the ‘gang’ who obviously have a social conscience and will assist the squatant to remain and enjoy quiet occupation of the alloted premises.
 
No paper trail – the Pres and his current tenants at worse have only turned a Nelson on the incoming squatant and for the squatant, there is only a civil matter to face up to if push comes to shove Foxy, so your good services would not be called upon.
 
This is of course only an embryo scheme that we, the contributors to EOS could roll out nationwide – no globally, can anyone help to tweak the finer points of this clearly brilliant scheme?

The accurate factual comment on the "police" reaction did indeed refer to the uk .
 
OK ,so guys, like a lot of his comments, it has no relevance in this forum, which as we know is about Spain.

The president holding keys to unsold property is quite common, obviously with the builder or banks agreement.

Dear Foxilady,

the law/statute referred to is recent, according to the professional planner defending.

It came to his attention in 2001 so now has some case history.

in the particular case I am involved in refers to a 45 acre field fenced and bunded plus ditching in attempts to keep out dog owners from surrounding urban sprawl

this is entirely british or even english but sounds somewhat similar to Spain's land grab tatics.

One of the biggest problems with spain.............. Norman.......... is the English. Normally fellow nationals help each other out. Eg. the pakistanis in England. The chinese in England. The Ialians in America and The irish in America, Australia and throughout the world. Yet here in Spain I hear on the street (and read on this forum) so many English peope complainig about getting ripped off on the coast, buyin properties through estate agents that end up being repossesed because they were built on illegal land or worse. When all the time the biggest culprits are the English themselves.So Norman take a look at your own nation before you start to critisize others.

 Just to further clarify. The english are the estate agents who sell these properties to other English. The English own close to the majority of the shops and bars that rip the other English off in. etc, etc ,etc

Thanks dbd for reminding us of that almost extinct breed of Brit – the Estate Agent. Gone are the balmy days when every Brit (and his dog) were Estate Agents, Easy-Jet Builders or Pool Experts. Fortunately most have disappeared into the ether and only the decent professionals (in the main) have survived. Who can remember seeing the same house with 5 different ‘Estate Agents’ at 5 different prices and now they are gone, the fun of trying to find the original lowest price has disappeared.
 
How the local Corredor spluttered with laughter over his lunchtime pint watching Brits fight each other for the privilege of paying through the nose, eyes and ears for that once-in-a-lifetime bargain at only 300k when he had details of dozens such ‘deals’ at a fraction of the price in his office. His office was normally his top pocket and his brochure was a scrap of paper.
 
Oh, how we miss the caring Estate Agent who knew a chap who could, for an exiguous premium, secure you a 100% mortgage, no questions asked. All you needed was a pulse and a passport and he did the rest. Wage slips and P60’s- no problem, he knew another man who would for a modest fee, generate ‘duplicates’ of lost documents, only for tax purposes though, you understand.
 
Now all we have left is 1,060,000 websites, each of which are exclusively authorized by the Banks to dispose of the repossessions, distressed and court auction properties even though the banks all have their own web property discount sites.
 
A closing thought………….. if you buy a ‘repo’ house in a ‘dreamy Spanish’ village that is populated in the main by the Sanchez families, and the house had belonged to Jose-Maria and Carmelita Sanchez, who lost it due to unemployment, and further, you purchase at a silly price, leaving the dispossessed couple still owing a fortune on your new house, how welcome do you think you would be Mr. & Mrs. Ladron?

New Spanish Royal Decree 9 th March 2012
 
Code of Good Practice for Mortgages
 
You may notice in the press, or hopefully in your Bank, that a new Royal Decree has been passed in Spain on the 9th March (Ley 6/2012). This basically is a Code of good practice to do with mortgages which gives special benefits with the Notaries and Land Registries for the Spanish Banks who choose to adopt the code. It is to help mortgage holders in serious difficulties. The Banks do not have to follow the Code but are encouraged to do so.
 
Although a positive step in the right direction, it does seem to us that the guidelines are only going to help a limited number of people in this area, given the restrictions that they contain.
 
We note on reading the new decree that they encourage the Banks to help those in serious circumstances struggling with payment of their mortgage, by measures such as extending the period of loans up to 40 years and by reducing the interest rate for four years. They also can possibly give a rebate on the debt and accept a final payment in repayment of the debt. Customers can ask if they may be eligible for the benefits.
However, the Royal Decree states that the people entitled to these beneficial measures must meet certain conditions, firstly for areas with less than 100,000 inhabitants on the Padron such as the Orihuela Costa, the house must not have cost more than 120,000€ at the time of purchase (not what it´s worth now).
 
Also that everyone in the family unit must not have any work or income other than unemployment benefit in Spain, that the mortgage payment must be more than 60% of the unemployment benefit and they should be registered with both the Spanish unemployment authorities and Spanish tax authorities.
 
We are sad to say that we think this is only going to help a very limited number of people.
 
With the conditions they have imposed it is obvious that it won´t help Non-Residents, but it is a start and perhaps we will see in the future the measures extended to help a wider number of people. Let´s hope so…

So tell your friend to send a reply that says.....

I have reported this to the town hall and local police. They are in the process of producing a denunciation which will result in a large a fine. The fine will be split 50/50 between you and the town hall funds.
