Make sure you get Palmera Properties in court. Summon their accounts, they will fall like a pack of cards. They have land assets. The 2 conmen - the Lying Dutchman not the Flying Dutchman and his little hobbit partner Ratardo not Gotardo - need to taste prison food. Ratardo has a real passion for expensive motor cars - as has his wife and other family members - pity they have all been bought with other people's money. They are desperate for money

Have you all read the Palmera website lately ,where they are trying to get us all to be their best mates and fight with them against their dodgy builders.Facts are, most of your money never gets to the builder it is stolen and spent by Palmera as soon as you hand it over .Even on the few ocasions when it is split with the builder Palmera still retain a whopping 50% commission or more.I have documented proof of this split/breakdown ,but dont worry its all gone in as evidence to the CDSAG and supporting lawyers.

Never be fooled by the crooks who run Palmera Properties. They used YOUR money to finance their lifestyles and have done for years. The firm is bust - trading whilst insolvent- get these shits (Sier S and Gotardo R) in court.

in court on october 1st,reply from our our lawyer case  to be decided on october 1st 2008,don,t think we are just fighting palmera and mirador but the whole spanish legal system. i have also just seen a websitewww.reginasoverseasproperty.co.uk advertising a2bed.2 bath apartment on the la perla site with photographs of site.what with palmera trying to change sides i just don,t know what to make of it all,hope the action group is having more success than all the lawyers seem to be having at the moment,just got to battle on and see what happens in the next few weeks and months

They are getting in serious problems currently and more than one will probably finish in jail. The most important problem now is not the the Spanish Legal System, which is slow, but the buyers who still believe that Grupo Mirador or Palmera are going to pay them without necessity to go to Court, it does mean that Palmera and Grupo Mirador gain time and the investers get tired to go to Court and try to recover their money.

It is correct that the Spainsh Court Process is slow but at the end it works, some buyers were advise for their lawyers to take legal action as soon as possible and they have won their cases, they are in the process to put "embargos" over the properies of Grupo Mirador and Palmera Properties, this lawyers has won to Palmera they will probably get the money of their clients very soon. If anyone believe that can get and agreement with Palmera or Grupo Mirador does not know this companies, they never do anything if they are not force to do so.

There are some lawyers that have beaten to Palmera Properties and Grupo Mirador months ago.

Excellent news if true. The lying Dutchman and Ratardo will NEVER NEVER NEVER pay any of the money they owe to 00's of people.
Force them into court
They own land worth several millions of Euros - bought with your money.
This land MUST be sold to pay the money they owe you.
Get their accounts into the public domain and fraud charges will result. They have absolutely zero accounting procedures. It is full of holes.
Their internal finance director is Ratatdo's uncle and he is completely incompetent

You are right, they never pay if they are not force to do it. Our lawyer got a sentence that obligued to pay to Palmera our deposit, our costs and the interest of the money. They have apealed (we have been said they always do it) but now we have a sentence in our favour we can ask for "ejecución provisional", it means ask to the judge to sell the goods of Palmera and retain that amounts of any bank account they have.

Yes, please be confident in the spanish judicial system, it is not fast ( as balbotas says) but it does work of course. Act bravely and ask for preventive seizure of goods, then wait patiently but do not lose your hopes and your confidence in the system.

Have been reading this thread with interest as we are purchasing through Palmera and about to complete - hopefully very shortly.  We have been using solicitors recommended by Palmera and now discover that we are expected to pay additional costs for legal fees - although we were assured that these were included in the Agency Fees we had to pay originally.  Also it now transpires that other people purchasing on the same site didnt have to pay Agency Fees.

Has anyone else come across this - we have sent documents to them but all they and the solicitors seem to say is the fees are not included.  If we have to pay then I would consider using alternative solicitors but am worried now about the timescale as this means more Power of Attorney etc. etc. -  

I have been told that Palmera read this thread so if you are reading it - you probably know who I am and that your office I dealt with has now been closed so what's the point of telling me to contact the office I dealt with originally.

I would value any comments or advice anyone can give me.

But have i read that right? You as a purchaser had to pay Agency fees? I know that we didn't and was just wondering how that works. Is it different over in Spain as I'm sure I had heard somewhere before that both the vendor and purchaser were paying an agent. Double whammy, crikey!!!

Its great to see people are finally getting to court and winning! It is true Palmera will appeal against everything, as they hope it will buy them more time to avoid paying back the money they stole.Hey Rob, I hope our lawyers now will go straight to court proceedings and stop waiting and hoping they will simply write us all cheques by Christmas.

Palmera charge around 4,650 euros full agency fees for which you get their corrupt appointed lawyer who only acts for them and their dodgy developers,and to cover admin costs! around 20 euros for the one :Do as we tell you letter: that they may send.The rest of the 4,000 goes [you guessed it]as a little extra bonus to their bent directors.Sometimes they will offer you half price fees or or even waiver them, to reel you into thinking you are making some great saving, and they will be content just to steal your deposit instead.Now they are asking you for more money!!! welcome to their world... Get your own lawyer to avoid anymore of their scams . Ask the majority of us on this thread....we have all been there.

No, most agents do not charge agency fees. Someitmes if an owner has a price that he wants for his property, then the commission is added on top in the total selling price, but Palmera will have been getting theirs from the developer anyway - at a higher percentage than a resale, Im sure!

Anyway, you are better off getting your own lawyer and you can do a power of attorney from the uk. Its a bot time consuming but in the long run you will be safer.

Hi Rixxy l know they should not charge agency fees but they have been doing this for years and getting away with it just part of there totally corrupt set up and practices,another one is selling the same apartment ( the one with the best views etc) to about fifty people then when they have sighned up (or should l say 18months after) they say due to a change in plans there are less apartments so they offer alternatives.Maria has seen some of there contracts and they are clever in wot they dont say.they have already done a runner from there Alicante office and taken some the apartments off there  web site  they were selling in that area, if you e-mail there benalmadena office to get some one to show these apartments,they promise to get someone up there to show you round but they will not pick you up at the airport, they say they will meet you at the apartments but dont show up.Also if you tell them the dates you will be in Spain (3 months in advance) they will deliberately send you an e-mail right in the middle of those dates nowing full well you wont see it until you are safely back in england. (happened 3 times ) there after service does not excist after you have paid a deposit. they do absolutely nothing for there money.to busy selling people properties they know have not got building licences or bank guranteesor on illegal plots etc so the sooner they are put out of buisiness and all there assets stripped the better for future buyers and spains reputation.( l  could go on for ever about the things they have done)Regards Pat.
