Gutardo Rodrieguez ,director of Palmera Properties was arrested and detained on 14th May for the fraud charges of selling illegal properties in Costa del Sol and Costa Blanca to name but a few, he has currently been released on bail pending charge
looks like we might be getting somewhere hopefully

We are now being offered property at a reduced price to offset our losses.So we need to pay more money for a property we do not want, somewhere we do not want to be.with very little chance of selling it on.I see this as a disaster not a result

my sentiments exactly, Can you believe he is pretending to offer solution, when it is just another blatent attempt to extort more money ,dump off these garbage properties, and further line his pockets to add to his hidden wealth and assets .

I am in Benalmadena at the moment. We have been to see a number of properties. They appear to be ones that have been on the market a while, or are unfinished. There was only one that appeared to be an option for us, but when I viewed some in the same complex using a different agent, he told me that even after the supposed discount, the offer was way above current market prices. He showed us other options that would have been cheaper to buy than our so called "special deal", that were very close in specification, if not better.

Come Fultond, you cant expect a special offer to actually be less than the asking price!.

I mean this is upstanding Palmera here.

I know a client who was charged for furniture in a fully furnished apartment.

My understanding is the Spanish Government is building a new jail to house the mayors and developers alike

I think as I get older I get more trusting and naive!

The ironic thing about this whole situation is that apart from getting Palmera Properties (Gotardo) off the hook, this is creating a whole new market from which they can earn commisssion. So after being ripped off for our deposits, we now happily go ahead and give them a second wad of commission! Until I see some real discount against current market prices this is not for me. I want to see Gotardo rot in a cell for a little longer.

If you look at the reality of the situation, there is no money forthcoming, so you just have to write off your cash. Just don't let him off the hook easily, keep your actions going.

Perhaps you have different options to the rest of us. Although I have to admit, I am extremely cynical about any proposed solution. Please don't be too vague.

I know where you are coming from, it's just that we were out there anyway, but we are back home now. I figured if there were any "special offers" then best to look sooner rather than later. Clearly they could not satisfy the whole defrauded community. But as you succinctly put it, there are no special offers at all, not that I really believed there ever was. Back to an unpallatable, but actual, scenario of having nothing for our money. But as you indicate, no point in throwing good money after bad!

we arrange a new property with the same deposit you gave it for a house never built for whatever reason,( no building license,promoters using the deposit in another promotions ..)  for  an equivalent price and placed in the same area. We are an independent law firm for 30 years and of course we are full qualified at the Málaga´s Law College and don´t work for Palmeras Properties or any other  promotor. We are helping many people,whom bought in Mirador Del rosario,Mollina Hills,mirador de la perla... that didn´t get their houses and now they being replace to another house they chosed between diferent promotions,  already built,full final licensed from the town hall and prepared jus,t to sign the deed and have the key .

I agree with Penthouse. You should not offer your solution as a resolution to our issue. This is the same resolution being offered by Palmera Properties, which is also completely false. All you are doing is scouring the market place for the available properties, and then discounting their asking price by the amount we deposited. This does not equate to current market values, and I would guess the sellers will be very happy and you will take your commission. This does not relate to the prices we agreed to 5, 6 or more years ago. Please do not try to deceive us.

The point here is not we want any other property other than the property i foolishly handed over to Palmera 52,000 EUROS for over 4 years ago, no property money back please yes, dont waste our time with these property solutions unless you can come up with one for my 52,000 then i may look but dont think i will part with another euro
i may have been to trusting in humans then , i aint now

I have read all your comments over the last couple of weeks.

Yesterday I received a recorded delivery message from Gotardo, as many others have by the way, apologising for the trouble that has been caused by his negligence. I will be passing the letter to my Lawyer for their comments because despite his assurances about trying to give me back what I've paid him, we all know he hasn't got any money.

I am not going for any of the properties that have been offered either. I want the cash back. No banks are giving mortgages there anymore, so any deal would mean you would take over the developers mortgage (in theory) but it would be very difficult to get an actual offer. I've been through some mortgage applications recently and it really is a complete nightmare now. The banks in spain just don't want to lend any money now, it's as simple as that, as they've had to many repossessions.

Glad to see people are still continueing the fight. I personally will never let this go ,and will have my justice.Why is everyone so quick to believe Rodriguez has no money!!!!! because he told the lawyers so? Has done the obvious thing in clearing out the PP bank account , no surprises there . Its so transparrent he has major assets and is still trying to do scam deals . Discounted properties my A***.Will there not be a trail of where he has stashed the cash!
and whats this latest ,apology letters people have been getting, does he choose random people to write to or call sporadically in an attempt to say ... hey look im a good guy trying to make ammends, its an attempt to get a lighter sentence when his day in court comes .....Sorry ..yeah ,  he is only sorry he got caught.

            i totally agree with everything you have said,we have been trying to get our money back through lawyers for 4 years or more after having  deposits on la perla for over seven years ,we are due to make our case in malaga crown court on october 1st and we just hope we get our money back with inter,est after all the grief they have given us this last seven years.i know a lot of  people are in similar situation to ourselves,like raganp has said they have a lot of money in assets to meet our cases  and should face the concequences,im due to retire in 2 years so there i not a cat in hells chance i will give up
