I would be interested in hearing views on how this community can move forward after the AGM. This community is divided and will continue to be so until some people take a step back, take a look at themselves and realise the damage that they are causing to other home owners and the community as a whole.

Having won the vote to cease action against illegal builds this should surely mean a cessation of intimidation and inappropriate behaviour towards those who had voted for action.  As "Silent Majority" stated in a previous thread we took it on the chin and it still feels like we're taking it.

When the last poster on the previous thread starts bandying around phrases like imported bigots they should be sure of their facts.  To my knowledge the Spanish gentleman has not been intimidated and is subject to Spanish law like the rest of us.  An illegal build is an illegal build.

Again on the previous thread a poster states that its "OK" to party to 5, 6 or 7 in the morning.  If you are elderly or have a young family would you be happy with an all night party? As a mixed age community people must, whether they are on their annual 2 week holiday or not, respect their neighbours right to a nights sleep. This attitude shows a total lack of consideration for others and should not have to be tolerated.

 Was it not those who instigated action against their neighbours,  who should be taking  'a step back and looking at themselves' for wasn't it this group who caused all the unrest ? wasn't it these people who, whilst quite willing to use community resources to further their aims, have never once committed themselves using their own personal finances ?

Were not the majority of owners,  just wholeheartedly supporting their fellow neighbours to help them claim a just and democratic result ?

You are quite right Ravenhill, we should be all looking towards repairing any damage done... but one would assume from your post that, Yes, you lost the vote, yet still accuse the wrong party of intimidation !

 

Wake up and smell the coffee !!

 Ravenhill posting drivel on this forum or any forum is not going to solve anything on our community. You say there is a campaign of intimidation and in inappropriate behavior towards those who voted for action.

First it was  a secret vote so how does anyone know who voted for what.

Second talk of taking it on the chin is nonsense no one has to take anything on the chin it was a democratic vote, common sense won the day and nobody needs to feel like they are taking it.

Third The Spanish couple who are now doing an underbuild. What proof have you got that they have not got permmision to carry out this work. How would you like it if a foriegner in the UK told you what you can and cannot do. All the properties on R3 that have had work done on them look a lot better than the ones that have not. People have spent a lot of money on there properties knocking windows out,  putting french windows in, extending there patios etc makes the place look a lot better.

Fourth Partying till the small hours of the morning is totaly unacceptable as Secret Majority quite rightly states.

You say there is a divide in the community and people need to take a step back. You are quite right. The people who need to take a step back are the the people who waged a campaign behind the previous presidents back to oust him from office and caused upset to all the people who had done the so called illegal builds.

I suggest  you reveal yourself Ravenhill and then we can all sort this out like grown up adults . Posting on a forum is going to solve nothing.

For those of us who were here and attended the ' Community Party' on R2 last night, can I say a big thank you to Bill, Hillary and Joan etc., for their hospitality to some of us, off R3.

It was nice to meet you all and we had a great evening albeit I'm sure we all ate and drank too much !!

Hi folk, Martin and I have just learnt that our contract exchange from Jumilia to Playa Golf III has finally been heard in Court and rubber stamped on the 1st Sept and that SJ are now forced to release the Jazmin to us immediately.  At last some relief for us.  Im sure you all know of the nightmare we have experienced (without Bank Guarantees from Herrada) in thinking we had lost all our Deposit.

Martin and I came out last May and re-chose a property.  We met some lovely folk living very close by but have lost their numbers!  We came out on holiday and stayed on Villa Martin a few weeks ago and went round to see Brian (Dave and Joan were out) on Playa III (immediately behind us.   Unbeknown to us, our case was in Court whilst we were there, and we simply drove round to show family what we 'technically' owned!

All being well, we should be having the keys in a month or so.  Would anyone recommend a furniture package or good local furniture shops (collect the same day!), alarm companies, shutters etc. ?  We know of Insiderite and Murcia Furniture but that's about it.  Or is it better to shop around???  Never thought this day would come

Any advise would be much appreciated.

Congratulations Sally & Martin - you must be so relieved!  Playa Golf is a great place to live and we are always delighted when new owners arrive.

As far as furniture packages are concerned, I paid a fortune for a package and wish now that I had chosen individually.  If you are able to spend some time getting just what you want, I think you will be much happier in the long run.  I have spent a lot of money changing things, now that I live here permanently. 

You will find that the big supermarkets like Carrefour do really good prices on white goods, lighting shops will come and fit everything for you and there is a huge Ikea in Murcia if you like their style. There are some big furniture shops in Torrevieja and San Javier so you will have lots of choice.  Some of the second hand shops are also very good - people sell new goods from furniture packs that are not to their taste.  Some of the curtain shops will even fit the curtain poles for you for a small charge.  There are lots of sales on just now so you should be able to pickup bargains.

When I bought my house on PGII there was a deal with Securitas where you got the first 9 months (I think) at a reduced rate so it would be worth having that connected - it is already pre-installed so doesn't take much time to do.  You will have shutters already and there are a quite a few grills companies around for you to choose from - get a few quotes before you decide and have a look at other properties to decide what you want - I personally don't like the concertina style and prefer the gate style.

Are you going to be living here permanently or is it to be a holiday home?

You will find most of us are very friendly and are happy to offer advice, support and even a glass of cava, so do keep in touch.

Hi Claire, lovely of you to reply!  We are so looking forward to getting ourselves organised.. Ive already been on the Ikea site and written a list..  Good sound advise and we thank you.  I guess when we get the keys we could always camp for a day or two! 

Im just waiting now for our Lawyer to organise the small mortgage and we should be prety quick after that.  I cant even remember if they've put sockets on the walls as it was last May (two days before the Administration process began) that they swapped Contracts for us from Jumillia to Playa.. what a relief now, we could have lost 96000 euros!  Hey ho life moves on.

 

It will be a holiday home as I still have a wedding gown business in the UK with my daughter and Martin has a busy job that we rely heavily on.

 

So... see you soon I hope!

Agree with Claire regarding the furniture packs....maybe purchasing individual items may be a little time consuming but the end result will be well worth the effort...

Yes ! There will be sockets on the walls, in fact everything other than light fittings. If you find you are short of anything until you get organised, I'm sure your neighbours will be willing to help...If It's the loan of tools etc., then I might have the ones you want.. 

Incidently   I mentioned to David they got a mention on the site as we played boules today..

It is fantastic to hear that you have completed a transfer successfullyyyyyyyyyy We had just the last payment outstanding on a property in Playa Golf III and went over to exchange  may2008 the week San Jose went belly up!!! now we have been offered an alternative site in Palya Golf III.... Our solicitor has just advised us that they will want another 4% although we paid them  the 4% on our original house already!!! Was this the case when you changed!!!

What a great name... and demented is how we are feeling today!  I asked our Lawyer the  other day what the likely time scale would be now all the documents are in for the small mortgage we will need.  To our utter dismay the Laywer has said that they are now in 'negotiation' with San Jose with the price on the Contract.  Turns out that our Plot 35 has a mortgage of approx 115,000 on it by SJ.  We have almost 98,000 in deposits with them and negotiated a transfer price the same week as you last May. of 148,600.  Now they say they cant complete unless we want to pay the 200,000 plus (ie our deposit plus their mortage!) for a little Marbella (Jazmin).  Technically they would owe the us the 50K euro difference, which of course they cant afford to do.  It's absolutely disgusting and we feel like back to square one.  They have sent a list of two other properties (2 x Tullipans and 1 x White Lily) all at the highest possible prices.  I can only hope that our Lawyer negotiates hard for us.  The Court document ordering them to complete on our Contract (the day before bell-up) looks to be pretty worthless right now.

We'll just have to keep at it and be patient by the looks.  With nowhere else to turn what do we all do but wait this out and keep paying out good money?

What's your next step??

Complete cowboys I am disgusted for you reading your mail... You take two steps forward and ten back. Hang in there your solicitor might be able to pull something out of the bag. We have been told that the house they are offering us is debt free were ye told that too? Or do we take that with a grain of salt!!!!

I think a salt bank would be accurate.  Last July our Plot was listed as emcumbrant free... strangely now there appears a 115K mortgage on it.  We have no choice but to put our faith in the Legal Eagles we've employed (and he did come highly recommended).  Im not knocking him so much as simply being cross that he rang  excited for me after the case was heard and won only to have the hopes dashed a week later.  I even bought a scanner (very technical for me!) to make sure he got all the documents quickly.  Basically I have emailed my disappointment and frustration and asked them to ONLY send me properties that they CAN complete on ...not just a tiny list that means nothing.  Ive asked for a site plan of Playa III and sensible options.

There is another couple who I met via the Forum who are now being pressurised to complete on a White Lily (also obtained via my Lawyer).. they have just had a baby and are delaying because of the huge mortgage it would now entail.  I'll find out what 'mortgage' there property has as they would like to pull out.

Ps If I flick between 'I' and 'we', its because we only married in May and this 'project' was my great idea of an investment.  We have to keep fighting demented.. the amount to loose is everything I worked for.. you cant make up 98K at 50 easily again. I just feel so guilty for my kids and an uncle that joined me in the adventure.

Hi Sal - I'm so sorry that things have gone sour again, after you thinking it was all sorted.

As I just posted to Demented on the main thread, a Nota Simple shows if there is a mortgage on a property and your lawyer should always get this for you, at the beginning and at the last minute in case someone raises a mortgage between the initial reservation and the sale - as seems to have happened in your case.

I don't know if San Jose have any other properties without mortgages on PG - CAM bank repossessed the SJ stock on my bit - PGII R1 & R2 - at the start of the year - so I don't think they have any stock at this end of the development.  They are still selling on PG but as long as they sell for higher than the mortgage they can do this legally - hence the high prices.  As I understand it, the issue for you is that you only owe them a small amount because of the money you have already paid them, so your final payment won't allow them to pay off the mortgage and they would appear to have no other funds to clear this debt.

I would press them again to tell you if there are any further properties without mortgages, as this seems to be your only option at the moment.

Thank you Claire.  Ive taken a day off from my shop to try and get some answers.  Ive emailed my Lawyer saying the exact same thing and want a reply today.  They just seem to still be able to dictate despite having acted so illegally in the first place. 

What is your position now?

Hi Sal - hope you get the answers you need. 

My own position is that I bought through an investment company (Smart Investor Services) and was thoroughly ripped off!  My property was finished when I bought it so I avoided all the problems you have had with off-plan but I was promised high capital growth, 30-40 weeks rental, etc, etc, which was all lies.  I thought I had checked my facts before I went ahead but I didn't realise that all the spanish statistics I read were so out of date and the fall in the market was well under way. 

When I came out here to live I became an estate agent (I was in Social Services before) and through my work, and Eye on Spain, I now realise how many people have been tricked into paying high prices, buying illegal builds, etc etc.  The spanish system is so different to the UK and the lack of accountability is something I still struggle with but there are some good agents out there and there are some really nice houses.  I personally love my Azucena (White Lily) and I love living at Playa Golf so I count myself very lucky. 

I am still learning about the system but I am always happy to try and help where I can.  Being an estate agent is hard here at the moment and sales are difficult to achieve.  I do think, however, that the market is improving and there is always room for someone who will be honest with clients and not try to trick them at every turn.

Hi each, Martin and I are about to complete on Plot 35, R3 and have just seen this article posted on the internet.  Can anyone shed any more light on the situation with the Administrators/San Jose re the maintenance and upkeep on Playa III?  We popped over in December and the pool etc looked in order and clean, have things changed since early December.  Claire T knows us well and did all the wonderful ground work for us which helped so much we cant thank her enough, but have just had one or two flutters before we part with any more hard earned cash.  We are victims of the Jumillia scam San Jose pulled and have absolutely no faith in them whatsoever after 5 years of lies, but this is our final opportunity of safeguarding our deposit onto bricks and mortar (albeit at a ludicrously inflated price - which we came to terms with to get this over with!).  Obviously we've asked our Lawyers at this 11 1/2 hour to ensure that the property comes free of any charges and we have every intention of being good contributors to the community of Playa as we have met one or two lovely lovely people already residents/purchasers.  We are really looking forward to our little holiday home in the sun... but obviously worry after all they have done to us and cost us.

 

Any info would be much appreciated.

Hi Sally and Martin,

There have been many problems associated with the demise of San Jose. Lots of people have moved onto Playa golf that were destined to purchase in Jumillia and from those that I know, all are happy with the area. I am sure that if you go ahead with the PG3 R2 purchase you will be able to contribute greatly to the community and make the community stronger.  But if you have reservations then try to get an ex-San Jose property on either R3 or R4 as there are still properties available on both of these urbanizations and the possible bonus for you would be that the community is up and running and established. In Spain always make sure that there are no outstanding bills for that property as under Spanish law it’s the property that retains any debts and not the previous owner. So make sure San Jose didn’t take out a mortgage on your proposed property and also come to some arrangements regarding any outstanding community fees, talk to the president. Good luck with your purchase.
