Hi,
To any other people who are waiting to complete on their apartments in Vegamar 1. My wife and I are still waiting to complete.
We are aware of having to wait until all works have been completed before the Town Hall will issue the Habitation Certificates.
What we don`t know is how many other buyers are in the same situation as ourselves, and what their respective legal council has informed them to do. We bought through Atlas and to be perfectly honest they are about as good as a chocolate fireguard.
Our property is in Escalera 5, Bajo 2.
We would welcome any info or response from other buyers.

We are in the same situation as yourselves, our apartment is in Esc 6 Bajo 3 and we were meant to complete in Jan of this year - but frustratingly are still waiting.

Like yourselves we also bought through Atlas and they have given us no info or help and we feel we are in complete limbo

I have the feeling there are quite a few of us in this nightmare senario unfortunately

Hi, Bob and Jan,
We are also waiting,  we are in Esc 5 and are with Amba Sun, I have heard nothing from Amba Sun at all. It is very frustrating, we could be waiting a long  time. PSI are the solicitors and they have been trying to get in touch with ideraco with no luck. The fax number they had, is  now disconnected. The last I heard was the solicitor was going in person to Alicante to see if idearco's office was still open.

Dear All,
I have been waiting since December o7, when I came over to sign and was told no more signings until the end of January.   The latest information I have came after some pressure on PSI.  They checked the office in Alicante which was closed and then visited the court in Alicante where they discovered that a creditor of Idearco applied for a claim against Idearco for unpaid bills, this meant that until the judge decides whether to put Idearco into administration or the spanish equivilent no property exchanges can go forward.  This took place in March 2008.   I think that the lawyers are having a lean time and that is why they bothered to go to the court, they must have suspected there was a legal problem.   My understanding is that this could go on for months or even years.  PSI told me that if the judge decides for Idearco the signings can go ahead, if not there is no compensation for us.  The preferred creditors are the government, social security payments etc, utilities and then other creditors.  We can put in a request for preferred creditors but this has to be done very quickly, within a month and as we are not in the country it may take longer than that to find out.  I have instructed PSI to let me know immediately this happens but it is Spain and with August coming up, long holidays etc we need to keep an eye on the internet sites and press. It would be useful to know how many apartments are sold but not signed for, the administrator must have this information but does not reply to e mails.  Working as a group makes the most sense.

Hello All,
I totally agree, Safia, You also made a good point in a previous e-mail to me,   I think it would be useful for all the other waiting owners should get together and agree as a group that because of the delay, lack of furniture etc we should be able to re negotiate a lower price.   Presumably the bank creditors would rather sell at a reduced price rather than have people walk away.  Acting as a group using a good solicitor we might just be able to pull it off.  
Bob and Jan, Michael and Caroline what solicitor did you use? and were they recommeded by Atlas?
What is your thoughts on the next course of action? Would you be willing to hire an independent solictor if we can find out how many potential owners are still to complete?
I will e-mail the Carol the president of Vegemar to see if she can find out this information.

Hi all,

Sorry for not replying sooner, but I have been up to my eyes in work. Jan and I have a Spanish Independant Lawyer, as we did not want one that Atlas had, reference conflict of interest. Our lawyer is David Ivars, his office is in Benissa north of Alicante. I must admit I have not been in contact with him since early May. I think it would be an idea to find out the total of people who have paid their 75% towards their property but are yet to sign. I presume that you have all looked at your contracts that you signed and have seen that it is with PROALTO. My lawyer checked them out around April this year and there was no problems financially with them only a charge by a Bank, which was perceived to be quite normal in business. I will be in contact with our lawyer via email to see if he can find anything else out. It would be interesting to find out who the creditor is who has put a claim against Idearco. It may be Iberdrola ( Electricity Company ) as I believe from emails from the President of Vegamar, that there still is an amount outstanding from the builder to them. I think if we can get a body behind us like the media/ press, the Coast Rider news, The Round the Town News and get them to run an article. The owners at Vegamar did this earlier this year and the publicity forced Idearco to agree to finish off the development, although it is still taking time. The administrator Juan Carlos Ballester can do nothing officially for us as we are not owners, however I agree he or Carol must have details of the apartments that are not signed for. I must say I am suprised that more people have not come forward on this issue.
Hopefully we can start a collective push and force things forward.

Hi All,

This is a dire situation, we to are waiting to complete on our apartment in escalera 5, not sure we will see our apartments because the builders seem to be paying off his debts by selling buildings and car parking spaces not sure if any of these are our apartments. Its very difficult to know what steps to take. Carol & the committee at vegamar are doing the best they can for the apartment owners but understandably cant help us as we are not owners.

Hi, Just to let you know I have had no word from Carol the president in relation to our question,  "how many apartments sold but not yet completed" I appricate she is busy.
Is there any other vegamar committee members who could answer this question?

We now have some good news for you at last, anyone waiting to complete on their apartment please contact our administrator, juan carlos ballesteer immediatly, the builder has said he will complete on apartments this month only.

Thanks for the news Carol, I realise how busy you have been and am very sorry about all the unnecessary stress you have been put under by the builder, the spanish owners and their representative. I am amazed at the cheek of the builder who has kept owners waiting for over a year and then suddenly decides that he will complete only during the coming month. I wonder if you know whether the habitation certificates have been issued for all the apartments in the development as I have been advised not to complete until these are available and my experience of this developer means that I have no intention of completing until my lawyer has possession of this certificate and the building insurance guarantee and they have been checked. To any other owner concerned I would add that the price included furniture and white goods which I doubt will be forthcoming from this particular developer now, we have been put under considerable stress because of the behaviour of this builder who has broken his contract with us to deliver our apartments in a reasonable time, he has not made any effort to keep up informed about his business and financial situation, indeed it has only been pressure from purchasers on lawyers that we have had any information at all. It is a buyers market in Spain as in the U.K and I for one will be making strenuous efforts to substantially reduce the balance on my apartment and would advise you to do the same. I am prepared to walk away from the deal if necessary, the rise in the euro will offset some of my loses but I am prepared to take a financial lose rather than close this particular deal at the price and time this builder demands. I would be interested to know why he is only willing to sign this month, it all sounds very suspect to me. I would be interested to hear other take on the situation. Regards, Safia

i quite understand your feelings, and it is for you to decide personally how to proceed, obviously only each prospective owner knows whether they can afford to lose the amount they have already put down on thier apartments.

we are in a better position with the certificates, the water certificates we have from the plumber now, they just have to go to industria for stamping, we expect our paperwork to go to the townhall in december for our habitacion certificates.  we hope to be in possesion of certificates needed for the electricity in decemeber as well, so progress is being made.

we have been working with the view to encourage the builder to release these appartments, and after a meeting with him and utility suppliers, juan was able to report that he would sign them over this month.

look forward to meeting with you in the future, if not good luck with your future purchase.

Hi Sofia,

I noticed in your last post the comments regarding the furniture and white goods package that comes with each of the apartments. While I was out in August/September 08 a large delivery of furniture and white goods packages turned up, and were unloaded and taken into various apartments (I am sorry I cannot say which ones).  I was surprised to see this after the builder apparently doing a bunk at the time. I can only assume that some of the empty apartments do now have the furniture in, but those living on sites might no more.

Hi all-straight to the point if any one wants their monies back from Idearco please contact craidokraus lawyers-the moments gone for me&my family-so i want my 1st payment of 40k back,under euro law this company are committing criminal offences-4 years this coming summer me and my family have been patiently waiting-but no more.So lets get this toerag and really make idearco BUST. jeffro escalera 1

just to say, i understand the builder is still awaiting a reply from the bank to see if he can complete on the outstanding properties.

re builder, no one can seem to contact him except the adminsistrator on occasions- re administrator, he is contactable on the email address previously given. currently though he is away until next monday.
