Hope you don't mind me butting in to your conversation.

Speaking as an architect who works in both UK and France with develpoment experience in both  but who has also had personal experiance of buying property in Spain off plan.

Whereas I wouldn't suggest that things are perfect in the two former countries, Spain is far worse firstly becasue their domestic development  is normally funded by the purchaser (through off plan purchase) and secondly because their banks are far less honest, their local authorities far more corrupt, and their legal system less transparent.

I think it important that the public understand this otherwise in 10-15 years we will witness a second generation of British people who will get caught out in Spain in the same way. Spain and much of southern Europe (and I suspect eastern Europe) is quite different - it would be more helpful to think of these countries as third world and invest accordingly.

Now (sadly) in hindsight I couldn't agree with you more Chris.

The only way to enforce the government into facing up to these uncomfortable truths is for all those who say they are in support of those abused by the Spanish system to step forward to the mark and be proactive for change. Write to their MEP's, keep the message firm that corruption and playing political games with people's lives will not be tolerated in an EU country that relies so heavily on good relations with their neighbours.

I dread to think how many have achieved justice in the form of first instance legal judgements only to find that they are stuck in a chaotic system that, to date, gives little value to ensuring that return of monies is followed through. The court delays and apparent unwillingness to apply justice in a timely manner (so as not to compromise purchasers further) are at the heart of the offplan fiasco, and until these issues are addressed there should be steps taken to ensure an adequate compensation fund is established through re-direction of EU monies originally intended for Spain.

And that is not taking into account the Urbansiation and Ley de La Costa Laws that have, and continue to decimate peoples' lives.

As you say Chris, so long as these unjust practices are allowed to continue then Spain can only be described as third world and potential investors should seriously take note.

Dear Sir/Madam,
 
We recently wrote to you regarding support for a parliamentary resolution (Marta Andreasen will seek a vote in the forthcoming parliamentary session) and we have received some replies relating to two Spanish laws that are having a significant effect on property ownership in Spain, namely the Urbanisation Law and Ley de la Costa.
 
However we feel there is another grave matter regarding court delays within the Spanish justice administration system that is having far reaching implications for thousands of off plan purchasers that we wish to bring to your attention. Many purchasers caught up in this scenario are finding that even though they have won a first instance judgement for breach of contract by the developer that they are being legally compromised, as in the interim, enforcement orders are being significantly delayed by the Spanish authorities (for instance in our specific case there was a delay of 13 months between petitioning an enforcement order for return of monies as per the first instance judgement and it being issued). The consequence of which is that the developer uses the delay to their advantage and transfers monies/asset strips making it impossible for the judgement to be enforced. Thereafter some developers are declaring insolvency which further compromises the purchaser as they are not recognised as preferential creditors. Thousands of innocent EU nationals appear to be affected by this injustice relating to court delays and developer abuse due to no fault of their own, so we ask that you also bring this matter to the attention of the petitions committee as a matter of urgency. We trust and hope that pressure will be brought to bear on the Spanish authorities via a parliamentary resolution to block funds to Spain and that we and others in a similar situation will be fairly compensated.
 
The court delays and apparent unwillingness to apply justice as per successful court judgement rulings in a timely manner has now become the heart of the offplan scenario and requires urgent intervention by MEP's to apply pressure on the relevant Spanish government and judicial offices.

I hope this might be of some use and urge as many as possible to enforce the message that court delays are significantly compromising return of deposited monies for clients (off-plan purchase) who have achieved successful first instance court judgements.
 
Only by highlighting these instances will we ever gain the attention and hopefully support of MEP's so PLEASE write and document your concerns.....
