Renting out a property

Hi, We own a townhouse in a small community on the Costa del Sol which we use for holiday purposes. The community is mainly full time residential.

We have now decided to rent it out on a short term basis over the summer months for additional income.

We mainly rent out to families with children, but occasionally there are groups of people. We always ask our guests to respect the neighbours.

However, some of the other residents are not happy about us renting the house as there are new guests constantly and obviously they use the pool etc.

Can the community prevent me from renting my house out?

I'd be grateful if anyone can help.

No the community cannot stop you from renting.

Thank you Jayce and Maria.

It puts our mind at ease as one of the other residents told us that the community also has rights and can demand us to stop renting.

They were obviously trying to frighten us to stop.

They can't legally stop you, providing the community rules don't prohibit short term rentals. However, you should talk to your neighbours and discuss their concerns. You don't want to end up on bad terms when you are there. It's in everyone's best interests that you clear up any problems - you don't want other residents to end up making the holiday unpleasant for your tenants either.
