Hi there, does anyone know if an English woman needs to be either legally separated or divorced before she is allowed to get a Spanish mortgage? I've come all this way and now the bank is asking to see either my divorce papers or legal separation papers, I have neither.  Linda

Dear Linda:

You do not need to be separated or divorced. to get a mortgage in Spain. 

If you are married, the Bank needs to now on your financial marriage regime. As you know, Spanish Nationals cen be maried under a community economic regime who will make the two spouses liable of personal debts.

Not the case for UK nationals under you specifically form that community.

Hi Maria

I was just wondering if you could through some light on the following question.

If someone was to purchase a property in spain and they pay the appropriate fees to the solicitor to do so, and should this property be cancelled (not finished, developer agree to refund etc..) would/should the fees origionally paid to the solicitor for the purchase (which did not happen) cover or include any costs for you to get your refund of deposit back??.
