Our house in Spain has a buyer. We had to return to UK suddenly due to Covid before POA could be organised. The deposit has been paid and initial contract signed. We have initial date for the end of May for completion with proviso that, if due to Covid, this date can be changed. Situation looked positive. Then at the beginning of April I was diagnosed with breast cancer, had a mastectomy, now will have six months chemo. I cannot travel to Spain. The house is in joint names. What can we do?

A sad situation. Perhaps a bit of a long shot but have you thought of asking the advice of your lawyer?

Power of Attorney would suffice in your absence. Very sad to hear about your breast cancer. pray all goes well.

I do believe Tanna may be correct. You can organise POA from the UK. You can nominate anyone you like ‘’Spanish lawyer, UK Solicitor, Friend or Relative’’ however if your Spanish lawyer with or without POA can’t be bothered to reply to your enquiries maybe it’s time for a change, but remember you are dealing with an industry where many have a chip on their shoulder and want to do as they like, your purpose in life is having the privilege of paying the bill, slightly less so in the UK where regulation is taken more seriously.

You can find details re notaries for POA in UK here

Maria de Castro or Keith Rule at Costaluz who frequently advise on EOS, would no doubt advise if this is still a valid method to gain POA from the UK and if this is recognised in Spain....

You can make  a POA (poder) in UK for  use in Spain.

Along the same lines, I did that and made some sworn statements before a notary in Spain for use the Phillipines
