Hi all

Thanks Justin for the info regarding Irwin Mitchell.

I have lodged my interest in attending their proposed meeting for next Wednesday 21st May 2008, in Birmingham, and completed the necessary form.

In my opinion, Irwin Mitchell are a much respected company, and my daughter worked for them a few years ago, in their Birmingham office, where she was training to be a Legal Executive.

Her partner, who is also a qualified Solicitor, has strongly recommended that I attend that meeting, before I make a decision on who to go with, in the group action. In his opinion, a group action, (dependent on numbers), means that the costs could be spread between that group, therefore, not being as expensive as just a few, or even individually taking action.

I am, in no way, trying to sway anyones opinion here, but, merely suggest you all look at the options open to us, before you commit to anyone. This is going to cost us all, which ever way you look at it, and there are no guarantees that we will get all, if any, of our deposits back.

Anyone also attending the meeting in Birmingham ? Please PM me.

Hi Justin,   thanks for explaining that for me,  i think i would like to be a little patient and see what happens next.  Obviously dont want to miss the boat and loose the money, but i would rather have my property.  Wouldnt be a problem to join an action group a little later  would it?

Malc, you are wise not to rush into anything.  Everyone needs to really consider ALL options before deciding what is personally best for themselves.

Abolex, great idea to hold a meeting next week for those in the area.  I hope many people can attend.

For anyone down my end of the coast then we always recommend that you chat with Maria de Castro.  She is based in Algeciras.

Hopefully there will be enough interest for the meeting in the UK to go ahead too.

Remember that at this stage you do not have to commit to anything.  Please just take your time and consider all options and carry out your own due diligence regarding any lawyer that you may choose to represent you.

I think that at the end of next week we list each possible option and determine the pros and cons for each to help everyone make a decision, if they haven't already.

Sorry,  but who has called a meeting in Birmingham and why?

Is this meeting for people who did not use a solicitor nor got a bank guarantee or for people who have a solicitor who's only interest is looking after the estate agents by whom they recommended. After all there affected as well by having to pay back there commission hence more closing down rather quickly!!

Could I please have details of this meeting time date place ect .

The meeting for this week is being coordinated by Jose Maria de Lorenzo.  He is based in their Marbella office.

I spoke to him yesterday and a lot of the feedback he's had is that Wednesday is generally not a good day.  It seems people would prefer to have a meeting held at the weekend.

He is going to send me final details hopefully later today so I'll post them here as soon as I know.

Now, let me stress that going to the meeting is NOT committing you to anyting at all.  It is an opportunity to ask questions as a group and to understand your options.  Whether you are using your own lawyer, another lawyer or no lawyer at all, then I would urge people to still attend the meeting.  This is a very confusing and worrying time and I hope by bringing as many people together in one room you can all find some comfort in supporting eachother.

If you want to be kept informed about the meeting please use the form below, even if you are unsure at this stage whether you can attend.

Birmingham meeting interest form

I understand that Abolex is planning to hold a meeting on Friday in Jumilla.  If you want me to run a central database for people interested in this meeting then please let me know and I'll get it set up.

Also, if there are people based around Costa del Sol / Costa de la Luz area that would like to attend an informative meeting then perhaps we can run on with Maria de Castro is there is a need.

This is exactly what Eye on Spain is all about and why it was started nearly 4 years ago.  Bringing like-minded people together.  Whether it's online or offline we try our best to make it happen. 

And finally, just to make it clear, we have NO financial interest in any lawyers present on this site.  We will always use our contacts and friends to help where we can.  That's what we're here for.

Excellent Justin,

You have been a superstar and without eye on spain who knows when we would have found out anything about this situation.

I have registered with irwin Mitchell even though we do have a solicitor already in marbella, all the help we can get is great especially if it's FREE......i can't attend the meeting though so if any one does go can they pm me with the jist of things.

A bit disappointed that the meeting with Irwin Mitchell has been changed from Wednesday 21st to Sunday 25th May, as we are flying out to Majorca for a week, with our daughter, her partner and our grandaughter.

Could I trouble someone/ a few of you that are attending to PM me with details of what was said/suggested ?

We are returning from holiday on the 1st June 2008, and would be grateful for any updates.

Thanks once again Justin for the info, and support.

One thing I would like to ask, and I don't think it's been covered yet is,

" How is it that some people have Bank Gaurantees and the rest of us haven't ?"

It was my understanding that BG's couldn't be given until the building licenses were in place ?

Would someone be kind enough to explain.........maybe someone who has a BG for SADM ?

Good luck everyone...........I think we're in for a bumpy ride !

To be perfectly honest we got one with ease, our agent was sunseeker homes and they advised us about the guarantee and gave us details of a very reputable lawyer in marbella at competative rates.

before we handed any money over we had a bank guarantee in place, we paid nothing for this, then  monies were exchanged for the deposits, i too am a bit confused as to why guarantees were not given especially seeing as it is a legal requirement.

We are actually in the process of getting our monies back, our solicitor actually told us he had our guarantee in his safe with our contract and that there should be no problems, if san jose refuse, the insurance company behind the guarantee will pay us our money back..apparantly!  We will wait and see, but the reason we are pulling out is not through panic it's purely because we have lost too much money waiting for this development to be finished, so we are looking elsewhere, not necessarily offplan.

Thats very interesting Janine and is just the imformation I have been looking for. My solicitor informed me that a BG could not be issued until the bank had my money and it usually takes a couple of weeks, eighteen months later still no BG. I will now need to consider legal action against my solicitor, could you possibly PM me with details of yours?

Thanks for that..........but, I still don't understand why / how you were able to do that and the rest of us were told we would be getting ours, but, as we all know, they never came ?

Somewhere on one of the forum topics, someone stated that the banks would'nt / could'nt give a Bank Guarantee until all the building licenses were in place.........or am I wrong about this. Perhaps Abolex Lawyers could shed some light on this.

Are our agents Ambasun International S.L then negligent for not advising us to part with any money until a BG was given ?

They also introduced us to PSI Laywers in Spain, but, we were advised to use independent Lawyers and not one recommended by the agents, and needless to say did not use them !

I and BrainDo are flying out n wednesday and meeting up with San Jose Thursday morning. If you give us the time and location of the meeting in Jumilla on Friday we may be able to attend. Our flight back is late afternoon.

I received an email from Holaspain, who have always been totally honest with me and know senior people at San Jose. I have copied parts of the email for you all to see, the bit missing is regarding my personal stuff

“The department that sent the e.mail was one of the calls I made this morning and the situation was explained to me in a more thorough way. Basically, the money for deposits is still safe, the licences have been granted for both Jumilla and El Pinet, it is the banks (because of the current situation of the Spanish banks) that will not give the money to pay Jumilla town hall for the licences and San Jose will not use the deposit money to pay this. Once the banks release the money building will continue straight away.”……” There is much more we need to talk about but I believe the anarchy being caused at the moment is causing people too much concern, we will talk when you’re here,
I hope this is of help to you all. It is so important not to panic, yes make plans just in case but do not get sucked in to spending money on solicitors and legal costs unless it is absolutely necessary. For now we just need to prepare whilst we await an outcome and be ready to respond if needed.

Hi All, Leading on from what TonyMal has just posted, San Jose are still operating their business. A few weeks ago I ordered an extra t.v. point, Pilar e-mailed the documentation which was duly signed and returned to her.Then all hell broke out with San Jose going into administration. However today I received an e-mail from Pilar thanking me for the documentation and she had added it to my file! Make of this what you will, would be interested in what others think of this turn of events? Cheers Joanniemac

Hi all,
San Jose has not stopped trading and should not do so for now, as it has gone into administration. The company operations will continue under control of the new managers appointed by Court.
Bankruptcy may come or not, depending on how the company is dealt with in the next months.
In any case, those with credits or rights to claim (unfinished sites, missing bank guarantees, etc) should submit their credits and sue the company to get deposits back, as experience tells us that the longer it takes, the less the chances are to recover deposits.
We will be having an informative meeting on Friday in Alicante area, 12 am. Place to be confirmed tomorrow on this thread.
Anyone coming, please send me a p.m. and remember to bring your documents to the meeting (copies will do).

Hi TonyMal. 
   my useranme is brianmags not briando. any way as tony has said we are out there on thursday and will report back when we come home.  As far as mags and myself are concerned they have been OK so far but just might be protecting as some have said but untill i see them eye to eye and make my judgement about their trust worthyness then.
                 But we will report eother way I do believe that we should not panic  na dcause a run on the company
