Yes, I prefer "Guidelines" to "Rules". They sound much more helpful and less dictator-like. Something to fall back on in the event of a recurring problem.

Community rules are normally written by the developer and are often contained within the escritura for the property, which you purchase. When we all proceed to completion the community rules will already be set. Any changes have to be approved by a majority vote at an AGM. The rules are for the benefit of the community as a whole and cover the legalities within the community. You may treat them as guidelines but they will be rules and you may find in a few years time that you are grateful of those rules if some owners choose to flout the rules to the detriment of all. . In my line of business in the UK I come into contact with Lessees on a daily basis, they share with me their complaints about those who flout the rules. 
 
I do not want to appear an authoritarian, but we all have a lot of money invested in this venture. A well-run community will be a pleasure for all and we must bare that in mind. For me, I am hoping it will be an oasis away from the pressure of business life in the UK, where we can relax and rest. It is pets that has brought the subject up in this instance, but it could easily have been drunken all night parties, loud music, occupancy of large numbers and (sorry Suzanne) people using the pool and making a noise late into the night. What we all have to remember is that it only take one to spoilt it for the majority!

Totally agree Tracey. As I said I live in a development of apartments all governed by a lease. It is absolutely essential to have that lease just in case. For example our lease states that no pets are allowed. However, there are a few and they are not a problem so we turn a 'blind eye'. Until that is when one particular dog started barking all day. We had to use the rules of the lease in this case purely to protect the majority.

ok ok all,  i think we all know there have to be rules.  And i am sure we will all abide by them and be grateful for them. Just its a bit early to be gettting told off already. You always get one who permanently complains about everything though!. Every neighbourhood has a grump and also a rule breaker.  I primise i won;t be the rule breaker.   I only meant early evening in the pool not midnight! ha.  I'm sure everything will be fine and don't really know why we are discussing rules at this stage when we probably won't get a say in them initially anyway as Laurdan says.

just had a response of my solicitor:- 

Thank you for the e-mail, Ocupation Licence for phase 1 has been obtained by the developer, they expect to start to complete in 1 month, but the developer will inform me.

short and sweet but another positive response

My first posting. Received e-mail from solicitor today. Licence granted and completions will start in 'one ot two monthe time'. We are block 7.

Was out a month ago and it still looked good. Work had started on the orange block's (the block behind the supermarket) pool area which will be a pleasant outlook from block 7. Phase 3 plot is still there though. We saw inside our apartment a year ago and the finish seemed good. One point about the parking and storage units: This is stated in the original contract and gives the parking and storage unit number. A plan of the underground car park was included showing the positions. There appears to be 20 parking and 14 storage for a block containing 24 apartments. The storage units, which are against the outside walls of the underground car park, appear to be about 4sqm on the entrance side of the blocks and 7 sqm on the balcony side. The plan implies that the system is two-way.

Still can't get excited about it just yet.

Congratulations Per.

A two way system to and from the car park seems very tight to me.- obviously someone will have right of way but in my experience all the underground car parks prior to this were one way.

Anyway, we're up to 4 now, that we know of, only 460 to go.

We're also block 7 so good to hear that things are finally moving although my solicitor was blissfully unaware of this three days ago!. Maybe we can have a Block 7 party followed by a Block ? party etc etc.

Dear All

its been a while since ive been on this thread since cancelling my contract about two months ago.  However have you seen the article below on the 'other main Manilva' website.  As you will see the three main developers will begin works on the Penoncillo road (which i know is VIAL A) and will fully fund the 3.5 million euros required to get this 'up to standard' including liks to the dual carriageway and propoer footpaths.  As you will see it is being monitored and assesed by the townhall (planning department) as to the progress. start in two months and will alst 18 mths

I have spoke with my solicitor (for what its worth as ive got my monies back now) and he has confirmed that this must have paid a great part in the delaying of the occupancy license.  Until the developers signed up to this there was no now way the townhall would have granted the occupancy license and still won't for the South west side of the development (blocks, 1, 2, 3 4, 9,10 etc). You will also see that street lamping, cabling, electricity are all part of this agreement and will surely mean an exclusive finish to the development similar to Sotogrande.  He also mentioned that as the this cost is being born by them then any 'cock ups' within electricity/infrastructure will aslo be at there expense and will have to be resolved for this whole thing to be completed.

My solicitor did warn that this could delay the license for the Penocillo side of the developement however thos eon that side - blocks 1, 2, 3 4 etc will have an idyllic finish and better acces to the facilities.

why did i cancel ?? - though Priensur may have been offering monies back to clients to finance the development of the penoncillo road as despite what we think they don't have an endless pot of money.

You will also see on the photograph of the sign re works to the 'Penoncillo road' the Priennesur Duquesa development in the background- again this MUST be superb news for Manilva, Duquesa and Sabbi

The Mayoress of Manilva, Antonia Muñoz, signed an agreement last month for major improvements to the El Peñoncillo road, of which all costs will be borne by the developers currently building in that zone.

These include Ros y Falcon, Prienesur and the Junta de Compensación SAU-3 El Peñoncillo who have committed 3.5 million euros to the project which will involve a dual carriageway running for approximately 1.5 kms from the road’s junction with the old N340 by Pueblo Mexicano, until approx 150 metres past the turn off to the Las Viñas secondary school. There will also be three roundabouts at junctions with the new urbanisations neighbouring the road.

The new road, explained Muñoz, will be an important improvement to the Municipality’s infrastructure providing an alternative connection between the coast road and Manilva Town, as well as giving excellent access to the many new houses in this area. The councillor in charge of Infrastructure, Mario Jiménez, who was also present during the signing of the agreement, went on to confirm that the project will be overseen by the Town Council, through the Geuma planning department who will be responsible for ensuring the quality and progress of the project.

The promotors involved in the financing of the new road, all have developments in the vicinity, and will contribute according to the built area and their border with the road.

Apart from the dual carriageway and central reservation their will also be a footpath and some parking provision included along with service infrastructure such as drains, sewers, conduits for electricity and telephone cabling as well as streetlamps.

Works are expected to begin in two months and should take a total of 18 months to complete.

The licence being granted for some blocks in Phase 1 is excellent news for the development.

I am looking forward to getting the keys to my apartment in block 2, so I will remain patient. 

Yesterday I received the following from my solicitor :

With regards to the first occupation licence, we would like to inform you that the Local Town Hall (Urban Department) has verbally confirmed today the first occupation licence was partially granted the last 28th of September 2007.

It has been obtained for the following blocks: 4-5-6-7-11-12.
