Hi,

Has anybody had a call from MRI?

We had a call this morning with updates, which are that yes the water pipe has been a problem but has been repaired and will be signed off by the town hall this week!! The developer can then do the road, taking 10 days so council can issue licence mid August. Unless the council have other issues that the developer is not telling us about.

I am pleased that the council is making  Arenal or whoever get things right, hopefully the developers are not hiding more dark secrets

Nothing yet from our solicitor. I hope all goes according to MRI's information. We really don't want to back out. As I've said, we loved the area, the build and the planting etc. All looked great. It would be such a shame to see it be allowed to go downhill. We're keeping our fingers crossed until September, then we will re-appraise.

September would be about right, if no more problems revealed at the last moment!!

I have lost 2 sweepstakes already amongst friends and family, third time lucky? So far, everybody's guesses have been and gone! So, when will we have a glass of cava on the patio/balcony of the apartment that weown? Next guess is 1st October, yes I do mean 2007

We have bought on phase one- block 3-apartment 2A.It's good to hear some news about what is happening with the licence. How have you heard that it will be August? We ordered our furniture back in Feb when we thought everything was about to be completed. The apartment looked lovely as did the grounds-even though it was raining.I would love to hear anything that anybody knows Cheers!!

Sorry for not reply to you before but as you can imagine it has not been easy to obtain all the information requested from the developer, and more when I have tried to confirm this information with the Town Hall.

 In reference with the developer I have talked to Francisco who was the same person that informs me the last time about the progress of the development. He has told me that it is true that they had an appointment with the technical in the Town Hall and that they have a problem with the water supply and the access road. This is the same information that you have. He confirms to me that at the moment they have people working on the side to replace it and that it will be finish both things in 20 or 30 days but being realistic he thinks that the First Occupancy Licence will not be ready until October 2007. 

He also confirms that at the moment they do not let the buyers inspect the properties as at the time of completion it will be in the sales office and post sale department which will attend all buyers with the snag list and they do not wish to have now any delay for this matters and they have another more important matters to attend. Perhaps it could sound strange but I more or less understand it. 

In reference with the resolution of the contract as per private contract you have the right to do it and they have confirmed that they will accept the resolution and return to you the amounts paid if we required them formally to do it. But as the contracts says about an interest and penalty for the delay, when I ask them about that they say that this will be more difficult to obtain it but that it will be something to discuss with the lawyers of the main office in Cordoba. In case you finally take this option I call  them and inform you with the result.

 I have also contacted the Town Hall to confirm all the explanations of the developer and after 3 days calling I have been able to talk directly to the technical in charged of the inform of the infrastructure of the development who has inform me that they have several problems why they do not obtain the first occupancy licence: 

  1. They have to replace a broken pipe for the water which has been broken by them (the technical told me that she is going to go tomorrow to inspect if they are doing it correctly and Francisco told me that it will be done in 20 days).
  2. They have to finish the access road. Francisco at the sales office told me that they are going to do it also next month and that they delay has been due that the road has to be made by 3 different developers and by the Town Hall. The technical in the Town Hall says that the reason of the delay is because the developer insists in doing the road with their builder and they have not agreed to do it until the Town Hall has accept it.
  3. Also the technical has informed me that they can not have the supplies for the water, electricity and telephone ( Francisco has not told me anything about this problem).  

The Technical has informed me that the time they take to give the First Occupancy Licence it will depends of how long it takes for the developer to do it, so they can not give me an exactly date. 

The result of all this is that the developer says that they will be ready for completion around October and the Town Hall can not give me any date as depends on the developer. Any case you have the option to resolve the contract at the time you wish to do it.

Don't know if this adds anything to the mix (or fun) but we are going to hang on in there for a while yet.

It just defies belief that a company waiting on some 70 million euro on final payments can't keep their customers informed, good or bad.

No, we're not there yet.........this a good development and once everything is resolved it will be a good buy. There's a lot going for it and we looked at a lot, believe me. I'm thinking that in the long-term, it's still a good bet. I think they know that too, which is why they are offering to pay cancellation fees so readily. That is just so not the Spanish way.............

Yeah, agree with that.

Once the Licence is granted (and it has to be at some stage) the value of the development will really increase, so Im not suprised that Arenal/Cajasur are now quite happy to pay out on cancellations at the "old" price.

Basically, if you want to cancel you can.  I have been over this a hundred times, good days and bad days.  I said months ago I had concerns that something was wrong and now it has surfaced.  But, it will be put right; your post WFLEM007 from your solicitor was an interesting read and feasible.

We have many friends in the area and if we cancel we will not get anything similar to Arenal Duquesa for the same money in a similar location.  Apparently there is a property crash in Spain at the moment but as always a good property will always sell and I believe that the developer will be able to sell the properties after cancellation.

The Town Hall are safeguarding our interest by being firm and making sure that everything is as it should be.  It is days like today with the weather here so awful, you think of your nice apartment in the baking sun and you just want to be there.  And we will, just not this summer.  We have to consider that we are dealing with another country and unlike the UK the customer service is plainly dealt with differently.  It is and continues to be extremely frustrating but we are, for sure, on the last hurdle so hang on in there.

Hi all

We are feeling more positive today,at least some of your solicitors are responding to your questions ours doesnt unless you bombard him with emails,even then he doesnt tell us anything , we already know more than him from information via the web site.We will stick it out as well,as long as it takes.

I thought all apartments had storage and parking space?

Glad to hear you're feeling better Lynn.  Don't worry our solicitor doesn't say a great deal either. 

We have storage space within the garages in the lower level.  We only have this as Arenal phoned after we had paid our deposit and asked us if we would like to purchase the stroage space.

Sorry I should have said storage in phase 1,

In phase 1 everybody has parking space allocated but there was not enough storerooms to go round so if anybody calling it a day and has a storeroom it would be handy to know

Hi I have just returned from holiday and I can assure you no one is working on the site and have not been for a while. there is evidently no water and they have just found a break in the sewerage pipe and do not know how long it will take.

I have started to proceed with the cancellation as I have looked at other properties whilst I was there and the prices have dropped and people are taking dramatically reduced offers.

I have waited nearly four years for this property and it is said to pull out b7ut there comes a time you cannot wait any longer.

I was also surprised to see so many steps aroung the complex not friendly for pushchairs or any one who is disabled they were not there in the beginning.

Hi Val,

when you say you have started to proceed with the cancellation does this mean you have to go the legal routes through the courts or will you just get what you paid back less any administration fees.

  We are really at a crossroads here and dont know what to do. Looking more like we will pull out of contract also if not much cost involved.

Hello All

We have been looking in with interest for the last few weeks. Certainly picked up more info on whats occuring than I have through my efforts to communicate with MRI and my solicitors representative  Elena.

I appreciate our frustrations are at the fruition stage compared to most of you guys - we purchased in Phase 1 last November assured by the infamous Paul that it should complete by the end of December but to be safe assume January. 

Optimistically we booked flights in January and hey ho it wasnt ready - We could live with that.

We then booked flights in May and again had to find accomodation else where. I wont bore you  with the reasons MRI were putting up as clearly many of you have heard them many times before certainly that dear old road has had some air play.

I last spoke with Johanna at MRI last weekend who absolutely assured me the workers were back in - she admitted to the problem with the water pipes and said they had not been aware of this before.  She said the road and pipe work were in hand and we could expect an August completion. We were encouraged that there was activity again but then read a despatch from Val who said there was deffinitely no one working on the site - Who's kidding who here?

This is a big move in our lives for very personal reasons and because of this our hearts remain positive and like many of you we believe and sincerley hope the wait will be worth while.

Heres to hopefully enjoying a toast with most of you soon even the Gooners - Yes Alan and Bob youve guessed ' Come on you Spurs'

What you have been told could be true, did they say which year? 

We also used MRI and Elena and I think they are kept in the dark by the developer as much as us, would be nice to think we would be able all watch the derby game 15/9 down the harbour!!

For all those with Elena for your lawyer I spoke to her at length on Thursday and I have posted the relevant points of that conversation on the 'Ocupation licence to be Granted' thread on this site.  Welcome Lester & Belinda to the Tottenham Hotspur Supporters Club Duquesa Branch. We are lining up a derby match between rival fans in Duquesa if and when we complete. It will have to be table soccer though that's all I can manage these days.

We are buying an apartment in Bulgaria as well as Duquesa.  The ski area we are buying in has a forum similar to Manilva Life and is also a source of much information.  The concensus on that forum is don't trust an agent having 3 letters in its name, the first being M and the last I.  It seems the same can be said for Duquesa.
