Having bought in Phase 1, block 3, we were concerned about the recent thread indicating that as we faced the pueblo mexicana, our completion wouldnt take place for at least another 12 months, as such we contacted our solicitor, ELS in Fuengirola & asked if they had heard anything.

Today, we received a mail from our solicitor, who says she has spoken with the developer & there is no truth in this statement, although it is true to say the word of the developer has been less than reliable thus far. 

She went on to say the developer indicates they hope to have the FLO in Oct/Nov, she said this cannot be guaranteed,given the history.

Whilst not great news, at least it is a discussion between one of the solicitors & the developers, as opposed to 3rd parties or even sales centre/ Gerens staff

Hi All.  OK where to start. 
Firstly, phase one is looking fantastic.  It is being guarded like the crown jewels.  I was unable to gain entrance into the apartment I have reserved.  However, Paco did take me round the development.  And all is good the gardens and external areas are being maintained.  So on that score, good.
The road in question is the stretch of N340 road running from the Guardia Civil under the blue bridge to the right hand turn going up pass our development at blocks 2 & 3, pass phase 2 and up as far as the new school behind phase two.  This is a huge project that is estimated to take 18 months with work due to commence next month.  I personally cannot see that they will be starting on the work going up pass us as there is building work still going on up the road with Prienesur and Ros Y falcon.  Ros y Falcon have a development on the left of the said road, that is currently active.  Now I maybe wrong but they are hardly going to start constructing a new road while building construction vehicles are currently using it.  Admittedly the roads there are urgently in need of improvement, but how does this impact on our licence being issued?
I had a meeting with my solicitor and he has advised that, he is unable to get a date for completion from our developer.  He calls them every day, he currently has 50 clients who have purchased on phase 1.  He said that he personally feels that they are in an administration mess.  He has called in the past to ask about certain clients and they are not registered on their database!  He has advised that if we are buying to live permanently or to rent then we should cancel.  But if we are only using it as a holiday home then to sit it out, as we will not get a similar apartment for the amount we have paid in the location.  This we can confirm as we could not find anything and asked agents who also implied the same.  He did say that you can claim compensation if you are planning on moving permanently to Duquesa and are currently renting until the apartment is ready.  Otherwise, compensation would not be able to be claimed, although are development is now currently nearly a year over due, and we can invoke the bank guarantee to claim our initial costs back, he said that developments always go over the stated time and generally it has to a year before any claim can be made, as is ours.
 So is up to the individual to make up your own decision, do you stay or do you go??  My personal belief is that now our developer has agreed to the road improvements, they will now require the licence for phase 1, whether that will be phase one complete I do not know and was unable to find out, I cannot see any reason why phase one on the side of Sabbi cannot be given the licence it is all in place with the road and looking great.  Block 6 & 7 over look from the rear of their blocks a pool area for the apartments built behind the Mercadona and a park area, which is still in construction.  It will be a lovely place when it is completed and the gardens planted. 
There are a lot of 'Chinese whispers' going on in the Manilva area, you have to be very careful of listening to agents that will undermine one development in favour of one that they might be able to sell you.  If they know you have money waiting to buy they are a bit like bees to the honey pot.  Caution is seriously recommended.  The problem now is that the town hall have gone from issuing licences whilst looking the other way, to being extraordinarily cautious.  With so much fraudulent activity concerning the issue of Habitation licences on the Costa del Sol in the past it has now become so air tight one cannot breath. 
I have taken photos, which I shall endeavour to post onto the photos area within the next few days.

Many thanks for the post Laurdan. As I understand it, blocks will be released in phases. What you have said confirms my feelings about this development. As good as the development is it's the 'muddling' approach by the developers that is a big negative for me. Sure if you can sit it out then eventually you will have an excellent property in a very good location. But how long will it take before absolutely everything is in order?

Ah Alan, yes it must have been a bad day at the office on Saturday! And that journey home must have been hell espescially with all the gooners on the train!!    I suppose they were singing 'There's only one team in London'  How wonderful!!

We have decided to continue with our apartment, our last visit confirmed for us that our aparment is in the location we want, yes their are cheaper apartments around, but for me I want to be in Sabbi, 5 mins from the beach and two from the shops, bars and restaurants. And there is nothing in my price range with this location. 

I can only repeat what I have already said, my solicitor said that we would not beable to claim compensation unless we were now living in rented accomodation due to the fact that we cannot move in.

I think that the developer will now be pushing for some kind of phased completion within phase one.  What impact the road works will have on the blocks on that side to the road, could I believe be immense due to disruption and noise. The blocks most affected will be 1, 2, 3 &  maybe part of 4.

Margo block 5 is on the sabbi side of road D  so it would not affect you, your block is next to mine (block 6) and your block would I believe, be one of the blocks that could commence completion.  When I was there last week the electricans were working on the lights in road D outside your block.

 

 Can anyone help I am having a problem uploading the pictures.  They keep causing a runtime error, any help appreciated.  Alan I know that you are the IT wiz kid! .

Hi Tracey. From what I know a run time error is caused by one of the following.
  1. Confliction with a running program
  2. Software issue
  3. Computer Virus
  4. Memory issue
If you are sure it's not a memory or virus issue then the solution is often to run a registery clean up programme. Failing that try closing all other programmes and try again or restart your computer and see if that sorts it.

I have just tried again to send the photos and this is what I am getting

I have just looked on the photos thread and some of the photos have now been posted.  It looks at bit hit and miss, so apologises, but as you can see if you enlarge them I have taken photos of the road area where all the work will be commencing. 
This may help explain photos
Picture 7106 shows road with our development on the right, this shows that the road clearly is in need of improvement.
Picture 7803 Pool area to blocks 5, 6, 12 & 13.  The facing is block 12
Picture 4698 Shows N340 taken from bridge and showing area where the road will commence.
Picture 3953 Photos 1 & 3 taken again from the bridge and showing more of the area where the work will commence. Photo 2 is a view of the road taken at the top of the hill looking down from the school, it shows building work still in the early stages and it is my belief that work on the road would be pointless here at this time due to so much construction still to be completed there.

Typical Spurs comment, Arsenal were lucky,  a 3.0 win hardly reflects luck!

If I may quote the papers this morning. 

"Arsene Wenger’s multi-talented cast produced an all-singing and all-dancing performance which had nearly 60,000 delirious fans cheering from the rafters."

And to add more to the Spurs misery the Seville manager Juande Ramos is the spurs target to replace your current one, Oh dear.

Behind the Mercadona, apartment blocks have been built and the owners have now moved in, these blocks were constructed the same time as our development, yet the owners have taken possession, even though their swimming pool area (overlooked from the back of block 7 of our development) is still being constructed.  

I feel that it has a lot to do with the road due to be improved.  That side of the development may be affected, even though the apartments are ready for completion the external area is not.  However, the other side is ready, so how long do they have to wait??  It seems a case of how long is a piece of string???????????

A few further snippets from our visit which finished yesterday.

1. Someone stated that the polls were not tiled.  This is not true.

2. There were a number of people working in the old show flat for the last 2 weeks, to what end I don't know.

3. The electrical contracors who are running in the main power cables were still at it at 6 p.m on Saturday evening.

4. Trees have been planted in the pavements adjacent to block 7.

We are definitely going to carry on with the purchase after what we saw.
