Hi Sierra Golf people

Does anyone know of anyone actually getting their full deposit back.  So many of you on the SG site have been buying since 2004 surely someone must know of someone who has asked for a full refund.  Or is that the catch, are some of you out there still waiting for your houses because somewhere in the small print it isn't possible to get your money back even though the builder has broken the contract by not completing on time.

I know everyone is trying to put on brave faces and keep up spirits etc but it isn't just the timescale now, no one will believe anything that Masa says anymore.  Until you actually see the papers is anyone going to travel to Spain, I don't think so.  And if there is a serious problem that is being covered up how long could we be realistically waiting.

The pictures posted recently are great, but from what we saw on July 10th there is no way that M13, 14 or 15 will be ready with water, electric, and roads in a 'few weeks' especially as the temperature is already in the 30s and August is almost here.  Tarmacing in August would be pretty hot.

I do not want to be the doom and gloom, but I am the realist and would rather talk about how we can do something practial instead of talking about golf competitions etc that can't take place for months and months as the golf course just wont be ready, but more important will the houses  ???????????????

Hi Rang,

Our names are Davina and Pete and we are one of the people who bought in 2004. Some while ago we were offered a full refund from Grupo Masa but we declined. We knew it was going to be a long haul but as we are both working and we would be using it as a holiday home only we decided to hang on in there. Even if it is 2008 we think it will well worth the wait. In saying that I do feel for people who are intending to move out there on a permanment basis, is that your plan?

Hi RangSG, my son did try get released from the contract and have the deposit returned, through our solicitor.  We tried all of last year.  Masa stalled and stalled then announced that they would not proceed.  This was even though we had a letter from them offering to end the contract and refund the money paid - after their delays and breach of their own contract..  They never had any intention of fulfilling their own offer.   Our solicitor was told it would be too costly in administration fees for them, and that the only way to get  out of the contract was to take them to court.   Personally, we don't have the money to risk on a prolonged court case (or more loss of sanity).  I suspect other people may have had similar experiences, although I haven't heard of any.

Our estate agents, Luz del Sol in Kent, told us that if we pulled out of the contract now (paid deposit in 2004) that Masa would require 25% of the total house price before giving us the balance as a refund.  Obviously it's too much to lose at this stage.

Hi All

When I complained about the dates of completion, the commercial buildings opposite my albatros 15-30 (was not told it was going to be there) Etc etc, QSD did offer me my money back.

I did not except because I think S/G will be great and I love the area and have set my heart on it, so I will wait. It will be worth it.

Hi all -  i've just come across this on the general forum - thread for getting deposit back  (Camposol was also built by Masa ).

 

We bought on Camposol back in 2002 before we decided to move to Spain permanently a classico Number 1163 Poligono C14 which should have been ready by the latest December 2004! We decided after a lot of ignored emails/letters and phone calls to Jumasa direct to go down the legal path, we had already been living in Spain for a year or so by now and we decided that as the villa was so late we were well within or rights subject to the property being so over due to pull out and get a full refund. We contacted both Luz del sol for help and Jumasa direct but as no-one was listening we really were on our own the agent said the contract was not with them but with Jumasa so, we tried phoning sending letters which were returned! We just wernt getting anywhere so then .......

I asked around on the forums, I had already set up my own website so had a few contacts one of them who put me in touch with a solicitor in Torrevieja who had won similar cases before.

We first contacted them in July 2005 and after they were ignored a few times by Masa they sent Burofaxes, which have to be answered over several months the solicitor eventually took them to court and in July this year the court demanded they pay us a full refund and interest on the monies already paid.

I have all the details for the solicitor we used we had to pay 1500 up front for costs this wasnt covered by Jumasa but we were just pleased to get out money back to be honest so the interest was a bonus.

Luz del sol also paid us the total care package as soon as we won the case. That was a con if ever there was one, they did nothing for that £2000 bar opening a bank account for us! Still it was a steep learning curve for me and has helped me so hopefully I can help others.

It takes time and patience to follow this through and it is very frustrating at times but I wanted to give people hope that they do not have to have the property if Jumasa have broken their side of the deal which in many cases they have! running over by years in many cases! They are allowed a 3 month delay under noraml curcumstances after that they shouldnt have a leg to stand on!

We were lucky as we already had another property to live in but for some people especially retired people who have sunk all their savings into a home only to find they have to pay out for a rental property for months on end eating into their pension its terrible.

Please note that anyone who is in fact renting because of late delivery of there villas is also entitled under Spanish law to extra costs to cover this but you do have to prove it.

You need to be in possesion of all paperwork, reciepts and details of the whole sale with a contract or copy of one. For anyone who does not have the original reciepts Luz Del Sol had all ours strangley enough and they should let you have them at your request if they havnt given them already or your agent if different.
