Hi all

We agree things are looking a bit grim at the moment , and perhaps in the future legal proceedings with an independant solicitor may be our only option but at this moment in time we feel there are other avenues we can explore before taking this step, such as contacting the builder, solicitior, and agents and also Almoradi town hall and planning officer and perhaps Almoradis mayor. As far as the cleaning of the building is concerned we feel we could be doing a lot more to help ourselvesby cleaning our own areas and have a communal clean once a week by everyone who is there at the time after all we now own the Vegamar, afterwards maybe hold a barbeque or a party as well as stopping our lovely apartment block turning into a slum it would be a great way of getting to know everyone if anyone has any sugestions on how we could organise this please reply. A little bit of the Dunkirk spirit is needed if we are going to keep our dream of a lovely place in the sun alive

Hi,

re the message below, we really dont want to seem negative, but there are a great many sites that are uncompleted over here in almoradi, several only half finished, our site is one of the better ones, so  dont think the town hall or mayor are very interested.

we do try to keep our own parts clean but with the unmade road and the dust here it is very difficult. as for cleaning every week by who is here, whilst we will always be prepared to do our bit there are only a few of us who live on site, and it is not practical to expect us to clean up after everyone every week, particularly as this is idearcos responsibility.  also a lot of the appartments are on the holdiay website and are being let out to holdiay makers, again the residents here should not be expected to clean up after them every week. (still the pool party sounds good)

on a brighter note, it is lovely here and the news is that the site will be completed its just a matter of time.

hi

gotta agree with carol its not thier mess

anyway on a brighter note, it seems that most builders in spain are laying off workers tho lack of freed up money and the banks aint lending due to election of president which was today,

am led to believe its a ploy by the builders to force the goverment start banks lending money again, as the goverment wont want loads of workers out work , its not the first time they have done this

if this is the case then things should happen very soon, by the way this is said to have come from diego when my wife was over last

any body heard the same

Evening All

Sad to read the recent posts and hope to read something a bit more positive in the not to distant future.

I do believe that we can all do our bit with regards to the clean up when we are out there, but cant expect people who live there on a permanent basis to clean for us all..

We are going out again on 28th March for a few days and hope to hook up with any of you who are out there at the same time.

Hi All,

We are paying our key holders to clean from our apartment door to the side entrance door when we have guests over now, I would not expect anyone else to have to do this for me. I appreciate the updates we get from Carol, its good to here from someone who lives full time on the site.

Interesting what Terry had to say about the government changes!

I think my message earlier was taken out of context it was meant to be more of a rallying cry ,I certainly wouldnt expect Carol or any other person to do all the cleaning it wouldnt be fair.

hi all,  last week i e-mailed iberian about the situation with idearco and the road not being started,to day i have just received a reply from them,and they have been told by the builder that the road is definitly going to be done but no date has been set to do this.they did not mention the financial situation with idearco.hope this is peace of mind for all owners at the vegamar.   limetree

Hi there

I have contacted my solicitors Aroca Seiquer and that they have advised me that they are not aware of Idearco being in any difficulties and that they are still signing dees before the notary.  Hopefully the situation is nothing more than a timing issue.

I have just spoken to the builder and they have verbally confirmed that the whole site will be completed the latest by the end of April

Hiya all glad to hear the good news about the road, as for the cleaning it will be better when we are in control of Vegamar ourselves as we will be able to make sure we are paying the right people to clean. I dont know how the committe works but Im guessing we all have a say in the comunity. I am over on the 5th April with my family for a few days it will be good to meet up with anyone else whos there.

My fridge in my apartment doesnt work we didnt get time to sort it the last time we were there has anyone else had any probs with electrical appliances and who do I need to contact.

hi

we had a problem with the cooker, and extactor fan in bathroom but diego was on site then and he got it sorted.

if any one is renting their apartment out a friend of mine has a web site for buying and renting apartments aboard,

he works on commission base i.e. i think 10% if rented thro his site

I am about to complete on an apartment in Vegamar 1.   It was completed in August but I was unable to visit Spain to get my NIE number until December, I was then told Idearco would not be signing off any more apartments until the end of January 2008.   I bought through Ambasun and after a lot of pushing they have given me a date of 28th March.  l have sought additional legal advice from a lawyer (international) in London and have been advised not to sign until I have a copy of habitation certificate and a copy of the certificate for the 10 buildings cover which  is appartently compulsory in Spain.   I would be very grateful if anyone could let me know if they have these certificates and any views on the apartments themselves.  Safia

hi safia,

we have been living on vegamar since sept, and completed last june. i contacted my solicitor recently as others had asked re the cert of habitacion, he said that we will not get this until the site is completely finished and ready to hand over to the owners for the comitee. he also said a decision had to be made on this,but he felt that a lot of builders in spain do not get this from the town hall until everything is completed, (as this is basically what it means, that all is up to standard) so they cannot give it before the site is totally finished.  I have not heard of the other one you mentioned so i cannot comment on that one.

Hope you get it all sorted out in March, it is nice here but the swimming pool has not been cleaned now for months and the site is very dirty. we do expect work to start again shortly and there has been a sign of a worker here in the last week.

I to am with Amba Sun and have been given the 28th March as a signing date. Like you I have had to hound Amba Sun and my solicitor with questions. One of these was the habitation licence. According to what I have read, the builder should have applied for this, as it can take months, I have asked to see a copy of his application. I don't know if you have been reading the forum but the main door to these apartments is open and all smashed up. I would have concerns about security. I have told the solicitor not to withdraw any funds to the builder until this door is fixed.  I feel there is little or no information when completing from either the agent,  builder or solicitor.  I also asked do we get a contract and will the snagging list be written into this, as there is talk the builder is in financial difficulties and people who have bought there are having problems getting the builder back to sort these out.  If the builder does go belly up and stops paying utilities and  we don’t have a habitation licence the utility company will not connect water or electric without this, Also I asked do we get  a warranty with the property as I know new builds in NI will have a ten year warranty if anything goes wrong. I don't want to hold up completion as we have waited so long and can't wait to get out there, but we are parting with a lot of money and need to be sure everything is OK.

Thanks for your e mail.   I sent an e mail to PSI lawyers telling them that I want sight of habitation certificate and the 10 year insurance paperwork and told them I did not want them to sign until I had a satisfactory response.  I also faxed out information they required about my deposit sent in MAY 2005.   I did all this yesterday 25th March as they said they would not be open until then but to date no re sponse and when I telephoned about 5 yesterday I got no response at all.   I acted on the advice of a spanish lawyer with John Howell's international law company in London (Very expensive advice).  I have invested a lot of money already but I need more assurance before I am prepared to go ahead.  Its ironic really my friend has bought two apartments in Almeria, hasn't used a solicitor and has absolutely no problems.   They were new apartments but finished when she bought them.   I do hope it all gets sorted and although I will only use it as a holiday apartment I look forward to meeting you and some of the other people on this website, sound great group of people, hopefully the plus of the project.  Are you going to live out there or using it as a holiday home.  I will keep in touch to let you know how things go, hope you will be able to do the same.

I  am with PSI and have heard nothing to-date, I agree we need assurance that these documents are in place, or at least in  process, we have waited this long and might as well hold of until we are content. The solictor should know this, but they may cut corners to try and complete. I also asked the solicitor when does the builder gets the remainder of the money. I have to sign a consent form to allow POA but will not be signing anything until I am happy.  I am using this as a holiday home if I ever get there. Would be glad to hear from anyone else on the forum about these issues.

Dear Joanne,
Thanks for your e mail, I had already signed poa with psi and intend to e mail them again today asking for a response, (sent them a reminder yesterday).  I will be phoning them this morning to find out what I can and e mailing my bank to ensure that they do not release the funds I have in Spain as I also signed a permit to withdraw the funds from the bank.   Even the bank is not responding to e mails but I feel unless the requests and instructions can be obtained in hard copy they have a get out.  I sound very cynical but this experience which should have been a relaxed one and easy considering what psi are charging which appears to be even higher than Howell's, has made me wish I had never considered buying a property abroad.   There's apparently an old irish saying, "I wouldn't have started from here." Now I can fully appreciate this.   Will let you know what happens.

Dear Joanne,

Sorry about the different fonts etc but tap the first one I see.  I have just received an e-mail from psi's Tony just as I  had posted a sharp one to them.   It states that they have passed my queries re the certificate of habitation and the 10 year guarantee onto Idearco and cancelled the signing for tomorrow.   Apparently the Notary had contacted them and cancelled as they have a "fiesta" on that day!    They state they will let me know when they hear from Idearco as to completion date.  This gives us a breathing space although it doesn't solve our problem.  I am tempted to go to Almoradi and with an interpreter see what the Town Hall has to say but as I am employing a very expensive Spanish Lawyer its a bit like having a dog and barking yourself.   I have an additiional problem in that I paid the balance of the deposit to Idearco's account via Moneycorp and as the solicitor in London pointed out and the contract states the builder noted is Proalto S.L.  Idearco said in Sept 2005 they hadn't received the money, when I sent paper evidence they suddenly found it.   Oh the joys of buying abroad.  I expect PSI will contact you.  Look forward to meeting and sharing a bottle of wine when all this is over.  Kindest regards   Safia
