Permission to change Rustic land to residential land

We purchased an apartment on a small development on the southern costa Blanca, our solicitor ensured all searches were valid and that the property was not built on rustic land.

This is correct and all legal documents prove so,however, 3 years later we have been informed by our President that the pool/garden are which is opposite the apartments has been built on rustic land and although the build is not illegal, the town hall is applying for planning permission to change the rustic land to residential which will mean we will lose 60% of the garden and maybe the pool.

We intend contacting our solicitor on Monday but in the meantime does anyone have any advice, as it appears that no plans for the pool/garden can be found at the town hall?

If you feel you have been mis sold a product ie House and/or not a pool and gardens get free legal advice from

We are trying to collect as much information as we can, it appears that the town hall have applied to change the use of several fields and areas of rustic land to be converted to building land which include our pool/garden land.

We are awaiting news from our solicitor as to what searches where carried out as we were enusred that the land was legal but we assumed this included the land the pool was built on also.

Its so frustrating to be here in the Uk not having direct access to any information. We love the apartment and village and Spain itself but you re evaluate your optioms when something like this happens.
