Completion due but Phase 2 not started

We are shorlty due to complete on our off plan property. .  Phase 1 is complete but building has yet to start on phase  2.  Although we have a small pool in phase 1 the main pool is in phase 2.  

Can anyone advise please whether we could withold part payment until phase 2 is complete?

Hi Louise,

Based on my experience I would either withold payment if you are satsfied with Phase 1 but definitely get out of thecontract if part of your reason for buying was because of the Pool in the 2nd phase.  Bear in mind that despite the promises you may be given by th developer Phase 2 may never be built or not built for some years.

Take the advice of a good independant Lawyer before deciding to withold payment or cancel.

I would need to see the contract that you signed and the publicity that was shown to you when you made your decission to buy.

Cannot really give to you an accurate advise withoutv seeing it.
