Residencia holder-Living outside Spain

Hi,

My daughter is an Indian Passport holder having a Spanish Residencia. She is currently outside Spain and is planning to do a short time course in Physiotherapy.
Can you please advise what is the maximum time she can live outside Spain being a Spanish Residencia holder and then return back to Spain? Is there a time  limit and if there is how much duration can she spent overseas?
An early reply regarding this is highly appreciated.

Fortunately this came up under another thread recently and the correct information was found and shared. I'm trying hard to remember which thread so I could go and check for you ..... but am failing.

I'm almost certain the limit was six months outside Spain but hang on a bit and someone will come along with the definite facts and hopefully citing the actual legislation. In the meantime, the one thing that's certain is that YES there is a limit.

So it is a maximum absence of six months, and this is the regulation:

Article 11
Validity of the residence card
1. The residence card provided for by Article 10(1) shall be
valid for five years from the date of issue or for the envisaged
period of residence of the Union citizen, if this period is less
than five years.


2. The validity of the residence card shall not be affected by
temporary absences not exceeding six months a year, or by
absences of a longer duration for compulsory military service
or by one absence of a maximum of 12 consecutive months
for important reasons such as pregnancy and childbirth, serious
illness, study or vocational training, or a posting in another
Member State or a third country.

One more question --Do you have any idea how I  can apply for this exemption for 12 months as my daughter is planning to study overseas.

I do not think you have to apply for it but have to be able to prove it when necessary. It might be an idea to enquire at wherever your daughter obtained the redidencia as to what the situation is / or requires.
