Dear All,

After 62 days of instructing my solicitor i have today been informed that he has received the money from the bank after executing my BG.

This is not only fantastic news for me but also should give hope to all those that have BG's

I must say the solicitor that i used was fantastic and did exactly what he promised within the timescale he said it would take.

You may all have read my Thread: And Now The Final Curtain - The Dream Is Over. Any help or information i can give to you all please ask as i am now out of this mess.

I will sign off with - THE NIGHTMARE IS OVER !!!!!!!!!

Well done !

I have just read a post on Viva Almeria that someone has got their case to court and been successful. They have got their money back plus interest and costs. They started proceedings in October 2006. So it looks like at least a 2 year wait for us even though we have a bank guarantee.

All,

We changed solicitors from Aldea to Victor Martínez solicitors in Vera in the middle of May. Fortunately for us we had bank guarentees, I have just recieved conformation from him today that CAM Bank have paid up and the second Bank Guarentee is very close to being paid by Cajamurcia. The first guarentee has been sorted within 6 weeks of going over and signing the Power Of Atourney over to them. Fingers crossed the second one will follow shortly and it will all be over....
To anybody looking to move I cannot talk highly enough of they way they have looked after us and how differently it was than dealing with Aldea.

All we need to do now is sort Parador out!!

Great news !!!!!

I too used Victor and like you said he did exactly what he promised and got the result.

I would urge anybody that is with ALDEA TO CHANGE NOW, they must be in HUMAS pocket as Victor has no problems in getting peoples money back if you have a BG

Great, another good news story.

It seems now that slowly refunds are getting paid out. Mostly from BG's.
Cam Bank seem to be the most responsive todate. Others not so sure about.

Once again, as I've said before, and we all feel the same I know, this particular developer putting us all through this long winded costly fight to get back what is rightfully ours beggars belief. I guess they have no real humane feelings as to what impact this has on individual lives nor do they care.
Some would argue the funds are no longer there and that the developer has used the money up ......  sorry, not our problem. They took our money and need to refund it end off...........

Many now have to look forward to court date / hearings....... interesting times ahead no doubt !

When you go over to Spain to sign over power of atourney to your solicitors is this all you have to do to iniciate refunds/cancellations.  I was asked to get it signed by a notary  here in UK and then get a apostille of the hague convetion signature ?? - I was not sure if this was just because I was in the UK, if so it will probabily be eaier for me to go over to spain to do it.

We went over with friends of ours who are in the same situation for 2 days, we had a little meeting with Victor first thing in the morning on the Friday and he explained what we had to do and what he would do for us. His assistant then walked us to Aldeas offices to get our file (€400 for 2 pieces of paper - at least Dick Turpin wore a mask). She then took us to the notary waited with us and explained the paperwork before we signed in front of the notary. Honestly they were very very good and they both spoke very good English, it was all wrapped up well before lunch. Victor will tell you either go to Spain to sign Power Of Attourney over or go to a Spanish Embassy here to do it, I think it probably puts your mind at rest a little by doing it there and meeting them in person.
We were walking down the beach in Majocar Playa by 1pm.....
A word of advice if anybody is with Aldea try to get out of paying the fee to close your account, I was expecting maybe a 15-16 page document telling us what they had done and when - oh no, we got the 2 original Bank Guarentees and a front sheet in an envelope - daylighy robbery.
If you need anything else just ask.

You can easily get power of attorney in you local town/city. Ask at your local council who is the notary in your town. Then, ask your solicitor to email the relevant papers and the notary will sign and rubber seal them. He will then send the papers to London to have them signed at the Spanish Offices. We got our power of attorney in 2-3 days. They will charge you a fee but it may be less than  the cost of flights at this time of year.

Hi Jane,

I got our money back in January without neeeding to go to Spain. Apostille and notary very simple procedure and cost less than £100 for the pair . Aldea should courier the docs to your solicitor for nothing as they did for me if you are firm with them. They have no right to requset monies and should be reported to the Spanish law society. That reminds me I need to try and get the 50% of their fee back as like everyone says they are in Parador's and by association, Huma's pocket

We did our P O A here  in uk .We had to find a notury, it cost us about £60 ,we printed the relevent papers from the solicitor ,we got them signed and stamped  and sent them back to solicitor.Hope this helps.Good luck.
