On the basis of Jethros last posting and various others - we all seemed doomed to using solicitors to get our money back. I started that action some months ago and it is going painfully slow - usual solicitor excuses.

It might be useful to pool information on progress with court cases and Writ preparation and which solicitors are being effective (if any) and which are thieving, lying, lazy Spaniards (sorry to sound racist - but I am now put off Spain for life and their people after this - I have had no reason so far to change my mind) and they always want to take our money up front in return for nothing. I am on our third solicitor - so speak from expensive painful experience - Aldea are the first solicitors you should kick into touch! I managed to get my fees refunded last year from them - so get your money back from them too! I have yet to hear of a satisfied Aldea client - but I maybe proved wrong!

I and several others (do not know how many) have transferred to Andersons who are currently preparing a global Writ for all clients - those BG holders that have been refused by Banks and non BG holders, but it is supposed to be in the latter parts of preparation.

Does anyone know of any court cases in 2008 against Huma and their outcome or anyone having a court date? Would you like to share at what stage of progress your Writ is at?

If you do not want to post publicly on the forum - I am happy to receive PM's and will honour any need for discretion or anonimity. However,I am happy to act as a co-ordination point about advice on solicitors. God knows we all need help now!!!

I feel we need to pool all information together especially now - as I am sure Huma have probably misappropriated our funds - hence bounced cheques - so we are in for one hell of a fight!!   I do not think Huma intend to give us one cent back! I wonder if the Spanish justice system is any different from my earlier stereotype.

By the way my motivation for this is Huma have 100,000 euros of my money (no BG's) - so that is why I am so anxious to help. We look as if we are totally in the hands of the Spanish legal system.

I want to see everyone get their money back!  I was the one who posted the details of the old lady thrown out of Huma's office - I was appalled and so are now even more passionate about we all get our money back!

Please read my original post below about sharing information on Writs/solicitors.

A few people have already sent me some PM's with interesting info - so thanks - keep sending. It is obvious not everyone feels confident posting direct on to the forum. I will get all the info together and post a summary of what I have in a week or so time and hopefully will write a frequent summary of information I get - in order to keep ALL up to date on latest news/information from PM's that are not published on the forum.

I intend to send a number of PM's to regular posters to try and get some factual information that might be useful to us all.

So I hope everyone sends stuff either on the forum or by PM and will reply if I send a PM to you.

For anyone thinking of swapping to Oasis - there is a forum on EOS set up on that and you should carefully read thru that before thinking jumping ship. One gets the distinct feeling of deja vu - so be careful, be very careful!

Hi all .

We emailed Andersons on Monday to find out the latest on ACC ,as we were told we would hear something mid april about court proceedings and they havent replied, is there anyone else with Andersons ,if so have you heard anything as to what is happening any info would be appreciated thanks.

Miguel at Andersons has been in hospital recently and only started back in the office last week. Luisa his secretary has left the company leaving Miguel on his own at the moment. This is what probably caused the delay in court action. I am with Andersons trying to get back my 2 stage payments with no bank guarantee's.

I did hear about Miquel being in hospital , but its nice to get a reply beacuase then we no were not being fobbed off again like we were with Huma , but i can understand they are very busy and hopefuly getting somewhere.We are in the same situation as you,we want both payments back ,and have no BG and its all very worrying as we started the ball rolling in sptember and it seems like forever.

We telephoned Andersons this morning. Our concerns were that Luisa has not replied to our emails for some weeks now. It appears she has left the company. We feel that someone should have contacted us and provided another point of contact. Anyway, things have not really progressed. We are still waiting for a reply from the bank who are very reluctant to communicate. We have been with Andersons since last August trying to get our money back. 

Miguel has someone from the Marbella office who is taking his calls at the moment. She could only tell us what is recorded on our file but I have requested a phone call form Miguel, who I never can get to speak to !  She is very pleasant and speaks good English. How can the bank justify ignoring legal writs, surely they must operate under a banking code of conduct. does any one know the answer ?

Hi

We haven't started any court action as yet, but it looks as we are not going to have any option as the person at Huma we keep being told is the person we need to speak to is never available and never returns our many calls.  We have paid 90k in two stage payments back in March 2005 and are now becoming increasingly worried ny the situation.  We cancelled our contract in March 2007 as requested by our solicitors Aldea but again find communication with them almost non existent.  Can anyone give us some information about the way forward?  Should we dump Aldea and if so who do we go to?  Do we need to do anything re Court action or should our solicitors be taking this forward?  Any advice would be appreciated.

Hi

 We are in the process of taking Huma to court we started in September but we were promised our money back ,the cheque it was on its way twice, but it never arrived, we were happy just to get our money back but they messed us around so that's why were going to court ,Its been a long worrying ride, but we wont give up without a fight.Our first  solicitor was recommended by Focus real estate and Villaquest  showed us around (mistake no 1)  they dont want to no, now were with Anderson's, sorry  its difficult  to recommend anyone at this stage because it seems everyone is struggling to get what they are owed ,but our solicitor says he is issuing court papers any day so i will let you no what happens sorry cant be any more help and a bit more enthusiastic but its one big nightmare good luck.

 Why has this once, respected company (and they did have a good reputation for build quality and service) acted like this  - it's beyond belief! 

Most business and customers would have settled for the straight forward -quick - refund and walked away. Both parties 'no win' but case closed.

Instead, they have ignored emails, registered post, not returned phone calls, even blanked solicitors and banks - alledgedly,  etc etc..... and so will be taken to court ....It will cost them more money and resources. But more importantly, the business name splashed across the www. Fools........

You are correct, they have made this one big nightmare that, in most cases should not have been........

So, what's going on behind the dark closed doors in this company that we should / don't know about? What are their real future business plans ?

ANYONE KNOW ? worrying.

My lawyer - Aldea have today received a bankers draft from Bankinter after executing bank guarantee. The amount is for the second stage payment.  Still waiting for the first stage payment, which is a different bank.  Aldea say they are confident they will get the rest of my money back, but that the bank concerned are known for dragging their feet.  I decided not to sign cancellation contract  and so far its paid off.  Once I get all my money back I might then take them to court for the deposit and legal interest.

Hi All,

as some of you know I was extremely optimistic last year of a resolution to the problem which is ACC. I have revised my position somewhat. We have had phonecalls from Huma asking us to transfer to Tabernas, but as it is not what we wanted, we would get no discounts, and it is in a windy desert it was a non starter from the beginning. 

As from today we are now in the process of getting our money back as we do have bg's, so we will see how long it takes. Incidentally we have also asked Parador to refund our £475 owners club fees.

Luckily we have a friend who deals with the Spanish property market, who will now keep his eyes open for us, so fingers crossed we will be in a position to get something else as soon as our money comes though. I will keep you all up to date on how long, and how easy or difficult it was to get our refund
