Thanks Dal for the info on Mike the Mortgage man!  Strange isnt it, we wait three years and  now 3 days seems an awful long time!  Let us know your good news on Monday

Whiff or not, I think we shall all just move on and make the very best of our new choices.  It may not be Jumilia but there is lovely countryside around us , pretty natural beaches and lets face it who could live without an Aldi?

Can anyone tell me if there are any local buses that stop at Playa Golf 3.  If so where do they stop?  Are there any that take you to any beaches?

Hi bobshe,

we were on Playa III earlier this month and asked residents on site.  If my memory serves me right, they said at the moment they were two hourly at the moment but hoping to increase the service.  I guess the more people living there the more frequent the service.  I may have to out out on my own some visits (hopefully when we get a key in the next 4 weeks) so learned to drive - look out!... Joking apart, there are so many small taxi firms (including british) the cost is only 4 euros anyway.  Even from the bus route its only a very pleasant 5 minutes walk down the avenues to the local beaches.  It really is lovely.

Hi Freddy

They are just behind the Irish  Bar, on the 1`st floor, dont worrie about it.  ,
Ive just got the new contracts from San Jose, typicaly they`ve messed up again, the have wrote on our contract that we will be moving from R7, 470, Santa Ana, Jumilla to R3, 79 Santa Ana, Jumilla!!!!
It should have been Playa Golf 3. I think its just a typo error but they will have to resend the contracts again, we`ll get there in the end.

ast week, Costa Blanca developer giant San José Inversiones y Proyectos Urbanísticos SA filed for a court protection against its creditors. According to court records, the company is approximately 30 million euros in debt.  Their developments, mostly unfinished, include El Pinet in La Marina village, Albatera Golf and Santa Ana del Monte resort in Jumilla, Murcia.  Anyone who has invested in an off plan property, basically must add their name to the creditors list in order to try to retrieve their money. The company blames the current state of the economy and the fact that the banks have withdrawn their commitment to the building projects, in particular El Pinet urbanization in La Marina, for their current financial crisis. In an interview with Everyday Spain, Oscar Ricor, a lawyer based in Torrevieja who is organizing a class action suit against the developer said, "From our professional point of view, the most effective strategy to be taken would be to combine two separate kind of legal actions; firstly, to take a lawsuit against the builder and its administrators through the criminal courts for fraud and illegal misappropriation.  Bear in mind that the buyers are not in the same position as an ordinary supplier who might claim compensation as a result of unpaid invoices.

 

"This means that the money paid to the builder has a special nature and, according to the Law, it is considered as a special kind of deposit.  It means that all the deposits paid should have been suppported by 'bank guarantee' and kept in a separate deposit account. "The builder used all the money for their own personal purposes and subsequently all this money is gone...the builder has been using the external frame of a limited company in order to conceal illegal activities.  This is why the criminal lawsuit should be combined with a civil court bankruptcy process, taken in Alicante. "It is highly advisable to use the legal services of a local professional solicitor such as ourselves, because at the end of the day both lawsuits are going to be dealt with at the Alicante Court ( the civil process for bankruptcy) and Orihuela or Torrevieja ( for the criminal one). "We strongly believe that with the combination of both lawsuits, the client will be able to increase the chance of a higher amount of compensation (capital + legal interests + moral damages). This is independent of the fact that this unscrupulous builder might end up in jail as a consequence of stealing all this money from innocent, elderly people, like one of our current clients for example, who put their life savings into this project and now have been obliged to survive in a caravan." Obviously there are many legal complexities to this case that have not been possible to cover in this interview. If you need help with this matter, please contact Everyday Spain.

Hi Dal,  Hope you get your mortgage offer on Monday.  Is the reason for the delay the Bank just being a little slow?  How long has the process taken you given the situation with SJ i.e from Contracts being drawn up, Lawyers searches etc.. just wondering as we are have been told that it is now up to the Administrators to decide if the Contract can go through (although everyone is very positive including our Lawyer).  We are apparently just waiting for our NIA (if Ive got the name right!)  from the notary which is due next week to be collected..

Just wondering about time scale and any insight into possible delays thats all.  My family are keen to holiday this summer , especially a six year old grandson!

Hi Sally,

We brought thru Atlas who have been very slow from day one. We came out to spain on 14th April and agreed a transfer to PG3 we put in a offer which was agreed by  everyone, We recived the transfer forms from Atlas on aound 14th may buy which time we started looking around for mortgage, mike was very helpful and its been about 2weeks now and hopefully the mortgage will be sorted on monday (lots and lots of paperwork was needed). It has taken abit of time but thats because we did alot of shopping around. 

We have only recived the contracts from San Jose yesterday, one page had a error, but we have decided to send the contract back but not to sign that page, they will have to send us that page again. 
We havent got a NIA number yet, our agent hasnt adviced us on that but once our mortgage gose ahead we will be in a better position to do the casing around. One things are sorted on our side we plan to come to Spain and finish of the rest of the paper work and furniture stuff. Its my wifes birthday On the 17th June and hopefully we can spend it in spain, I know its a longshot bot might even have the keys by then.

Hi all - the NIE number is crucial to any sale, as far as I know nothing can proceed without it.  It takes at least a few days to get it so I would advise that you check with your lawyers now and get it started.  You can check on the general forum where I'm sure you'll get good dvice from Maria de Castro or Georgia.

Hi folk,  yes quite right the NIE has to be obtained (our Lawyer has full power of attorney which we signed during our visit 7th May week at the Notary in San Javier).  Without this you cant open a bank account from which the mortgage payments will be made.  Our Lawyer is looking to collect our NIE in the next week (3-4 weeks from application).

Might be worth asking your Lawyer Dal especially with time of essense etc.  Our Agents had offered to obtain ours but we decided to give POA to our Lawyer to speed things up so that he could arrange all paperwork without us having to be there now.

Let us know tomorrow.. really hope it you get the offer through to move things forward for your wife's birthday!!

Hi Guys and Girls,

I have e-mailed my agent ( ATLAS) regarding NIE numbers and that we will be ready to complete and we should get our mortgage offer in the next few days and what to do next, do we get flights out to sort our contracts, NIE, bank and any other paper work. Atlas told us not to book any flights untill the THE BUILDER RELEASES THE PROPERTY AT THE END OF JUNE!!!! 

How is that when its a key ready Villa? (Atlas dont have a clue!!!!) So i rang San Jose and was told something totaly diffrent, San Jose said that the Villa is key ready and when mortgage is done and paperwork sorted the villa is ours, The Villa has been transfed to our name and was due to complete end of may, but we`ve only got the contract on may 31st because Atlas have been slow passing documents to us. San Jose said the property is waiting for you!! they are going to said me a e-mail comfiring that, once I get it I will let you know what they`ve said. 

Its worth people who are tranfering to contact their agents and see if they say the same as Atlas.

Anyway I`ll keep you posted.

So excited for you!!!  Looks like we are only a couple of weeks behind you lovely people!!  I'll contact my Agent and am waiting for my Lawyer to send confirmation too.. 

Nearly in Spain folk!!!!   

Keep us informed as its just adding to my belief we did the right thing...

We will be R-2 No35 PGIII... remind me where you will be!

Oh I checked yesterday on Last Minute Web and the flights at the end of June are around £129....

Hi all,

I have found out that the administrator will not allow people who have transfered from santa ana to playa golf to go ahead with the purches. Alicia is the best person to contact regarding this matter, We have chatting to her this morning.

Our agent are now arranging for us to fly out and pick another property with another builder and to transfer all fundS paid. Its a sad  state of affairs, our lawyer has adviced us that its the wise choice to take up our agents offer as we could lose all monies paid to date. So i think we will not be moving to Playa Golf after all. 

Contact your agents and lawyers  for updates.

Hi

Atlas will be offering the similar property for the same price, where lawyers will chase up the money that is with San Jose themselves but they have told us that they will be transfering all the money we have paid to a new property with another builder because of the position of San Jose. ( we have changed properties twice with San Jose)

From our conversation with San jose this morning we belive all the people who are transfering to Playa Golf will not be able to do so because of the administrators. Anyone who has not been listed as a creditor I sugest you do so to be on the safe side. Everyones situation might be diffrent but  we are taking up the offer given to us from our agent.

Seems strange as I was chatting to a gentleman this morning who was looking to transfer his deposit to a house on Playa Golf 3... This chap had walked past ours a few times with papers in his hands and today we had a chat....He only got the list of available houses yesterday, with the ones marked that were due to be sold...He did say he was dealing direct with San Jose and was not dealing with Atlas anymore.
We have had maybe a dozen interested parties over the past 3 or 4 days looking to transfer from Jumilla to Playa Golf 3.
