My lawyer also confirmed that the licence has been issued and she is going for completion.

Has anyone got a copy of the license because my solicitor is unaware of this? I am all set to take Arenal to court for non performance of the agreement for failing to deliver by 30th September and then not deliverying the apartment within 8 months of this (ie end May). Arenal have refused to return our deposit even though we are legally entitled to cancel.

Have just received the following from my solicitor

 would like to inform you that the developers Arenal 2000 have confirmed us this morning that they indeed have already obtained the First Inhabitant Licence for the properties in Jimena. They have informed us that their intention is to start signing the Title Deeds at the beginning of September.

 

We will carry out the necessary searchings, and as soon as we have finalized them, wew ill establish a completion date with the developers and will request you the transfer of the rest of the funds into our client's bank account.

 

Please do not hesitate to contact me should you have any doubts or queries regarding this matter.

I have received another e-mail from my solicitor and one from Arenal 2000 comfirming that final occupation licence has been granted and that signing of tiltle deeds is imminent.

I have been asked to prepare final payment however i would like to have the property snagged and defects made good before I hand over final payment. Can anyone advise whether the solicitor should holding back some payments until Arenal have carried out any remedials that may need doing or whether I would be able to withold some monies as I would be reluctant to pay them everything as I am sure they wouldnt come back to sort anything out that was needed

any advice would be appreciated

I am not sure of the legal position re holding back some funds on completion for snagging. Given the way Arenal have treated us, I will certainly be asking the question.

I have received replies from my solicitor and an independant building inspector that no snagging can be done till the title deeds are signed then the developers will hand into you a sheet (in spanish) in order for you to take note of every defect you see in the property then the developers have a period of one year to repair all the defects in a property. You will not be allowed to hold monies back until the snags have been repaired

According to the surveyor I contacted  he reckons  that once you have signed, the Promoter he is obligated to accept your snag list within 15 days and he must repair them within 30 days which is all well and good if you live over there but If you dont then i assume that you have to employ a surveyor to do the snagging. I have been quoted 500 euros by a British surveyor to do this but  being a surveyor myself am a little reluctant to shell out. Hopefully my trip over at the end of Sept will tie in with all this.

However my main concern is that no matter what the rules are any defects will not be made good by Arenal.

Don't forget we must persue Arenal to reduce the price of the apartments due to the fact that it is not an exclusive development when we first signed and paid deposits.

Also there is compensation and interest  to given due to the delays.

Make sure your lawyer adrreses's these issues before signing the title deeds.

We should not let Arenal get away lightly for leaving us in limbo and not informing its clients about the progress of the development.

Just received an e-mail from solicitors that the developers want to start signing the Title Deeds of the properties from next September 19th 2007. They are wanting the balance of payments + 300 € of utility bills (charge for making the necessary contracts with the supplies companies) + 500 € as provision of funds for the community of owners + 500 € as plusvalía (this is a local tax to be paid for the purchase).

Anybody else been contacted to pay the final balance

Hi Folks

Does anyone know of any recommended persons who will do a snag list - someone mentioned it was 500 euros which seems pricey ?

My solicitor has also mentioned they wish to sign next week without any of the details.

hello have only heard once from my solicitor manzanares to say that the habitation licence had been granted and as i cant get over to spain for a while i am not pushing them for inf. however i did check my original costings and the community fees are included as well as the plusvalia at 300 and 700 respectfully so just double check your contact to make sure you do not pay twice. See you all in jimena next year then!

I have Manzanares as solicitors as well and have double checked to see if the community charges and plusvalia were included in their original list of of expenditures and they were not so they will be an add on for my costs. I have just arranged the balance to be sent via a currency exchange to the solicitors account so fingers crossed things go smoothly from now on though with the track record of this development i fully expect there to be some more stumbling blocks. Will be in Spain in a couple of weeks so hopefully get to have  look around and hopefully wont be too disappointed.

BTW I know there is no Air Con installed anybody know the best way to get it sorted?

Hi all, I am buying one of the apartments here and already live in Jimena. I have been to visit my apartment a couple of times in the last week to measure up and check it over. The sales lady on site is not a great source of information. I was trying to assess from her details about how the community will be run etc. but she could give no details. I have also asked the question of my solictor who also drew a blank. He said the official line from Arenal is that all this is yet to be decided.

As for the question of snagging, I went over the apartment thoroughly to check for problems. At the first visit the apartment was being cleaned after an internal re-paint. They haven't done the greatest job. There is paint all over the skirting, and it is badly finished. Other that that it seemed ok. One thing to mention. They had put the holder for the very poor quality shower fitting in the ensuite placed too high on the wall, and when we tried to slot the shower head in, it didn't reach and the cord ripped!

I went back to the site office with the sales lady there and she wrote down the problems I had pointed out. She said she would try to see to them before, but she showed me the form to fill in that we will be given at Notary with the keys (so if you are not offered it, ASK FOR IT!). It is a snagging list, in Spanish, but fairly straightforward to complete.

When you go round to check, check if you have the same problem with the shower.

Anything you need help with on the ground in Jimena, let me know and I will see what I can do.  Also I have a friend here who runs a property management company. If you are intersted in her services, let me know directly and I will pass on her details. We should all arrange to meet up when you are over signing on your apartments. We've had a bad experience up to now, but once we own the apartments, the running of the urbanisation will be the responsibility of the community commitee. If we want it to be a lovely place to live it's up to us to get involved and work together to make it so.

P.S. Anyone got a solution to the shower curtain/door problem in the main bathroom?!!

The shower problem referred to below is a bit of a conumdrum - refer to your floor plans and we will see that the shower tray comes out half way across the window. There are two issues with this. One, the window opens fully inwards so cannot be open when taking a shower. Two, this room has a false ceiling for the aircon so you cannot suspend a shower curtain from the ceiling. I am going to Leroy Merlin this weekend to check for potential solutions and will update on here. As an aside, I'm kitting my appartment out with goodies from Ikea. The nearest is Seville (2 hours drive) and the Malaga new store is delayed until the end of the year. If anyone would like Ikea stuff, check out their website, and provided I have enough room in my van, I'll help (for a small fee of course). Alternatively, I would be happy to show any of you around my apartment when completed, provide costings and then arrange for the whole fit out for you. Contact me directly and we'll see what we can do.

Hi I am new to this thread so please be patient with me. I did not know this site existed and so all this information I have been able to find out took far more effort that it should have. Would it be helpful if we all swapped telephone numbers so we can have full conversations about our experiences regarding this development? Also for people who are continuing (as I think I am going too) we can exchange contact details for suppliers, Gas, air con etc.

It the third block is to be social housing does this mean that the people who occupy are liable to the community charge, usage of the pool (which I understand has not yet met specifications). I know from experience that people who have lower incomes can see expenses such as community charges to be optional.

I have contacted my solicitor (Manzanares International Lawyers - Marbella) who I have to say are as useful as a chocolate tea cup. I asked Carlos del Valle if I could get my deposit back and his reply was “I don’t know”. He further argued that this was not his expertise but he would send my file to the office litigation department if I wanted. All I wanted was a professional opinion but he would not give one.

I did suggest that I could move my deposit to another Arenal 2000 development and the response from Arenal was that they may consider this option. After thinking this through I have decided against this because most of their developments are in the concrete jungles which is exactly what I don’t want

I have received a letter from Arenal who have informed me that the development has been granted its final occupation license and that they recommend all clients begin to make the necessary financial arrangements. Has everybody received this letter and is everybody prepared to continue to full purchase even with the long delays and the social housing block issues.

Finally (thank god I here you all shout) my apartment is Block 2 entrance 5 2nd floor – if you are my neighbour then please give me a call and I can apologise for one very lovable but definitely very teenage son. (music very acquired taste)

hello ihave just had an email from manzanares requesting that i transfer immediately over 6000 euros to them to cover the unicaja mortgage costs - 4500 euros plus the rest for manzanares extras. i simply dont have that sort of money lying around and this is the first i have heard of all this. i have written back saying i will withdraw from the mortgage i could just as well have taken a further advance here. anyone else in a similar situation?

 I have sent the balance of monies across and am told the title deeds are to be signed on 26th September. As I am in Spain next week on holiday I hope to pick the keys up on Thursday and go and check the place over a week on Monday as I will be stopping at the Anon on the Sunday night, also I have arranged for the place to be snagged as although I am a surveyor myself I had already made the arrangements and wasnt sure when the deeds would be signed as nothing to date has been on time.

I also have Manzanares in Marbella and they have at times been very frustrating in not responding to e-mails but have been a lot more co-operative these last few months. I guess its down to the luck of who your personal lawyer is, but I have gleaned most of my info off this site

BTW Ian007 i am in Block 1 so your son can blast out his music to his hearts content

Hi guys, (sorry put it in the wrong place before)
Just discovered this site.....should have done months ago...not to feel alone in this battle.....thanks Ian for pointing me to it....
I am one of the relocated buyers from block 3 to block 1 but I'm not 100% sure of anything anymore.
I am Spanish myself and have had the same problems that you have even speaking the language, they are so helpful, are they not? The only thing I can do without is a lawyer, we don't use lawyers in Spain to buy a property but I understand you do mainly for easying communiction.
There are now too many messages for me to catch up but one interesting one was about the fight to get the prices lowered with which I fully agree. What we are about to buy is not the same product we signed for at the beginning with block 3 being some kind of social housing (not the worst there is since at the end of the day is buying half the price we are paying!!!). So if anyone is going down that route I would like to join (contact details below) although I feel that should be done before signing the deeds and that seems to be around the corner now.
Some people asked about the community charges and I know that does depend on us and on the needs of the complex. I have got another flat and we have to discuss things like gardening and swimming pool extras, Arenal has nothing to do with that. However someone mentioned they want €300 + €500 that I don't understand what this is for. In my other flat when I bought it the developer asked each owner to pay €100 as a starting fund for the "community" that needs to be set up but apart from that I don't understand where €800 come from.
Anyway this is already long, please find below my contact details and don't hesitate to use them for a chat or for a strike with poster and banners blocking the road down the development if necessary....I am in London though........

I am in Spain at the moment expecting to pick up the keys this Friday 28th Sept but have just been told that Arenal are having problems regarding the water and electricity connections so am now advised not to sign the deeds until it is sorted so now wont be able to pick the keys up and my money is now over  in the solicitors account. i knew there would be further problems but it seems like one long farce from beginning to end. WHAT NEXT
