I paid my deposit on a ground floor 3 bed apartment in March this year.  So far I have had no trouble with Manzanares.   My point of contact Carlos del Valle, Office Manager,  has been very good.  I can email him with a query and he responds that day before close of business.  This is a far superior service compared to the solicitor I am using in Turkey. 

According to him Arenal are awaiting the First Occupation Licence from the Town Hall.  Until this is issued no one is allowed to access or occupy the apartments, not even the bank valuers!  Arenal were hoping that the licence would be issued before the end of the month.  I wouldn't hold my breath though.  From what I understand these things can take time.   It doesn't really matter to me when we finally get the keys but I feel particularly sorry for all those who have bought to live in.  The wait must be agonising.

We are also using Manzanares in Marbella, while they were very good at replying early doors they have not been as good over the last few months and it is only from this site that I can keep up to date with things. However they were recommended to me by someone who had dealt with them and was very satisfied. lets hope everything comes together soon

Having not had a reply to my email of last week from Manzanares I rung them yesterday. They did respond by sending me a copy of the requested items including the Bank Guarantee which does at least have all of the relevant names and stamps. I have had no paperwork for the mortgage even though it had been sent apparently so have re-requested this. The Puerto Banus work has been transferred to the Marbella office so hpoefully they will be better at responding. I do have (very cheap) flights booked for the first week of January to Malaga and the solicitor suggested I cancel them (which I wont of course) as there is no way that the paperwork for the apartments will be available till mid Jan at least were his words.I do at least feel reassured now I have the Bank Guarantee that everything is in order because there had previously been a distinct lack of paperwork other than emails.

It all appears to have gone very quiet! After the protests sometime ago (see my earlier posts), work was carried out the following day on the road up the side of the site. However, the roundabout at the bottom of the hill is only half complete, only one side of the road is tarmaced and the site appears abandoned. It looks like the work that was done was just to appease the protestors and show that something was happening. I cannot get anything from my solicitor other than the habitation license is the only thing holding things off. It seems there is a stand off between the town council and Arenal - Arenal not paying for the instracture (road) to be completed until the council give the license and the council not granting the license until the roads are finished. Meanwhile, us poor punters who have invested our cash can only sit and wait. If anyone has any updates please post them. I have got to the point where I would rather have my money back than wait indefinately for a flat that is only going to be used for friends and family to stay in when the visit.

263 people have looked at this posting.. that indicates to me a lot of concern !. Has anyone succeeded in progressing with obtaining their deposit back ... particularly as the habitation licence has not been issued and the bank guarantee has I expect expired. Remember that the law was changed and the deposits are held by a third party to protect the purchaser.... I understand solicitors are offering deposits back but Arenal are refusing to refund.   Use the law and numbers to get what is rightfully yours before you lose the advantage of not having the habitation licence,

Was there last week and the girl in the office did say they were expecting the licence at the beginning of Feb. Some workmen - about 6 were improving the slope to the water just beyond the road infront of the first block. sun was shining and I felt hopeful.

Have uploaded 6 photos taken last week - nothing too exciting as the best shots of the show flat are already there. One picture is of the Hozgarganta river 2 mins outside the village. Another one is the utility area - this one faces inwards so essentially 4 utility areas are facing one another but for the apartments located on the corners these face ouwards and have good views - the groud floor ones have a larger terrace. There are 3 photos of the lift area and hallways to give an idea of the door and floor finishings.

thanks for posting the photos this has given I & my patner some hope that everything will soon be sorted out & we can all move in & enjoy are new homes I just hope that there are no more setbacks once again thanks 4 all u are doing

A mini success - I've actually got a responce from my solicitor. Not great though. Basically, I have given Arenal another 8 months to complete by not giving notice to cancel the contract when the site was not complete by 30th September. I now have to wait until May before I can have my deposit returned if the development is not finished by then. Apparently, I can cancel the contract and have my deposit returned less a penalty now but I've not been told how much this is. I suggest that anyone not wanting to wait indefinately urgently seeks advice from their solicitor in case you "give" the developer more time by not giving notice. I understand that Arenal as still hopefully of getting the license but cannot say when this may be.

Hello everyone, my solicitor tells me that they are now waiting for just one signature at the town hall but things will not get moving before march. i am not personally in a hurry but would have liked to rent out the apartment for the summer to help with the mortgage so when THE DAY finally arrives it will certainly be at my convenience not Arenals!

Hi, just to say work has been pretty constant on the main road in the last two weeks which is positive. Today we were told that a number of the apartments will be given for Social housing, i'm not sure how this can happen but its something else to add to ongoing uncertainty.

There has indeed been a fair bit of work on the road recently. The left lane now appears to have had foundations laid ready for tarmac. I actually got a reply for my solicitor yesterday answering a question about my rights if I were to pull out. Apparently, I can pull out but it will cost me €3,974 or 10% of my 30% deposit. Worse still, I can't get the remaining 90% of my deposit until August!!! Check your contracts - I can't beleive that I can be penalised and forced to be out of pocket for the developer's failure to complete on schedule. On the up side, my solicitor also said that the town hall had requested some changes which Arenal have made (no idea what these were) and that the license should now be issued by March.

Hi, I was unaware about the social housing,does anybody know how many appartments have been allocated. I have contacted my solictor, hopefully he can also shed some light on this matter.

Latest information I have is that ALL units in Block 3 have been sold to the town hall. I have not been able to estalish if this is for social housing or for low cost accomodation (to help people get a first foot on the property ladder).

I don't know about ALL flats in block 3, as we have bought a flat in block 3, so I would be interested to know if anyone else has. In Spain, who would get allocated social housing?  I really don't like the sound of it!

Hi all

I was contacted via phone 2 weeks ago by a representative of Arenal who notified me that Arenal had decided to refund me all of my money because the sale of my apartment (Block 3 ground floor - 3 bed) was unable to progress to completion due to a problem with the Town Hall not granting the full licence.     I have agreed to be fully re-imbursed and the matter is now in the hands of my solicitors who promptly confirmed the next morning that the sale could not be completed due to a problem with Block 3.    Highly disappointed but I am already looking elsewhere in Spain to purchase and am planning viewing trip.   I must say that I am surprised that you were all still unaware of this latest development.

hi all I have also been told by my solicitor & areanl the I will not be getting my apratment due all of bloch 3 is up social housing I have also been told that I will have to wait for my money that I gave in good faith for yes you guessed it 6 months what a joke hopefully strength in numbers will see us all get are money sooner ( what would happen if we decided not sign & keep are apartments ??

I have called Arenal direct today and yes, all of block 3 is to be for social housing. The refund does include the reservation fee, but I believe we should be able to claim expenses (solicitor) and even compensation plus what about the interest we would have been getting on that money if it were still in our banks? Also, I have seen these flats back on the market at a higher value, so we are also potentially loosing profit on an investment.

I heard about block three yesterday pm from my solicitor. I am very very upset as I have an apartment on the top floor. I also have been told it will be fiv e months wait for my deposit plus a few hundred euros. Does anyone have a solictor who can tell us how to get two years interest as that is how long I have been waiting. I cannot speak Spanish.

It would seem the town hall has arenal over a barrel and told them to give block three for social housing or they would not get any licence Do you agree? Also I was told the apartments cannot be sold for more than the asking price for ten years which makes a mockery out of buying them as an investment. I can't believe I have been so stupid or are we just the victims of another Spanish scam ?? Does anyone know anything about buying property in Turkey ? Iit as dodgy? Feel like giving up on bying anything at all.
