Today we have been advised that the final stages of permits for Arenal Duquesa are soon to be granted.
 
The developers will be meeting with the local town hall next week in order to reach an agreement regarding the main access road. Once this permit has been issued  by the town hall, the road  will then be completed within 10 days and following this the final licenses will then be issued. Please note that this is only applicable to phase one. The construction on phase two will continue once the builders have site access.
 
We will be in touch again shortly once there is more good news to report.
i recieved this today from MRI and they are always behind with updates . As i have told you all, my lawyers  have already had the said meeting with the developers and the town hall and the agreement between them for the road has already been agreed so its looking imminent now eh!?  i presume the meeting next week is for the licences and not to agree on the roads.

As I understand it from my lawyer in Marbella, 30th June is the very last date for them to complete without us asking to pull out with a full refund. It doesn't look like it will happen before then does it??

no martin it doesn't look likely completion will be before end of june. definately not but if the licences are granted then i think cancellations might not be as straight forward because the developers will be in a position to begin completion. (which can take just a couple of weeks).  There are lots of get out clauses, i.e. to get costs back the problems have to be the developers fault and licences are not down to a fault on thier part.  cancellation at this stage includes no costs refunded unless you decide to take them to court. After June 30th people may start the cancellation process but if licences come in then completion could be quicker than cancelling (i know, there i go again being too positive!)  i may be wrong but  i don't think many people will go ahead and cancel at this stage now.

i, myself can't cancel  because i was not the original purchaser of my plot. i purchased from another person via an agent, but even if i COULD cancel, having seen the development and researched area and listened to feedback from other agents and people out there in duquesa, i wouldn't cancel now anyway.

of course, everybody is feeling different about things but i am just exited and every part of this has been part of the experience for me.  yes, i've been angry, frustrated, depressed even about it all but it'll be worth it. 

are you thinking of cancelling martin?

and Laurden... i've got everything crossed.  And if it doesn't happen soon, then my treck around manilva, marbella etc last week was all a waste of time and you lot will probably throw me off this site for good for giving you crappy information.    Maybe its Alan thats unlucky eh alan? this keeps happening to you no?!

Hi all and thanks Suzanne

I too had the letter from MRI when I got in last night - so far they have kept their promise to keep in touch every two weeks (but it's only the first note since being in their office two weeks ago!). Still I should be positive about it all.

Suzanne - the adrenalin seems to be pumping now you are getting closer to "the line" - it is all exciting and going to be a great location to holiday/live. Now you've done it once will you be buying a block of apartments somewhere  else soon!! (perhaps a few drinks first!!!)

Hi Suzanne, could this be it? Yes you are right you could say I have not been lucky with my information. There is a slight difference this time though, I also am with MRI and I haven't heard a thing so that could be good news! Fingers crossed.  (What's the saying unlucky with apartments lucky in love? Something like that.)

Well, we haven't had anything from MRI, but got a phone call out of the blue last night from Elena - yes, she's our lawyer too. Sounds like she's gonna be a very busy lady quite soon with all those completions to process.....

She says that the developers and town hall are having a meeting this week to agree contracts so that the developer can compete the road, which they reckon can be done in about 10 days. This appears to be the road up from the roundabout near the supermarket, giving access for Phase 1 occupiers to our parking etc.

Elena says that licences will be issued when this work is done. Assuming that nothing will happen in August, realistically, we're hoping for completion late August / early September. My birthday is 1st October and I want to down a bottle of cava on my terrace- sounds like I may be lucky...?

Elena also said that if we have any expenses caused by the delay, eg hotels, cancelled flights tec. to send them to her and the developer will consider compensation.Sounds a long shot but if any of you have substantialcosts caused by Arenal, eg storage, it's worth a try.

Looking forward to meeting our new neighbours soon!!!

Hi sounds great news I am going over on 8th July and hoping to see what is going on and maybe when I return can give you an update.

We have been waiting since October 2003 but it will be worth the wait as we are going to live out there.

Hi

Anybody heard any update on flygib low cost airlines. At present its possible to fly from leeds using monarch airlines but its expensive enough and if you dont live on the mainland then you have another flight which is more expense and more time consuming. It makes the convenience of spain not so convenient. Flying into Malaga is ok but if you dont drive its expensive and quite a journey to Duquessa. Im hoping to use Gibraltar but no signs of any movement on the low cost airline yet. Anybody heard why its not happening and is it likely to happen at all.

you are on a little island just like the one across the water......just off the mainland off europe.    flygib are dead in gibraltar....you will have to fly to malaga for the moment.

Another week has gone by with no more news.

How much longer is this to go on?  Snagging will probably take weeks.  Has anyone any knowledge of how this will happen on a large development.

I understand from my cousin that the fences have been painted!!!!

I am flying out on Sunday and I am hoping to get some answers.

Regarding the snagging,  I was told originally that the snagging would not take place until the licence had been obtained, maybe that has changed now due to the delay

have been told and legally it is correct that in Spain you complete on a property then inspect it for defects, the developer/builder then legally has 15 days to correct defects.  Whether they will go down the legal route remains to be seen.    Currently there are still no builders on the development, so who is to carry out the snagging?? 

Alas, another month has gone by with still no concrete news from the developer/builder, I have heard that some prospective buyers have proceeded to cancel contracts.  It seems very strange this couldn't careless attitude from the developer/builder.  I am in the process of looking into my cancellation option with my solicitor; personally for me I am quickly approaching the end of my patience.

I must say, with this sort of delay, we would by now normally have gone down the route of cancelling contracts but having viewed the property reasonably recently (end of April) we are feeling like trying to hang on in there. It's a great development, the quality of build is excellent and there is a good infrastructure to support the area. We came away from the development feeling good. Margo

Yes you are correct, after completion you have usually 2 weeks for snagging which you can do yourself or get an agent to do it for a fee, then you agree a list with the developer and the works done, simple in theory

Once the habitation licence is issued the agents will come out of the woodwork offering all kinds of services, MRI for example offer deep clean (which our apartment definetly needs), followed by spit & polish clean and snag check.

Our solicitor said that the developer would probably agree to a longer snagging period, maybe 3/4 weeks if we have good reason, I think that we will get a professional company to snag ours and then see how it comperes with things we spot

I agree and I am sure most people will agree that this is a great development. However, how long can you be told that completion will be in a few weeks only for that time to come and go, not once but time and time again. I beleive I have been one of the most positive on this forum but I am feeling now that enough is enough! I think some honesty from the developer would help. If he said we cannot complete until November 28th then so be it. It would be a long wait but we would know where we stood. Also what bothers me is, if the only problem is the road, which can be fixed really quickly, why aren't they continuing to build on the other phases? I am preparing for a cancellation unless something dramatic happens very soon. Even then I may still quit as the excitement has gone from this project.
